THese been the ordinances, that the Emperor hath caused to be red and declared in 〈◊〉 since/ to the states of his countr●●●s of those parties at their assembling to his 〈◊〉 ●estye the vii day of Octobre/ the year of our Lord. ●. v. C. vvvi. The which have be published through all the said countries the xu day of Novembre following/ aswell to the avoiding of the E●●herayn sect/ and other reproved sects/ as for the purveyance of the dysord●e of his Coin & orders to be set in the said countries. ¶ Cum privilegio Regali. Charles' by the divine clemency Emperor of the Romans ever August king of Germany/ of Castyl/ of Leon/ of garnado/ of Arragon/ of Navarre/ of Naples/ of Cecylle of Maillorke/ of Sardayn/ of Yle of Yndes/ and main land of the occian see/ Archeduke of Austryche/ Duke of Burgoyn/ of Latheryc/ of Brabant/ of Lembourg/ of Luxembourg. etc. ¶ Earl of Flaundres/ of Artoys/ of Burgoyn palentyn/ of Henau/ of holland oh/ zeland/ of Ferrette/ of Hagnenault/ of Namur. etc. ¶ Prince of zwave/ Markys of the holy Empire/ lord of Fryse/ of Salyns/ of Malynes'/ of the Cities/ and towns of Vtryght/ & doneryssell. And domynatour in Asye/ & in africa to all that these presents shall see/ greeting. For to understand and eschew redress the Errors and abusions concerning our holy faith likely for to come in our countries in these parties. To the abusions being in our said countries upon the feat of coins of moneys/ upon the diversities of customs that have been used. Of the abusion of notaries and scribes. Of ingrating aswell of victuals as of other marchaūdys●s. Of bankerotes. Of vagabonds. Of drynkynge/ & dronkennesses. Of the conveyance of horses out of our said countries. To the disorder of array against blasphemers & opprobryers of our lord god/ of the virgin marry/ and of saints with great irreverence to our mother holy Church/ and of her commandments in great disestimation of our ordynauncꝭ and to the great hindrances or interrestes of our subjects. The which for to order/ and to address a good true/ and hold amity & intelligence in our said countries among & between our subgectes'/ we have caused to propose to the estates of our said countries/ and given them by writing at their last assemble before us certain points and articles/ and upon the same to have their advise the which they have satisfied. Letting you to wit that this aforesaid considered (saying the said advise of the premisses in our prive council typely tried/ We continuing in our purpose for the honour & reverence of god our creature and to the exastation of his faith/ to the expulsing and extynctyon of the Lutherayn sects and other abused sectis to the wealth and profit of the comen wealth/ to the support and ease of our subjects from all wrongs and oppressions/ to their surety and rest/ and for remedy to the said abusions abovesaid/ by the advise of the knights of our order/ & of many other good & notable persons of our said countries/ the which we have for the same assembled and convocate: And with great & ripe deliberation have ordained and statuted these acts following. ¶ Charles. etc. first as touching the Lutherayn sect & other reproved sectis/ that our ordinances contained in our last letters of placard given the xiiii day of Octobre/ the year of our Lord. M.u. L. xxix. upon the abusing of our holy catholic faith/ and avoiding the perverse sect of Martin Luther and other reproved authors by our mother holy Church/ than and sithen published in these said countries and seygnouryes. And by us reviewed in form and manner/ as in our presence we have this said day caused to be red to the Estates of our said countries here assembled with us to be observed/ kept/ and maintained according to their form and tenor and that the penalyties therein declared & put to the offender to be really and rigorously executed without remission/ dissimulation or delay. And to the end that none shall pretend ygnouraunce/ we have willed and ordained our said ordinances to be published thorough all our said countries and lordships (in these costs) within all places where as Proclamations been wont to be done the xu day of the next month of Novembre. And fro that time every vi month till by us be otherwise ordained. ¶ And as touching the act of Coins and money/ we do ordain that the ordinance upon the same reviewed in form and manner as we have caused to be red to the said estates confermally at the last ordinance the ten day of Decembre the year xu C.xxvi. rypely deliberate by th'advise of all the estates of our said countries/ of diverse other persons having knowledge in feats of Coins & moneys/ of the generals or masters of the said Coins/ of the knights of our order/ and of the chief of our privy council/ and of reasourers/ to be in all points and articles observed and kept And for because that no person shall pretend ignorance: we will that it be published in all places/ as is aforesaid. etc. ¶ And for remedy to be had in abusyons proceeding of the diversity of the customs of our said countries/ & to the inconveniences that by them daily ensue in so much as oftentimes diverse pure customs contrary in one country be sustained and verified by diverse practycyens. And by the said means many of our subjects do lose their right to the great disprofit of the comen wealth. The default whereof is that the said customs be not approved and remaining in writing. We have therefore ordained that the customs of all our countries in these costs within vi months ensuing shallbe put in writing by the officers and men of law in all the towns of our said countries great & small And each of the same for the said towns/ their sheriffs or bayllyes/ and all other officers in their towns where they have administration and rule respectively to put the said customs in writing accorded in every quarter: and to bring them to our presence: and in our absence to our right dear and beloved sister the queen Regent for us to cause them to be visited and duly examined. And upon the same to take advise of our provincial counceyllers/ and other as need shall be/ & with good & ripe delyberation of council to confirm and ordain upon the said customs observation of the same according to equity and reason And for the most profit and commodity of our subjects in that behalf. ¶ Of notaries and scryveners. ANd to purvey against the faults and wrongs done in our said countries by notaries or common writers: some of them by simpleness and ignorance/ and other by deliberate deed to the great hindrance and loss of our subgectes'/ and of the common wealth. We have therefore enacted that from henceforth none shall be admitted in to that towme/ but well learned men and of good fame/ and such as by examination of the chief men of our provincial counseyl & judges of every country shall be found expert/ able/ & sufficient/ and approved/ and that it appear by act of the said counsel and provincial judges. And the said act by the said notaries (or they may exercise the said town) shall be bound to leave in the court rolls of the said counsel and to pay for every act only ten groats of flanders/ and upon pain arbytrary that none of both parties pay or take more than the said ten groats for an act. And we forbid all other not examined and admitted as is aforesaid to the room or office of notary or writer upon pain aforesaid and to be dysamyted for ever to exercise that office nor other. ¶ Of Marchaundyses engrated. ANd to understand the damages proceeding & that cometh of monopole or engrating which diverse merchants and other artificers of our countries in these costs/ use daily as well feats of victuals as other wares & merchandises in diverse manners. And to purvey against the unleeful bargains that many do/ for their singular profit/ to the great hindrance of good and faithful merchants our subgectes and other conversant in our countries here about & of the common wealth. We of our sentence & absolute power hath enacted for ever that no College of merchants of these parties nor strangers of any fellowship/ their broker's/ legers/ helpers/ nor likewise artificers nor other of what soever vacation faculty he be of/ meddle to make statute/ ordinance or covencyon tending engrating or monopole to make bargains contracts or pactyons unlawfully / To have secret knowledges/ as buying all one sort of ware or merchandise/ and keep it under them. And by that means to put & keep other that have need thereof in necessity/ & constrain them to buy the said wares at an excessive & unreasonable price/ at the pleasure of the said regrators/ and we defend and forbid them and all other to make and practic all other like damnable and pervycyous pactyons'/ contracts and abusions to the damage of the common wealth/ upon pain of banishment and confiscation of goods/ countries and places/ or confiscation of place/ and other arbytraryly according to th'effect of the misdeed. And we forbid all judges/ officers/ and to all our lyege men and lawyers/ and all other of our said countries: and to all them having or pretending authority to ordain/ enact/ confirm/ or make any such punitions and unreasonable statutis concerning such monopole. Commanding them expressly that if any such statutes come afore them to be broken and abolysshed And of our part we have declared and do declare them none & of no valour. And as much as need is we have revoked and fordone them by these presents In giving charge to all our purveyors and each of them in his behalf that where as our officers or other be negligent to do and fulfil this our will that in this case they proceed against them that be negligent or delayers in doing that/ that they ought to do without dissimulation as they find them: this to be done at all times/ and against them that do constitute or confirm any pervycyons ordinance or statute aforesaid/ or that directly or indirectly do against this present ordinance. ¶ Of dearth of victuals. ANd for to remedy the great dearth and dyfordre that been in these our countries of victuals as we understand proceedeth of engratynges that been used and done to the great hurts & hindrance of our subjects and specially of our poor commons and public wealth of our said countries/ we therefore will ordain and command our officers and men of law of our pryncypal towns of our countries that each of them in his room respectively & within iii months next following this day do rate & set prise reasonable on all manner of victuals/ and their concepertes with in the said time to send in to the hands of the rulers/ counceyllers'/ and judges of provinces where they have jurysdyccyon/ and they to over see and agre to the same as they think best/ and to send it unto us or to the queen/ our said moste dear and best beloved sister by dyscryte advise of council therein to do as shallbe thought most behoveful. ¶ Against bankeroutes. FOr to put remedy against bankeroutes/ we have ordained and enacted that all merchants men and women and all other persons what so ever intermytting in the feat of merchandise the which fraudulently or by wrong beareth away the money/ wares or debts of other merchants or persons to be & shall be holden & reputed for comen thieves/ & such we have proclaimed them. And like wise all they that knoweth the fraud and abusion of the said bankeroutes/ and doth meynteyne receive/ or hideth them where they be refuged except they show and warn the chief officers and lawyers of the places where they been. And in likewise they that do meddle in the doings of the said bankeroutes or in their absence do lead the train of occupying with them by fellowship or otherwise. And semblably they that dissimule or fain themself creditors of the said bankeroutꝭ and that with them shall use to frequent transports & simulations/ or in what so ever manner do them assist or help to the conveyance of their fraud and deceit. And all the above named and each of them we have privated fro the franchise/ surety/ and liberty of all towns/ boroughs/ and other places privileged with franchise. Also we ordain that the said bankeroutꝭ: their helpers & assistants above declared that shallbe found & known for such that for refuge do redrawe them in towns/ boroughs or other privyleged placis what soever none except that their goods by them thither brought or caused to be had thither to be taken out without prejudice. Albeit that the said towns/ boroughs and other places be fraunchysed & privileged in other causes. And that the said bankeroutes afore declared and their complices after that they shallbe known/ taken/ and attainted for such as thieves and robbers of the goods of the common wealth to be punished without favour or delay to the example of all other. And that the goods transported and conveyed by the said bankeroutes and the fellows to be put in sure keeping to the behoof of the creditors as belongeth to reason. And that the wives of the said merchants that maketh bankeroutes/ their husbands being present or absent have occupied ordinarily or commonly with merchandise and keep shops either in buying or felling to be bound and holden for to answer or make good for their husbands debts made and contract sith their marriage. And moreover we will and ordain that all merchants men or women that by cawtele or fraud to beguile their creditors absent themself from our countries by the space of xl days/ & be warned by common cries at the place of their abiding to return in to our said countries within xl days after to content their creditors/ that than they at the end of said xl last days and all bankeroutes fygytyves and their complyces above declared attaint of the same as is aforesaid to be banished for ever out of our countries and lordships and never after to return. And also declare all and whatsoever their bargains done this by simulation or cyrcunuencyon and fraud to be none & of no value. And we will that all the creditors of the said bankeroutes and of the complices and other so fled to come and portion like to divide and take upon the goods of the said bankeroutꝭ that may be recovered a marc the li without pference. notwithstanding that any of the said creditors chance to come afore another for to season upon the goods of the said bankeroutes and they fellows so that it be in a pryvyleged place. And notwithstanding the customs statutes/ or privileges of the said places/ if they have any/ against the which in any wise we do not mean nor will the causes abovesaid having place/ and as farforth as need shall be/ we have and will deroge by these presents. ¶ Of vagabonds. AS touching vagabonds we will ordain that our ordinances last specified in our sen●●e of placard proclaimed in all our countries shall be observed and the penalties enacted and set to be executed against the transgressors without dissimulation or delay. And that no person take ygnoraunte in them to be newly puplysshed the xu day of the next month of november/ and from thence forward from vi months to vi months till we have otherwise ordained. ¶ And for because that pnsently the poor people increase in these our present countries in over greater number then in times passed/ & that by experynce they are suffered all indifferently to beg and ask alms many faults and abusyons ensueth because they give themself to idleness/ which is beginning of all evils leaving thereby themself & children to do any handy craft or other style whereby they might get their living. And consequently apply themself to wretched and damnable living & their daughters to poverty and unhappiness: and to all wickedness & vices And though that they be young and lusty of body yet withdraw they by great importunity that that should be dealt otherwise to aeged/ sick/ impotent/ & them that be in great necessity. And afore our departing from these countries to remedy and set order in the common wealth. And over all that poor/ sick/ and other needy and not able to get their living may desocoured and sustained to the honour after the ordinance of almighty god our creature by very love & charity: we have ordained and statuted this that followeth. first that neither man nor woman put themself to ask or get alms be night nor day/ openly/ nor commynly/ covertly/ nor secretly/ in churches or streets/ in houses nor before them in any manner whatsoever upon pain in doing the contrary for the first time to be imprisoned with breed and water at the discretion of our officers and justyces/ men of law or other persons that shall have charge of this present act where as it happeneth. For the second time at the discretion aforesaid. Except fro this and reserved the relygeous man/ dyent persons/ prisoners/ and Lazars which may get their alms in their accustomed manner. The said Lazars to have their hats and wide long cloaks and other tokens as they ought. On condition that when they make their water they to go from the people as far as they may or can on pain to be punished as it is aforesaid with breed and water. ALso that no strangers forayns shall demand alms on like pain and correction. save them that be honest and not wont to brick & lewtre passing their way by pilgrimage or other devout way may lodge at hospitals and masondews one night only upon pain aforesaid. And to be received by the masters or mistresses of the said hospitals they shall be bound to recover and present them taken fro the officers or deputies at the condayting of the charity of the places where they would lodge. ANd that no poor folk shall pass fro town to town or fro village to village for to dwell or take residence upon like pain. But if by chance of war of floods mischief of fire or other inconvenience they be comen to poverty/ and that duly they make certyfycate to them may be ministered and allowed lodging or house. And otherwise not. And as for poor people now being in our said countries and have been resident one year they may abide in the same estate as they be & have part of the almesses that been or shall be ordained without going to beg openly or secretly as is abovesaid. aLso that each of them shall keep their children great and small from begging or asking of alms upon pain aforesaid. And the said children to be correct with rods and otherwise at the discretion of the said officers or men of law of the places where they come. ¶ And to take all the offenders of our said ordinances and deffences afore said there shall be ordained and deputed in every town and village by the officers and men of law/ one or two sergeauntꝭ or more if need be after the bigness of the places. ¶ And to the sustentenaunce of poor seek and other needy persons not able to get their living/ being resident or dwelling in towns or vyllagꝭ of our countries/ we ordain that all the charytees tables of poor hospitals: brotherhedes and other that have obytes and distributions of prebends and almesses be made one common purse to be dealt to poor people/ by the abvyse of the masters & rulers of the said tables of poor hospitals and brotherhedes/ with them that the officers and men of law in every town/ parish/ or village shall depute and commit to the behoove of the charity in the manner hereafter declared/ save that the almesses founded for spiritual persons as mandyentes and other shall be divided at the order of the founders. ALso from hensforewarde in every parish church of the towns & village of our countries shall be set tronckes and blocks to put in the secret alms of good people. And the said blockꝭ and tronckes to be shut with three keys of the which the parish priest shall have one the men of law one/ & the third to him or them that are committed to deal the said alms/ for to take out the said money that they find there when they thyn● best tyme. And moreover there shall be deputed in every parish church by the officers and men of law there an honest man or two to gather for the poor folk in the said churches/ ones or twice in a week/ or as often as they shall see needful And also the said deputies of every parish shall go once in a week or oftener to the houses of the dwellers & ask alms for the relief of poor people. And aswell the said deputies that so gather the alms as they that deal it to the poor shall be bound to yield account every month of their receptꝭ: and lyenges out to the officers/ men of law or their assigns in a common place in the presence of all them that wylcom thither to here it. ANd for to rule and conduct this work of charity there shall be elect and chosen by the officers and men of law of the towns and villages certain persons of the best estates or qualities. The which chosen and deputed/ we require and ordain that for the love of god and perfit charity to accept the charge and to keep the order and rule to them given And that they so chosen and elect may take and commit a receiver under them to keep particular account of the said almesses and dependents or belonging. And they so committed shall or cause to make diligent inquiry of the number/ estate/ quality/ & condition of the poor people each in their quarters/ of what occupation & age they be of/ of their charge of children and what gains they have or may make. ANd they so committed in every parish shall make or cause to be made regystres/ and in the same clearly write the effect of their inquiry/ that is to wit the number of poor folks in every house/ & the portion of money needful to them above their gains in regard of their faculty/ necessity/ and charge. ALso the officers and men of law by the advise of the chief & honest men/ shall devise to gather in one common purse all the almesses of what sort so ever they be: for to deal the money weakly in his parish to the number of the poor folks at the discretion of them so committed Be it in money/ breed/ would/ clothing or otherwise alway by them regarded the quality & condition of the said poor folk. And to give no money to drunkards/ idle folk/ gamners'/ hazarders/ nor other like. But breed/ would/ clothing/ & other necessaries to maintain them in their households. And the said ill disposed of their persons shall be constrained to work & to bring their gains home to their houses upon pain to be put from the alms of the said purse & of other penalty as shall be thought according. ALso the prisoners/ sick folks/ and other that can not go out of their houses or lodgings/ and women in childbed shall be visited and helped/ & purveyed with the alms of beds/ sheets and coverlyddes/ of meats/ fuel/ and other needs. And in likewise orphans and children that be foundlynges shall be nourished by the said alms. ANd that the children of poor folkis that before this present ordinance were vagabonds living by beggary/ some of them shall be set to school/ and other to learn occupations/ or other feats/ or to serve honest folks. And they that learn occupations/ shall upon sundays and holy days learn their Pater noster. their believe/ and the commandments of the Church of the school master that shall be therefore ordained/ And he shall lead them or cause them to be led every sunday to mass/ to the sermon/ & evensong. And to the end that the said children may be more apt to serve & learn/ they that been committed to do the said charity shall purvey them of raymentꝭ and other things behoveful/ and to cause them to be cleansed from all filthiness/ and heal them of all their diseases/ as farforth as the almesses may bear. And the officers and men of law with the said commissioners to deal and order the said deeds of charity as in their consciences they shall think best in the same. ANd that all the poor people living of the said alms and charity have and bear a mark upon their gowns/ at the ordinance of them so amitted. ALso that all curates/ and preachers in their Sermons and hearing of confessions in making of testaments/ & ordering of last wills/ to the good maintenance and furthering of this ordinance and works of charity shall do the best of their devour to exhort/ induce/ & move the people thereto/ to give and depart with their goods. ¶ And if the poor folks relieved with the said alms do complain to the said curates or preachers/ or to other/ that the said alms is not done to them duly/ the said curates preachers and other to take no light credence of them/ but to comfort them with meek words and send them to the orderers of the said alms to be purveyed as they ought to be/ and who soever knoweth that the said charity and alms is dealt to such as it ought not to be/ or that some person for shamefastness or simpleness dare not discover their need/ they to show it to the deputies/ & after information made they to be by them purveyed. ANd we forbid that none what so ever he be take on him from henceforth to lodge any of the said bryboures or idle women beggars but one night only upon pain to forfeit three carolus of gold/ the third to the accuser/ and the rest to the profit of the alms of the charity. ALso we defend all them that by themself/ their children or other do persever or receive part of the almesses of charity from henceforth to go or haunt taverns or cabarettes/ or other like places. Nor the play at caylles/ bowls/ & other games foreboden upon pain arbytrayre. Suffering them sometime for recreation to drink a pot of seruoyse with their wives so that they drink not drunken ANd to the end that this present work of charity may be observed & kept for ever to the honour of god/ and relyef of poor people we have consented ordained and granted to all our officers and men of law: and them that be committed to the said deeds of charity through all our countries/ each of them respectively in the place of their administration that at all times and as often as need shall be to fulfil amplify and make better this present ordinance by new statutes which they shall perceive and know to serve & be profitable to the wealth: furtherance/ maintaining/ and augmentation of the said charity. ¶ Against disordinate drinking. COnsequently to remedy the disordinate drynkyngꝭ and dronkennesses used in these our countries in diverse cabarettes/ taverns/ and lodgynges kept in by ways out of towns/ borrows/ villages/ and high ways/ and other places on dedication days/ feestis and kermesses. And to eschew the strives/ manslaughters and other incovenyences thereof proceeding/ we have statuted and ordained that all the feestes/ kermesses/ and dedications in each of our said countries be kept upon one day such as by us or our most dear and right well-beloved sister the queen Regent in our absence/ by the advise of the governors/ counceyllers'/ and judges/ provyncyalles of the said countries/ shallbe ordained & declared within four months after this day. And that the said kermesses and dedications shall last but one day only/ upon pain that they and every of them that be found & keep the said kermesses & dedications longer or past the day ordained to forfeit as often as they do there against xxx li. parysies. ¶ Of brydales or weddings. That they that keep brydales in all our countries and lordships/ shall not bid but their next kynsfolkes and friends on both parties/ to the number of twenty persons at the most. And that the feast of the said weddings shall not last more than the principal day/ and the next day till after noon/ upon pain to be forfeited by them that do the contrary/ as well they that keepeth the weddings as they that cometh in more number and be not of the next kinsfolk. And they that be there longer than it is said/ for each one of them twenty carolus of gold. ¶ For bidding of gossips. WE defend also that none of what estate he be of/ to pray or desire godfathers/ or godmothers to the christening of their children/ to have or receive any gift or profit. And if a present be given or offered them. We defend them to take it. And likewise we forbid them that been desired to be godfathers or godmothers to give them any thing. On pain to forfeit aswell the givers as the receivers/ at every time that they do so the thing presented & received/ and the double of the worth thereof except it be to the children of poor & miserable needy persons. At whose christening the godfathers & godmothers/ for god's sake may give their alms at their pleasures without mistaking or offence. ¶ Against blind hosteryes. THat from henceforth within our said countries and lordship's none shall keep taverns/ typelynges/ or lodgings in by placis out of common streets and high ways out of towns/ villages: or hamletꝭ. On pain to run in forfeiture twenty carols of gold doing to the contrary. And they that lodge or shall drink in the said cabarettes by ways to forfeit vi golden carols at every time so doing. ¶ Taverns to be shut on sundays. THat frohensforth none of what estate or condition he be of presume to set people in tavern or cabaret on the sundays/ & other holy days commanded by the church/ nor for to drink at high mass time/ or even song. On pain that they and every of them/ at every time so doing to pay amends of lx groats of the money of Flaundres. ¶ Of manslaughter by drunken folk. ANd for to set remedy to the great number of manslaughters done daily in our said countries by drunkenness or under trust of forgiveness easily to be had/ we have instantly required & ordained to our said moste dear and ryghtbeloved sister the queen/ and expressly commanded to the chief men of our prive council that at their coming they give not lighter remission of homicides nor other causes proceeding of drunkenness: but to the contrary if they may take them in drunkenness that hath committed manslaughter or any other evil deed/ to punish them first for cause of their drunkenness And than for reason of their slaughter or other greiffes by them committed without delay as they can find by right equity and justice. WE will also do enact and ordain right expressly that they committed and to admit in our name at the renewing of the laws of towns & boroughs of our said countries that they do not move or set any persons in the law which they know to be named or famed dronklewe & customably excessive dronkers. And if unwares they have amitted any in to the law/ that customably were drunken and after being in law persevereth dronklewe/ In that cause to dysmysse them of their office what ever it be for ever. The pains and amends ●●ouesayd to be used/ the half to our profit/ A quarter of the profit to the shower thereof/ and the other to the office that executeth it. ¶ Against excess of array. ANd for to redress the great dysordres & excesses among the lyege people subjects and other evil inhabytaunces of our said countries clothings and array to the insupportable expense and prejudice of the common wealth. We have statuted/ ordained defended and foreboden by these present statutes to all our lyege people be they Duke's/ princes/ Marquyses/ Earls/ bannerets/ noble man or other our subgectꝭ/ dwellers & inhabytyers of our said countries in these parties of what estate/ quality or condition that they be of to women as to men without any exception/ the wearing and use of all sorts and manners of clothes of gold/ of cloth of silver brocartes of gold and silver/ aswell in cloaks as capes/ dowblettes/ jerkyns/ coats/ & jackettes in sleeves or half sleeves or in bordures/ gaderynges or manner that is more or less that otherwise in any sort or it may be. And like wise all brawderyes of gold or silver upon any manner thing that it may be. THat none of our lieges or subjects of what so ever estate quality or condition he be may or shall from henceforth were gowns/ mantelles nor jackets of velvet or cremosyn satin/ but only princes/ marquis/ earls/ or the knights of our order/ and lords/ bannerets of ancient nobleness: or the chief of our prive council & their children the chief of officers & head officers of our house. In keeping by themself and eachone of them certain number of good horses to the behoove of their estate and vacation. NOr none of our lieges or subjects or other dwellers or inhabytyers of our said countries other than the forenamed may or shall hereafter were gowns of black velvet/ tawny or other colour/ nor cremsoyn/ but if he keep three good horses for the saddle/ whereof two of them shallbe. each of them of the height of xvi palms and a half at the least. And that none but them above named may or shall frohensforth were gowns of satin or damask/ but if he hold two horses/ one at the lest of the height of xvi palms and a half. ANd furthermore that none of what estate he be of mayr or shall were cote of velvet/ satin or damask/ but if he keep one good horse of the height of xvi palms and a half as is abovesaid. On pain to do the contrary at every time so doing of the confiscation of the gowns and other raymentꝭ gardyngꝭ/ and brawderyes that they do were against our present ordinance in the countries and places or confyscation of place. And beside penalty arbytrayre indifferently of the value of the said raiments/ guards/ or brawdrynges/ & the said forfeit confiscation/ and penalties shall be the half to the profit of the parish church or other churches of the place where it is found or had/ at the ordering and discretion of the judges/ one quarter to the profit of the bringer forth. And the other quarter to the behoove of the office that executeth it. ANd in the ordinance as is abovesaid the women and children shall be ruled according to the degree of their husbands & fathers. And the widows in this behalf shall remain in their widowhood and be reputed as they were in their husbands days. ANd that they which have raiment of silks may pourney themself of other. And that they that would were garments of silks may purvey them of horses/ we have consented and agreed that they that have raiments of silks may were them if they please unto christmas day next following And that they that would were silks/ may purvey them of horses within the same tyme. provided alway and that we defend forbid that at the said feast of christmas that they that have no horses as we have said shall not make new clothings of silks. And the tailors shall not make them/ but that by the chief officer of the place it be certified that he that would make new garments of silk be purveyed of horses as it is ordained. To the observation whereof we have enacted and ordained that all officers and each of them make diligent visitation every three months/ if they that were silks in the limits of their offices do keep number of horses confermally to the said ordinance. And their visitation to be put in writing by manner of Inuytorye of them that keep horses. And they to send them every three months to the queen our sister. On pain of forfeiture of a. C. carols of gold every time that they do miss to be put to our use & profit/ to the end that our sister the queen may know every three months what number of horses we may recover in our countries. ¶ For horse's. FOr to retain the merchandise of Horses in our countries to the wealth & profit of many of our subjects that make merchandise of them/ we have defended and forfo●●) to all persons be they our subjects or strangers to carry any Mares out of our said countries/ On pain of forfeiture of the said Mares/ and also the valour of them the half to our use One quarter to the finder/ and the other quarter to the office that executeth it. ¶ We forbid and defend to all persons our subgectꝭ or strangers to buy any horses in the plain countries: & to all other for to sell them out of free fairs or markets. On pain of forfeiture of the said horses for the sellers & the value of them to the buyers. In this reserved our servants of our household/ and men of our ordinance/ the which for our service and their riding may buy them in the plain countries. And they that have such horses to sell them to them as well as in frefayres without offending. ¶ Against swerers & blasphemers. Consequently to redress & put remedy against blasphemers/ we have defended all persons to blaspheme our lord god the virgin Mary/ the saints or their names. On pain that they that forsake god/ dysavowe god/ or despite him/ his mother their names or the saints: to be imprisoned the space of a hole month in a deep dungeon with breed & water. And they that so do blaspheme with hard and felonous hearts/ beside the said prisonment to have their tongues pierced openly upon a scaffold with out grace favour or delay. And they that make any other vylayne oaths to be punished in their bodies arbytrarylye at the discretion of the jugꝭ under whom the said oaths be made/ or of him that hath knowledge thereof. And that the said judges dissimule nor deffer the punishment of blasphemers/ or fowl swearers in manner aforesaid. On pain to be private and put out of their offices for ever: nor to recover or exercise any other ¶ Of mutuell friendship among subjects. AS touching the mutuell intelligence and amity between our said countries and subjects/ the which we have ꝓpose to our estates of our said countries in their assembling last with us. considering that in the said intelligence confederations and good amytees consisteth & dependeth chiefly the force/ the surety/ and rest/ and in effect the wealth of the commynte of the said countries. We them required and ordain most certainly. And upon as much as they desire to obey us and do us pleasure and for their own wealth/ surety & rest/ as they been all under us their only prince/ natural and sovereign lord/ that likewise they love each other and have mutuell good and true intelligence and love that they converse & haunt lovingly one with another/ & to entremedle and use together in all things/ whereof the commodities more in one county than in the other and as neighbours friends/ and subgectes constytued under one prince been bounden & ought to do. And that they assist/ & help each other in their mutuell defence/ surety and tranquylyte. ¶ And if that occasion of dyffycult chance between any of the said countries that it be avoided lovingly among them if it may be. if not/ with the means of the governors of the said countries eachone to his power or where need shallbe by intervention of our said right dear and well beloved sister the queen without figure of process. Nor likewise any books that sith ten years hitherto have been written or imprinted without showing the names of the auctors/ printers or writers/ nor the time and places/ when they were compiled written or printed. Nor also the new testament/ the gospellꝭ/ epystoles/ ꝓphetyes nor other what soever books in french or Thyriz having prefaces/ or prologues/ apostylles or gloss containing or touching any doctrine/ or error or any wise derogaunte or repugning contrary to the christian faith/ to the sacraments or commandments of god and of the church or to the doctrine of the same. Nor like wise to paint portray or cause to be painted portrayed/ to have/ hold/ or keep any images/ portraturies/ payntynge/ or opprobrious and dyspyteful figures of god of the blessed virgin Mary/ or of saints. And moreover that none of what estate that he be of presume to talk or dispute of holy scripture in doubtful matters or diffycyle/ but if they be right well famed & approved Theologyens by famous universities. On pain to them that do the contrary of confiscation of their bodies without grace/ respite/ or delay. That is to wit of them that here before have committed any error and being abjured and been fallen therein again to be executed by fire. And other/ as men by sword. and the woman by the pit/ and their heads set there about/ in example of other/ & the forfeiture of their goods or of place. ANd that none of what soever nation kind/ or condition presume or advance them from henceforth to translate/ write/ or print/ plane/ or bind within our said country of Brabant any books/ quyres/ or what soever doctrines of holy writ in french/ or thy ris/ nor in other speech than latin. Nor also to cause to make/ nor to bring or cause to bring in to our said countries/ any of the said books/ or other/ translated/ written/ or imprinted in other countries without the leave of the ordinary/ or of you chancellor and men of our counsel in the said countries/ and your approbation of the said books quayres or writings. ANd that none presume frohensforth to print or write/ or cause to print or write any new books/ quayers/ or volumes though they be not composed by Martin Luther/ or by them afore named or other suspect & reproved auctors or any of them/ and that the said books or writings be no treaty of any herytycall matter/ erroneous/ or suspect/ but that the said books quyers/ or volumes be ecclesiastical matters till the ordinary or his deputy have visited and approved them. And that the said printer or writer neither for to print nor write them: but if they have for the same obtained our letters patentꝭ of grant & licence upon pain of doing the contrary without grace or respite upon a scaffold to be marked with a hot iron in manner of a cross so sharply that it may not be put a ware/ or to have one eye put out or one hand out of/ at the discretion of the judge/ to the regard of misusing 〈◊〉 breaking of the said ordinances WE also ordain and statute for a commandment that no host nor hostess nor other persons/ of what nation estate or condition they be of wittingly lodge receive favour or sustain any heretics or abusers of the faith of the sacraments and ordinances of the church: or that hath done against our statutes & ordinances. And that all they that have lodged them/ received/ favoured/ or sustained/ knowing them to be such/ and that they do continued in their false errors to show which they be/ (within xu days next following the publication of these presents) to the chief officers of the next good town of their abiding. On pain of failing thereof of forfeiture and loss of their bodies without respite/ & also their immovable goods of confiscations of their movables. ANd that all they that here before have been/ or hereafter shall be attaint of heresy or abusing of the faith or sacraments/ or constytutions and ordinances of the church shall not from henceforth company nor talk one with an other of matters defended by the church. On pain of confiscation of their bodies and goods lying in country or territory/ of their movables. ¶ That none attaint or by information precedent vehemently suspect of heresy or error in the faith or of the sacraments and ordinances of the church/ shall not exercise/ have/ nor keep in our said country of Brabant/ of us of our lieges/ or other persons. Nor in towns or other places of our said country any honourable estate what soever nor be of our councils in any towns. And defend our officers & commissioners at the renewing of the laws of our said countries to admit them to shyrefshyp or any other manner estate or room. ANd desiring to purvey for the knowledge of heresies/ errors/ and abusions against the catholic faith/ the sacraments and ordinances of the church/ which be or may be in our said country/ we accord and ordain by these presents/ to them that do name and show them/ or to our justycꝭ and officers as it shall be seen. They that been accused to be duly attaint and convict. That is to wit of each of them that do not exceed C. li. of groats/ money of Flaundres for one tyme. And if they exceed the said. C. li. of groats/ we accord and ordain that over and above the half of the said. C. li. of groats/ the said showers namers or accusers to have the ten penny of the goods/ & that that is exceeding the costs and expenses in the suit of justice prealably deduct of the said goods/ we will that to the honour of god it be bestowed in works of pity & mercy. The which ordinance in the advise of the estates/ & great number of notable and good persons of our countries expert in the knowledge of featis of money/ of the generals or wardens of the said moneys/ of men of our provyncall councils and of our recepts with great and ripe delyberation of the late our right dear & well-beloved Lady and aunt tharchduchess of Austryce. etc. than regent for us in our said countries/ whom god assolue. And therefore it is not very possible to value them justly. And if they were valued the poor simple people could not know them. We have forbode and defended in our said countries the course of the said patters and grant blanks and all white money of france till that our right dear and well-beloved brother and cousin the king of france and we have agreed of the pre/ alloy & of the price & valuation of our moneys/ or that otherwise by us be ordained. ANd the groats/ half groats/ gigotz/ little pens & other pens of Holland/ and other pens/ half pens/ courts/ & mites/ forged in our moneys shall have conse in our countries as they are wont. And it is to wit that with the said half groats and other money under them no payments shall be made/ or course of rents of merchandises or other. aNd as for other pens of gold or silver not heretofore valued (of what coin or for soever they be) we have declared them byllyon and forbid the allowance/ of them in these our said countries at any price/ nor by commutation nor exchange of any wares/ or moneys gold or silver. On pain of forfeiture of the said pens & of l floryns of gold karolus for the first time: For the second time/ of the said pens and a. L. karolus And for the third of the said pens and of. CC. karolus or other arbytrary penalty at the discretion of the judges/ after the xigence of the case and the faculty of the offenders/ If it be not by the hands of the exchangers ordained by the said generals in our said countries. The which exchangers shall be bound to give the value and cut them & have them to our mint to be melted/ On the pain hereafter declared. ANd that our present ordinance may be the better kept/ and that our countries and subjects/ & them that be there resident or conversant be discharged of the avauntagyous moneys of gold & silver by this present act declared byllyon/ we ordain that the generals of our said moneys within the xu day of Novembre that our ordinance shall be proclaimed or soon after go forthwith conjointly or severally to all the chief and other towns/ boroughs/ and franchises of our said countries where as need shall be. And by the advise of the officers and men of law therefore purvey on our part/ if they have not done it already/ And if they had/ and their provision be not observed of exchaungers able folk and convenient for to buy the said pens of gold and silver dyffended/ and giving to them that hath them the price and value/ cut them in the receiving and bear them to our mints/ so that the said exchangers have reasonable salary of it/ that is to wit three patters/ for every li of groats money of Flaundres of the metal of byllyon gold or silver that they do change/ more or less after the instructions that the said generals do give to the said changers. And the said changers at their instruction to make solemn oath in the hands of the said generals/ or one of them in the presence of the chief office and men of law there as they are committed inviolably to keep their instruction. On pain of loss of their offices/ & to be proclaimed unworthy for ever to beat office in our said countries and of vi C. floryns karolus of gold/ and other pain arbytrary. furthermore we forbid the said exchangers nor other of what estate or condition soever they be to try the heavy pens of gold or silver forged in our moneys nor other valued by this present ordinance from the light pens for their advantage. On pain for every time so doing each of them vi C. floryns karolus/ and to be private of their room and offices beside penalty arbytrary. And other that be no changers nor our officers. On pain of an. C. karolus and penalty at the discretion of the judges. ALso to eschew and take away the occasion of the raising and enpayring of moneys which men say is proceeded of the calculation and reckoning by pounds solz and pens of groats moneys of Flaundres or Brabant/ which is used in most part of the chief countries in these parties/ we do ordain and enact by commandment that frohensforth all our demesnes tayllyages our mills meadows/ and woods. Our rents & other goods. Those of prelate's & other men of the church. Also of our servants and other of our countries and lordships of what estate that they be. All contracts of merchandises/ hiring of goods/ of seruaantes/ and in effect all convenants whereof so ever it be/ be made/ paid/ and fulfilled with floryns karolus of gold of true weight & alloy of our new coin at the price of twenty patters the karolus/ or of other money gold or silver valued after the rate as abovesaid. And that if any convenants of what soever it be sith the first day of March the year xxvi last/ that our ordinance of the ten day of December in the said year confirmed to the ordinance of the year twenty is begun were made at poundꝭ of groats of flanders and Brabant. we will and ordain that albeit in the said case any be or shall be bound to pay for the fulfilling of such convenauntes vi floryns karolus gold for the pound of grotis of flanders four for the li of groats of Brabant & one karolus of gold for every li of xl groats. Nevertheless if by contracts of rents or otherwise preceding the said first day of March the year xxvi last it were otherwise appointed such contracts may be fulfilled after their tenor/ and of the writings that been made and expedyed. ⸫ ⸫ ⸫ Moreover for surety of the observation of the said ordinance we have ordained that all sentences of condemnations/ of penalties/ and amends (that shallbe made and rendered in to our prive/ great/ and other counceylles. Also over all our jugꝭ/ officers and men of law of towns more and less or other places of our said countries as well by the judges and officers/ of prelate's/ of our servants/ noble/ and other folks/ having jurysdyccyon in our said countries) be made with karolus of gold of our said money/ & be paid in karolus at the price of twenty patters or in other money valued after the rate. And also that the wages & pensions that we give or shall give from henceforth to all our pencyonaryes/ to them of our household and all our officers be counted & paid in karolus of gold. And that in likewise it be done by folk of all estatis in our countries and sygnoryes. And that all lyterages that from that day forward shallbe sped in all our countries in whose name and by whom it be in coin of gold or silver they make them to be sped and expedyed with floryns karolus at the price aforesaid/ and of less some in valued patters. ALso that none of what estate or condition he be of to presume fromhensforth to receive or give: nor also to present (to whom so ever it be) pens enualued lesser than price/ nor at more price than this present ordinance beareth/ nor also the pens declared for byllyon at any manner price/ by way of commutation nor otherwise in to the hands of changers as it is said. On pain of forfeiture of the said pens and of l karolus of gold for the first tyme. For the second time the said pence and. C. karolus. And for the third of ii C. karolus and other penalty arbytrary as abovesaid. WE also defend that none of what estate he be of to transport or cause to be transported or borne out of any of our said countries and sygnouryes any light pennies of gold molten or unmolten or any masses of gold or of byllyon. On pain of forfeiture of the said pennies & masses and of ii C. double rials of gold for every mark of gold/ and of. C. rials of gold for every mark of silver for every time/ and every one that so doth. WE defend also to all our receivers our demesnes of our aids/ rentis and other goods. To the masters of our chambers ol treasoury/ to the treasurers of our wars and our other officers of recepts/ herein comprised our officers of comptable justice/ that they do not receive/ give nor allow gold nor silver from one to another/ for any manner cause at higher price than we have ordained. On pain of forfeyting of a. M. karolus of gold/ and loss of their offices without ever to recover them. aNd for the more surety of the observation of this present ordinance/ we have ordained (that all our officers in the towns & other places of our countries in these parties) at the day that the same is proclaimed. Also the men of law of the said towns and other places/ to be present at the said proclamation. And that the said men of law make solempite oath upon the crucifix in the hands of the said principal officers of the said places/ invyolately to observe the said ordinance. And that all the bourgmaysters/ mayors/ shyryffis/ of our towns/ villages/ bourghes/ and other lordships at the day of the renewing of the laws of the same beside the oaths that they are wont to make by reason of their room to swear solemnly to observe the said ordinance of moneys or that that we or our successors at the said time shall publish. And that they and every of them to their power to acquit and behave themselves at the indication/ condampnation/ punishment and correction of the transgressors of the said ordinance/ and to the execution of the penalties and amends thereto ordained after the tenor of the same. On pain if they fail to be at the said proclamation (if they be in place where it shall be) & to make oath to the pnseruing of the same/ as soon as they be in their office eachone of a. L. karolus of gold of their proper goods. And on pain that our said officers: and the said sheriffs and men of law be negligent to proceed to the indycature & correction of the said transgressors after that the fault come to their knowledge of privation of their offices without ever to recover them. And moreover of vi L. karolus of gold for amends each of them of their proper goods without delay or grace. ALso for our officers of receit & justice of auditors of our countries and lordships/ we ordain that within xu days after the proclamation of the said ordinance at the ferthest they make solemn oath for keeping of the same in the hands of our auditors before whom they are bound to account. And if they be far of/ they may make the said oath in the hands of the chief justice of accounts. And the said oaths made the clerks of the courts of justice thereof shall make a register. WE ordain also that all our officers eachone in the limits of their jurysdyction/ and the generals of our moneys and every of them in all our countries & lordshyhppes to inquire diligently of the feat and doing of our subgectes'/ and other resident and conversing in our said countries: & if they keep the said ordinance or not. And that they may the more easily come to the knowledge of the same: we have given them commission/ power/ authority/ & commandment/ & specially by these presents singularly to our said officers to inquire/ & examine by oath & faith all them whom they will if they know any that hath offended (in their jurisdictions) against this ordinance. And we command all them that been inquired to tell the troth/ On pain of an. L. karolus of gold each of them/ or of other arbytrary pain. Ordaining our officers each one in his jurisdyccyon to proceed against the offenders in the penalties ordained. And that the generals of the moneys report unto us of the offences that they find/ or to our most dear and right well-beloved sister the queen: or to our said chief & men of our prive council & of our finances to purvey therein as it behoveth. ANd that the said penalties above declared be distributed/ the third part to our profit/ one third part to the accuser/ and the other third to the profit of the office that diligently executeth the said penalty. And the said penalties we will & ordain to be executed precisely any opposition or appellation made or to be made notwithstanding. And if any of the trangressours appeal or oppose fro execution of the said penalties we ordain to the chief president & men of our prive and buy council/ & to our chancellor & men of our said council in brabant/ and to all officers and men of law of the said country/ and other in knowledge thereof each in their degree that they agree not to the said appeals letters of releyf no: other provision containing clauses of inhibition. ANd for because that none shall pretend ygnouraunce in our said ordinance and edyct/ we will that it be proclaimed in all our towns and other places of our said country of Brabant/ whereas proclamations are used to be made the xu day of the next month of Novembre. And from that time forward every vi months without interruption till by us be otherwise ordained. And that the copies in good legible letters be fastened to the gates and other places of the said towns & churches of the said countries. ¶ And also that the copies of the instructions given by the generals to the exchanges of the said countries be in likewise tacked about the place where as they abide. Our ordinance made in the year. M. v. L. and twenty to endure in the feats of money: whereof is spoken afore with the surplus/ in all points and articles/ the which by this present act is not expressly derogate in the hole. And we give you in commandment and right expressly ordain and commit by these presents that our said present ordinance in all points and articles ye cause to publish the said xu day of Novembre next coming in all the places of your jurysdyccyons/ where as proclamations been used to be done. And the foresaid ordinance of the year. M.u. L. & twenty in all poyntis and articles to the which by these is not expressly derogate as is aforesaid ye preserve/ keep/ & observe/ and cause to be preserved/ keep/ & observed in the manner called inviolably And for the same proceed & cause to proceed against the transgressors of the said ordinances by execution of the penalties therein opposed really in deed without delay/ simulation/ or forbearing any opposition/ or appellation made or to be made notwithstgnding. This for to do/ and that thereon dependeth/ we give you and your substytutes committed full power/ authority/ and commandment special. And by these same we command expressly all our justyces/ officers and subjects that seeth this and to every of them in their degree/ and as to him appertaineth in this doing/ ye obey and intend diligently/ for it is our pleasure. ¶ Given in our town of Bruxelles under our country seal hereto put in placard: the vii day of the month of octobre.
