JAMES by the Grace of God, King of great Britain, France and Ireland, defender of the Faith, etc. To our Treasurer, Lords, auditors of our Exchequer, and to all our Customers and Searchers at any of our Ports, Havens or Creckes, within our Kingdom of Scotland being for the time, and to all and sundry our others lieges and subjects whom it effeirs to whose knowledge these presents shall come, or whom the 'samine doth concern greeting.  
Forsameikle as in one general convention of our three Estates of our said Kingdom halden in our burgh of Dondie upon the xiii day of May the year of God 1597. years, upon very good considerations, It was thought meet, statute and ordained, that all claith and others waires and merchandise to be brought within our said Kingdom from foreign Nations should in all time thereafter pay to us the custom following. That is to say, twelve pennies for every pounds worth thereof: And to that effect, we and our said's Estates gave full power and commission to a competent number of the Lords auditors of our Exchequer and others of our Nobility and Council, to set prices upon the said's waires and merchandizes, conform to the whilk our Customers to be appointed to that effect should collect and uplift our custom thereof. And as it is well known to all men of judgement and understanding that this special prerogative (amongst many others) hath by the laws of Nations been yielded and acknowledged to be proper and inherent in the persons of Princes, that they may according to their several occasions raise to themselves sic competent means by taking of custom of wares and merchandizes transported out of their Kingdoms or brought within the 'samine, as to their wisdoms and discretions shall seem expedient sufficiently to supply and sustain the great charges and expenses incident unto them in the menteinance of their Crowns and dignities (so the same be done without prejudice of trade and traffic) Even so it is most certain that we are a free Prince, of a Sovereign power, having als great liberties and privileges by the laws of our said Kingdom and privilege of our Crown and Diadame, as any other Prince or Potentate whatsomever. And therefore may alter, raise and diminish our customs as the prices of wares and merchandizes doth rise or fall. In consideration whereof, and because we are credibille informed that divers wares and merchandizes contained in the A B C of our customs of our said Kingdom, are therein valued and rated at lower prices than they should be, to our great loss and hindrance; and that diverse of the said's wares and merchandizes are valued and rated at over heigh and dear a rate, to the great prejudice and hurt of the Merchant; and that diverse wares and merchandizes both of those that are brought within our said Kingdom, and of those that are transported out of the 'samine are not at all valued nor mentioned in the said A B C, whereby the customs thereof hath hitherto been taken only by the eaths of the merchant's awners of the said's wares and merchandizes. FOR REFORMATION whereof, and to the intent that all sic wares and merchandizes as at any time after the first day of November next to come shall be brought into our said Kingdom or transported forth thereof, may reasonably and indifferently be valued and rated both for the true payment to us of our custom and for the ease of the merchants, we have lately given power and direction to one competent number of the Lords of our Council and auditors of our Exchequer, to try and examine what reasonable and indifferent values and prices may and aught to be set upon ilk sort of the said's wares and merchandise; and thereupon to make and set down one Book of Rates and valuation, to the effect our Customers may know what to take, and the Merchant know what to pay for the custom thereof. And that it may appear what care we have to avoid the least inconvenient or grievance that may arise to our people, we gave special direction to the said's Lords of our Council and Exchequer, that in setting down of the said Book of Rates and valuation, they should have a special regard to the setting of the 'samine orderly, and to forbear to value at one heigh rate sic commodities imported within our said Kingdom, as our poor people within the 'samine could not goodly want; or might give occasion to the Merchants to raise the prices thereof, sic as Victual, Pick, Tar, Hemp, Lint, Iron, Soap, Tackle, Cordage, and others of the like nature. Whilks Lords so appointed by us have set down this present Book of Rates and valuation accordingly, and reported the samin to us subscryved with their hands, the Original containing forty leaves written on both the sides. Whilk Book we have for the better authority thereof likewise signed with our awn hand, and have ordained our great Seal of our said Kingdom to be appended and hung thereunto, and ordeins this 'samine Book to remain amongst our Records and Registers of our said Kingdom. And therefore WE WILL AND DECLARES, and for us and our successors, decernes and ordeins that there shall be for ever after the said first day of November next to come after the date hereof, taken and received by our Customers to our use twelve pennies of every pounds worth of all wares and merchandizes contained in the said Book of Rates, that shall either be transported out of our said Kingdom, or imported within the 'samine, as for the custom due to us for the 'samine wares and merchandizes (wines, gold and silver only excepted) The impost of which wines is particularly set down by itself in one artickle at the end of this present Book of valuation and rates of merchandizes and goods imported within our said Kingdom; and the custom of the said gold and silver (in case the 'samine shall be transported out of our said Kingdom upon licence) is set down by itself in one artickle at the end of this present Book of Rates and valuation of wares and merchandizes exported out of our said Kingdom. And for this effect, WE do by these presents ordain and command all our Customers, Searchers, and others having entresse in receipt of our customs at every Port, Haven or Harberie within our said Kingdom, that after the said first day of November next to come, they and ilk one of them demand, uplift, and take of all our lieges or strangers that shall happen to transport out of our said Kingdom to foreign Nations or or import within the 'samine from foreign Nations any of the goods, merchandizes or wares contained in the said Book of Rates, twelve pennies for every pounds worth thereof, according as the 'samine is valued and rated in the same Book as for the Custom due to us, our heirs and successors for the 'samine: And that they demand, uplift and take of impost for every tun of wine that shall happen to be imported and brought within our said Kingdom after the said first day of November next to come, the sum of money set down in the said Book of Rates; and for every pounds worth of coined gold or silver carried out of our said Kingdom upon licence, the due custom likewise set down in the said Book of Rates. And in case it shall happen any merchandizes, goods or wares either to be transported out of our said Kingdom to foreign Nations, or brought within the same from foreign Nations, whilks are not contained and set down in this present Book of Rates. OUR WILL AND PLEASURE IS that the same shall be valued by the Merchant awner thereof or his factors, upon their eaths of fidelity, solemnedlie given in presence of our Customers, and that our custom shall be taken thereof accordingly. And we ordain all Merchants als well our born subjects of our said Kingdom as strangers, to observe, fulfil and obey this our ordinance concerning the payment of our customs, under the pain of incurring our heigh displeasure, and as they will answer to the contrary upon their peril. As likewise we ordain the Lords of our Privy Council and auditors of our Exchequer of our said Kingdom, to direct letters for answering and payment making to our Customers of the custom of merchandizes, goods and wares, and impost of wines set down in this present Book of Rates and valuation dew to us, after the said first day of November next to come in sic ample form, and under the like pains as they have been accustomed to direct letters for the like cause of before. providing alwise, like as OUR WILL AND PLEASURE IS that if at any time hereafter it shall plainly appear to our Thesaurer and Lords of our Council and auditors of our Exchequer of our said Kingdom being for the time, that the rate, value, kind, name, length or weght of any goods, wares and merchandizes contained in this present Book be mistaken or wrong valued contrair the truth and our true meaning in that behalf. In that case, we do by these presents give full power and commission to our said Thesaurer, Lords of our Council, and auditors of our Exchequer, or any eleven of them conjunctly (our said Thesaurer being alwise one) to reform the same Book according to our true meaning in every point. And we ordain the Clerk of our Register and Rolls of our said Kingdom to deliver to every Customer or collector of our customs at every Port, Haven or Harberie within our said Kingdom, a just extract of this present Book of Rates and valuation under his sign and subscription manuel, for their better warrant, to ask, crave, receive, intromet-with, and collect our said's customs. And these our letters patents, or the just extract thereof subscrived by our said Clerk of our Register and Rolls, shall be as well unto you our said Thesaurer, Lords of our Privy Council, and auditors of our Exchequer, as to all other our Customers, officers, and others whom it shall or may appertain, and to every one of you a sufficient warrant and discharge for doing and performing all and sundry the premises according to to our true intent and meaning, any law, statute, order or use heretofore made to the contrary not withstanding. Given under our Sign Manuel at our Manor of Greenwich the xxix day of Apryle, and of our Reigns the forty five and eight years. 1611.

129 Act of his majesties twelfth Parliament the 5. of june. 1592. Anent the Custom of English gudes, and searching of gudes customable.  
ITEM, OUR SOVEREIGN LORD And Estates of this present Parliament, ratifies, approves and confirms the act of secreit Council, made upon the penult day of Februar, one thousand, five hundredth, fourscore nine years. Anent the bringing of all packs of English claith hail, un-broken-up to the Customhouse, and selling thereof, in manner contained there-intill, in all points, articles and clauses, respectiuè specified in the same, with this addition: That na manner of persons take upon hand, to house, hide or conceal any manner of English gudes, either coming by sea or land, in any burgh or suburb of this Realm, under the pain of confiscation of all the gudes swa hid and concealed, in defraud of the due Custom, where ever the same can be apprehended. And in case the 'samine be not apprehended, the awners to make the availl thereof forthcoming to his Majesty as escheat, after tryell ta'en there-intill as effeirs. And also for the better execution, to ordain ilk Customer, to search within the bounds of his office, all manner of houses and buithes, alswell to burgh as to land; and to escheat, confiske and intromet-with all manner of uncustomed English gudes, and all English claiths unsealed; and if need beiss, to make open durres, and other lockfast lumes, and to use his Majesty's keys to that effect. And in case any persons resist be force, to make open and patent durres to the said Customer, for the effect foresaid: The persons resisters to be under the like danger, as the committers of the deforcements, and to be punished in their persons and gudes, conform to the act made there-anent. Ordaining also, the Provest, Bailies and Magistrates of ilk burgh, if need beiss, to concur and assist with the said's Customers, in execution hereof, swa oft as they fall be required thereto.   

89 Act of his majesties ellevinth Parliament the xxix of julie 1587. False Customers and searchers sold be punished.  
ITEM, It is statute and ordained, that all Customers and Searchers committing fraud in their office, be oversight of the transporting of forbidden gudes forth of the Country, for gratitude given to them, shall be called therefore at Justice Airs, and particular diets, and punished in their persons at OUR SOVEREIGN LORDS will, and all their movable gudes to be escheated to his Highness' use, in-case of their conviction.   

251 Act of his majesties 15 Parliament nineteen of December 1597. All Merchandise brought within this Realm sold pay Custom.  
OUR SOVEREIGN LORD, And Estates of this present Parliament, ratifies, approves and confirms the act made at Dondie, the thirteenth day of Maij, the year of God, one thousand, five hundredth, ninety seven years, anent OUR SOVEREIGN LORDS Customs, of the whilk the tenor follows. FOR-SA-MEIKLE As it is understand to the King's Majesty, his Nobility, Council and Estates, presently convened, that the subjects of all Foreign Nations, whilks brings and transports any kind of claith, or others waires or merchandise, from any Foreign Country, to their own native Country, hes been in use, and yet still continues in the payment of certain custom, or other exaction therefore, chiefly at the time of their arrival, and incomming within the famine: And almaist few or nane of the subjects of any Realm exeemed therefra (the subjects of this Country only excepted) wha be reason of one alleged bypassed immunity, claims the privilege of exemption: Albeit it can not be denied bot his Majesty is a free Prince, of a Sovereign power, having als great liberties and prerogatives be the laws of this Realm, and privilege of his Crown and Diadame, ay any other King, Prince or Potentat whatsomever: And therefore aught to have the like custom and exaction, for entertaining of his Princely Estate of all claith and others wares and merchandise to be brought within this Realm, by his Highness' subjects, at all times hereafter. For the whilk purpose his Majesty with advice of his said Nobility, Council and Estates, hes thought meet, concluded and ordained, that all claith and others merchandises whatsomeever to be brought within this Realm from all foreign Nations, shall pay the custom following, at the time of their arrival and entry therein, in all time coming: That is to say, Twelve pennies of every pounds worth of all sorts of the said's wares or merchandise. And to this effect, his Highness, and his saids Nobility, Council and Estates, gives full power and commission to the Lords, Auditors of his Exchequer, and others of his Nobility and Council, to the number always of eleven persons, at the least, to set down the A. B. C. of the custom of all claith, and others wares and merchandise whilks shall be brought and enter within this Realm yearly hereafter: With power lykwaies to them to set price upon the saids wares: conform to the whilk the Customers to be appointed by his Majesty to that effect, shall uplift custom thereof: And to make all other ordinances  for the ease of the Merchants, and surety his Highness' custom, in the execution of the premises. And also of sic others gudes to be transported forth of this Realm, as are not as yet expressed in the A.B.C. already made. providing this act be not extended to Earls, Lords, Barons and Free-halders; but it shall be lesome to them, to send their gudes beyond sea, for their own particular use. AND ALS it shall be lesome to them to bring within this Realm, wines, Claiths, and other furnish, for their own particular use; and na ways to make merchandise thereof, conform to the laws and liberties granted to them of before. The whilk act above written, OUR SOVEREIGN LORD, and Estates foresaids, decernes and declares, to stand as one law in all time coming.   

255 Act of his M. 15 Parliament the nineteen of December 1597. All Cocquets sold be special, and contain the particular kinds of Merchandise.  
ITEM, It is statute and ordained, for eschewing of the damage and skaith whilk daily aryses throw general and informal Cocquets, given and granted within this Realm. That in all times coming all Clerks of the Cocquet, shall patticularlie expreeme and specify in the Cocquets given by them, the particular quantities of the gudes and merchandises, the special kinds and sorts thereof, the names of the Merchants and awners of the 'samine, how meikle of the same gudes pertaineth to ilk Merchant: And that the Conservatour in the Law-cuntries' admit nor allow any Cocquet, except it be written and form in manner foresaid, bot shall confiscate all the said's gudes, not expremed particularly, as said is: And make count and reckoning thereof yearly to the Thesaurer, as he will answer upon his office.   

257 Act of his M. 15 Parliament the nineteen of December 1597. The each of the Merchants, Skippers and factors passand to and fra the Law-cuntries, and forth of this Realm.  
ITEM, The Conservatour shall not receive nor admit any Cocquet, albeit the same be lawfully given, except the Merchants, Skippers, factors, and every one of them before the lossing of any of their gudes, make faith, and swear solemnedly be GOD himself his Creator, that he hes na forbidden gudes or gear, nor na other unlawful merchandizes, by and attour that whilk is contained in the Cocquet, nor knows of nane to be in the 'samine ship pertaining to others: And that sa far as he understands, the hail gudes and gear perteins properly to free men, and na part thereof to unfree-men. As also at their back returning from the Law-cuntries' towards Scotland, they shall likewise give their solemn eathes, before the laidning of the ship, or inputting of any gudes, that the gudes properly pertains to themselves, and not to strangers. And if they loss any gudes and gear coming from Scotland, before the giving of the said each, or puts any gudes in ship-burde, to be transported towards Scotland, all the same gudes to be confiscate. And if the said each be refused be them all, and they na ways will make the same. It shall be lesome to the Conservatour to arreist the said Ship, and all the gudes contained therein. And if some makes each, and others refuses, he shall arreist all the gudes pertaining to the party refusand, and make count thereof, as said is. And whatsomeever gudes are not contained in the Cocquet, to be confiscate, as said is.  
ITEM, It is statute and ordained, that all Merchants and Skippers, at the receiving of their cocquets in all parts and ports within this Realm, shall give their solemn eathes, and make faith in form and manner above expremed; and that they have na forbidden guds nor na other lawful guds or merchandise, except that whilk is contained in their Cocquet and enters; and that they shall take na other gudes in, all that voyage, under the pains foresaids. Whilk each shall be made to the Customers, whereanent they shall be answerable yearly in the Exchequer.   

260 Act of his majesties 15 Parliament the nineteen of December 1597. All Marchands should give one inventare of their merchandise and gudes to the Conservatour.  
ITEM, every particular Merchant coming forth of the Law-cuntries to this Realm, shall give up to the Conservatour the special quantity of his gudes, and the quality thereof, before the inbarking of the 'samine gudes, under the pain of confiscation thereof: And the Conservatour to visie and try the same at his pleasure, to the effect that he may send hame one Cockquet of the same, particularly to his Majesty's Thesaurer, subscryved be himself or his depute, for eschewing of the fraud whilk may be used towards his Majesty in his customs.    

Acts of secret Council. APUD EDINBURGH vigesimo quinto die Mensis Octobris 1611.  
FOR-SA-MEIKLE As the Lords of secreit Council understanding that his Majesty hes been greatly hurt and prejudged in time bygain in the due payment of his Highness' customs, be reason of some Marchands, awners of gudes and gear transported out of this Realm, and inbroght within the 'samine for their awn advantage and commodity, hes been accustomed to pack and close within packs and trees of grofwares and merchandise, paying small custom to his Highness; gear and merchandise of better value, and paying greater customs, and at the giving up of the said gear in entry to his Highness' Customers, hes given up the same and paid custom therefore, as for the grofwares contained in the said pack only. FOR remeed whereof, the said's Lords hes statut and ordained, that na Marchands take upon hand at any time hereafter to pack or enclose within packs of skins or other packs transported forth of this Realm, or within packs of lint or Hemp, trees of Carts, Cards or Keames, or other packs or trees brought within this Country, any other gear or merchandise of contrary nature, and conceal the 'samine ungiven up in entry to his Majesty's Customers, in defraud of his Highness due customs, under the pain of escheating of the hail pack swa found, wherein the same gear shall be swa found to be fraudfully packed. AND TO THE EFFECT, that that nane pretend ignorance hereof, the said's Lords ordeins this present act to be imprinted, and letters to be direct for publication hereof at the market crosses of the head burrows of this Realm, and other places needful.

THE Lords of secreit Council, understanding the great hurt that his Majesty hes sustained in time began, be certain Skippers, Masters and awners of ships, who in favours of the Merchant, and in defraud of his Majesty of the due payment of his customs, laidens and losses their ships at unfree Ports, and at Ports and harbories where his Highness hena Customers. As likewise, at their departing out of this Realm, after that they have made and given up to his Highness' Customers the entry of all gudes being within their ships and veshels, and received their Cocquet thereupon, they use to receive within their said's ships other merchandise and gudes and transporteth the same out of this Country uncustomed, and at their returning hame again, losses one part of their laidning before they give up their entries to his Highness' said's Customers. FOR remeed whereof, the said's Lords hes statute and ordained, that na Masters, Merchants, Awners nor Skippers of Ships, Crears or others veshels within this Realm, take upon hand at any time hereafter, to laiden or loss their ships in hail or in part at any unfree Port within this Kingdom, or in any open Raids within the same, under the pain of escheating of the hail merchandise and gudes swa shipped or lossed, and of the Ships, Crears and veshels wherein the 'samine shall be shipped, and out of the whilk the 'samine shall be lossed. As likewise, It is statute and ordained, that na Clerk of Cocquet give or delyver any cocquet in time coming to any person, Marchand, skipper or others what-som-ever, until sic time as the said Clerk receive an entry subscryved be the customer at the port where the gudes are shipped, whilk entry shall contain every particular marchands name with the quantity and quality of the gudes pertaining to him, and the Customers certificate that he hes received the King's Majesty's custom of the same gudes, under the pain of deprivation of the said Clerk of Cocquet from his office, and punishing him in his body, gudes and gear at the will and pleasure of the said's Lords. As also, that na Customer receive an entry of the gudes and merchandise being in any ship to be transported out of this Kingdom, unless the presenter thereof deliver the 'samine subscryved with his hand, and therewithal solemnedlie make faith and swear in presence of the said Customer, Be GOD himself his Creator, his part of Paradise, and as he shall answer upon the salvation and condemnation of his saul, that he hes na forbidden gudes nor gear, nor na other lawful merchandise nor gudes within his said Ship by and attour that whilk is contained in the said entry subscryved with his hand, nor that he knows of nane to be brought within the said Ship to be carried away in her at that voyage, nor shall not receive thereafter any gudes or gear to be laidned within his said Ship, and carried away in her at that tyme. Whilk each give it be refused to be made, as said is, It shall be lesome to the said Customer to arreist the said Ship, and all the gudes and gear being therein. As lykwayes, It is statute and ordained, That na Masters, Awners nor Skippers of Ships, passing out of this Realm take upon hand at any time hereafter, to receive within their said's Ships and veshels any merchandise gudes or geat to be transported out of the same after that they have made and given up their enters to his Highness' Customers, under the pain of escheating of the merchandise, gudes and gear sa shipped, and of the Ships, Crears, and veshels wherein the famine shall be shipped. As also, that na Masters, Awners nor Skippers of Ships arryving within this Realm, take upon hand at any time hereafter, to loss any of the wines, merchandise, gudes and gear, being within the same ships, under what-som-ever colour or pretence, at any Port or part within this Realm, or convoy any of the same away, in defraud of his Majesty's Customers, until sic time as the entry of their ships be made, and the same with the Cocquets received be them at the Port where they received their laidning be first delivered to his Highness' Customers, and that they leave no part of the said's wines, merchandise, gudes and gear ungiven up in the said entry, nor conceal no part thereof from the said's Customers, under the pain of escheating of the hail wines, merchandise, gudes and gear swa to be lossed out of the said's Ships, and of the ships, Crears and veshels out of the whilk the famine shall be lossed. As also, under the pain of escheating of the hail merchandise, gudes and gear left out ungiven up in the said entry. Whilk entry shall be given up be the Skipper or Master subscryved with his hand, wha shall be obleist solemnedlie to make faith, and swear be GOD himself his Creator, his part of Paradise, and as he shall answer to GOD upon the salvation and condemnation of his saul, that the same is a just and true entry of the hail merchandise and gudes shipped within his ship at that voyage, and that he hes lossed na part thereof, nor convoyed nane of the same away, before the giving up of the said entry. Whilk each, if it be refused to be made, as said is, It shall be lesome to the said's Customers to arreist the said ship and hail gudes and merchandise being therein. And to the effect that nane of his Majesty's liege's pretend ignorance hereof, the said's Lords ordains this act and ordinance to be imprinted, and publication hereof to be made at the market crosses of the head burrows of this Realm, and other places needful.

FOR-SA-MEIKLE, As for reformation of some abuses practised by the merchants carrying gudes from Scotland to England, and from thence to Scotland, to the hurt and prejudice of his Majesty's customs: It hath pleased his Highness to set down these orders after-following to be observed in time coming, alswell by the Marchands trafficking betwixt the said's two Kingdoms, as by the farmers and Tacks-men of his Highness' Customs of both the Realms, Viz.

That the Farmers anc Tacks-men of the customs of Scotland do keep books of all the gudes that are entered and shipped for England, and also of all guds brought from England to Scotland, the ships name, place and masters name, and to and from what Port the ship is bound, and to keep the entresse of every Port severally.

Also, that they keep books of all gudes carried by land from Scotland to England, and from thence to Scotland, and to make certificate under the hand and seal of the Farmers and Tacks-men or their deputes; expressing the Marchands name, the quantity and quality of the gudes, to what place the same is carried, and the day of the month and year, when and where the same was customed. The same form and order to be observed by the Farmers of the custom of England, and reciprocally the Farmers and Tacks-men of both the Realms, to send every half year the copies of these books, the one to the other, Viz. at Christmas and Midsummer.

That all Cocquets or certificates be made in the names of the principal awners of the gudes laiden in every Ship, and not in poor men's names, skairslie knawne in Scotland or England.

That na Marchand or Tradis-man take upon hand at any time hereafter, to carry by land any gudes from Scotland into England, or from England into Scotland by the waste grounds or wastes, bot that the same pass by the ways of Aiton, jedburgh, Kelso, Drumfrice and Annand for Scotland; and by the ways of Berwick and Carlisle for England, under the pain of confiscation of the gudes otherways carried, or the value thereof to his Majesty's use after true tryell and examination taken therein.

That the Farmers of the customs of both the Realms, and their deputes, upon the arryvall of any Ship from Scotland, and likewise from England, shall make due examination of the gudes laiden with the Cocquets or certificates for the same. And if they shall find a greater quantity, or other guds than are specified in the saids warrants, that they apprehend and stay the said's gudes, and take them into their possession, until the Marchands awners thereof, or their factors in their names have given sufficient caution to his Majesty, for answering and paying of the value of the said's gudes, into his Majesty's Exchequer of either Realms, according as the same shall be prised by twa honest men to be nominated, one by the Marchand, the other by the Farmers and Tacksmen or their deputes, give it shall appear upon examination, that the said's gudes sa stayed are uncustomed. The same order likewise to be observed by their farmers and Tacks-men, and their deputes for the land carriage.

And that the Farmers and Tacks-men of the Scots customs do every half year send to the farmers of the English customs, all these bands for sic surplusage of gudes give they be not discharged be certificate. The like to be done by the farmers and Tacks-men of the English customs.

For the better observing of whilk orders and that nane pretend ignorance of the same, the Lords of his Highness privy Council ordeins this present act and ordinance to be imprinted, and letters to be direct for publication of the same at the market crosses of the head burrows and Seaports of this Realm, and other places needful. Commanding and charging, all and sundry his Highness lieges and subjects whom the 'samine doth concern, that they and every one of them inviolably fulfil, observe and keep every article abovewritten. As they will answer to the contrary, upon their highest charge and peril.

FOR-SA-MEIKLE As it is understand to the Lords of secreit Council, that be diverse acts of Parliament, laws and constitutions heretofore made and observed within this Realm, all manner of English gudes brought within the same hes been ever in use of payment to his Majesty of a certain custom and duty properly appertaining to his Highness as a part of the patrimony of his Crown. As also, be act of secret Council, of the date the penult day of Februar 1589 years. Ratified and approven in the Parliament halden at Edinburgh, in the month of June, one thousand, five hundredth, fourscore twelve years, It is statute and ordained, that all English cloth brought within this Realm, sold be brought to his Highness Custom-house: and there sealed with one seal appointed then to be made to that effect. Whilk act took full execution until sic time as his Majesty coming to his Crown of England, did for a time forbidden the taking of any custom for merchandise and gudes transported from the one Kingdom to the other, being the native commodities of the Land. And now since, It hath pleased his Majesty to take these customs in his own hand again, and to give order and direction that the 'samine shall be collected and uplifted in time coming to his Highness' use. The Lords of secret Council hes found necessare, meet and expedient, and decernes and ordains, that the foresaid act shall be revived again, and stand in full force and effect in all time coming. And therefore ordains the Tacks-men of his Majesty's customs, to cause make and print one seal and stamp of steel, containing two halves, for every Burgh and Sea Port within this Realm, whereas Customers are or shall be established, the one half containing JACOBUS REX, with the King's Majesty's Arms and Crown; and the other half the name of the Burgh where the 'samine shall remain. Whilk seal and stamp shall be stricken and applied to lead, and the 'samine lead being swa strucken and printed with the same stamp shall be hung to every piece or wob of claith, Cairsayes, freeze, Cottons, Baise or Fustians, that hereafter shall be brought within this Realm forth of England be sea or land, before the same be presented to open market, sauld or any ways disponed upon: And the one half of the said seal to be keeped be the Customer, and the other half be the Clerk of Cocquet. The awners of the said claith, and others abovewritten, payand the custom thereof, with sic one duty for the seal as was accustomed to be paid of old to the Customer and Clerk of Cocquet equally betwixt them. And to the end, that all English claith and others abovewritten, presently remaining within this Realm, may be discerned and knawn from that whilk hereafter shall be brought within the same, It is also discerned and ordained, that the Customer of every Burgh and Seaport within this Realm, shall repair to the dwelling-houses and buithes of every one of the said's Burrowes and Seaports whereof they are particularly appointed Customers, and there receive the eathes of the awners of sic pieces and wobs of English claith, and others above specified, as are therein, whither if the custom thereof be paid or not, and where the custom thereof is not paid, that they instantly pay the same: And that the said seal in taken thereof be hung thereto, and to all the other wobs and pieces of English claith, and others above-specified, whilks shall be apprehended within the said's buithes and houses, whereof custom hes been paid of before for payment of the said accustomed duty for the said seal allanerlie; and that the awners of the same claith and others above specified, require the Customers of every Burgh and Seaport particularly, to repair to their said's buithes and houses to this effect, betwixt and the _____ day of November next-to-come; and farther to do and perform all other things whilk to every one of them is appointed to be done in manner foresaid, under the pain of confiscation of all the wobes and pieces of English claith, and others above-specified, that shall be apprehended thereafter wanting the said seal. As also, to the effect his Highness Customs of all merchandise and gudes carried from Scotland to England, and from thence to Scotland may be the mair truely paid, It is discerned, statute and ordained, that na Marchands, their factors nor servants, Masters, Awners nor Skippers of Ships, Barks or others veshels going from Scotland to England, take upon hand at any time after the date hereof, to laiden any merchandise or guds within the same Ships, Barks or other veshels, until sic time as the same gudes and merchandise be first brought to his Highness Custom-house, and the custom thereof paid, and certificate given be the Customer thereupon. And that na marchand's, their factors nor servants carry any merchandise or gudes by land to England, until the same be first brought to his Highness Custom-house, and the custom thereof paid, and certificate given be the Customer thereupon, under the pain of confiscation of the hail merchandise and gudes swa shipped and laidned, with the Ships, Barks and other veshels, wherein the same shall happen to be shipped, and of the merchandise and gudes sa carried by land to his Highness' use. And in case the same gudes and merchandise can not be apprehended, the awners thereof to make the just availl thereof forthcoming to his Highness use as escheat, due tryell being taken thereintill as effeirs. As lykwaies, that na Masters, Awners nor Skippers of Ships, Barks or other veshels, coming from England to Scotland, take upon hand at any time after the date hereof, to loss any of the merchandise and gudes being therein, till sic time as they first enter their Ship in his Majesty's Custom-house, give up one true inventar of the hail gudes and merchandise being therein to his Highness' Customers, and therewithal delyver unto them the Cocquet received be them at the Port where the said Ship was laidned, and make faith that the said entry sa given up be them, is true, and that they have not put on land at na Port, Harborie or other part what som-ever, any of the merchandise and gudes laidned within their said Ship, but that the 'samine are all within her at the giving up of the said entry, under the pain of confiscation of the same Ships, Barks and other veshels, or the just availl thereof to his Highness' use. As also, the said's Lords, decernes and ordains all and sundry his Highness subjects and strangers, that at any time after the date hereof shall happen to bring within this Realm, any merchandise or gudes be sea or land from England, that they bring the same directly to his Highness Custom-house, and that they nor nane of them take upon hand, to house, hide, conceal, dispone or make sail of any part thereof, until sic time as his Highness' customs thereof be first paid, and the Claith, Cairsays, freeze, Cottons, Baises and Fustians (in case any be) sealed conform to the order of old and here established, under the pain of confiscation of the same merchandise and gudes sa concealed and uncustomed, to his Highness' use, where ever the same may be apprehended. And in case the 'samine can not be apprehended, the awners thereof to make the avail thereof forth-command to his Highness use as escheat, due tryell being taken there-intill as effeirs. And because the Marchands, awners of the saids merchandise and gudes carried from Scotland to England, and from thence to Scotland, and the Masters, Awners and Skippers of the said's Ships and other veshels, uses sic craft and policy in the quiet convoying away and concealing of the saids merchandise and gudes, as sometimes it is very hard and difficile to get the same apprehended, or sufficient probation led there-into be witnesses: The said's Lords of secreit Council hes therefore found, discerned and declared, that the certificate of any of the Fermorers of his Highness' customs in England, or of his Highness' Customers or controllers of his Highness' customs at any port or place be sea or land within that Kingdom where customs are received and paid autentiklie, subscryved be any of their hands, bearing the day, month and year of the bringing of any of the saids merchandise and gudes from the one Realm to the other; the Marchands name, Awner thereof, the quantity and quality of the 'samine, the Ships name, Master and Skipper thereof, wherein the 'samine is transported, shall be als sufficient probation against the Marchands, and awners of the saids merchandise and gudes, and against the Masters, Awners and Skippers of the said's Ships, Barks and other veshels, as give probation had been led there in till be witnesses. Whilk probation shall be led before the Lords of his Highness privy Council or Auditors of his Highness' Exchequer. And for the better putting of this act and ordinance to execution, the said's Lords ordains and commands the Fermorers of his Highness' customs and their deputs, and all others his Highness Customers and searchers, to pass, search, seek and apprehend all and sundry English cloth, Cairsayes, freeze, Cottons, Baise and Fustians whilk shall be unsealed, in manner abovewritten, in taken that the 'samine are customed, where ever the same can be apprehended, in open markets, fairs, houses, buithes, or other places what-som-ever within this Kingdom at any time after the said _____ day of November next-to-come, and to confiscate the same to his Highness use as uncustomed gudes. And to the effect that nane of his Majesty's liege's or strangers pretend ignorance hereof, the Lords of secreit Council ordains this present act and ordinance to be imprinted, and letters to be direct for publication hereof at the market crosses of the head Burrowes and Seaports of this Realm, and other places needful in form as offeirs.
