Socage in ancient tenure/ and Socage in base tenure/ Socage in free tenure is to hold freely by certain rent for all manner of service as is before said/ and of that the next kinꝭ body shall have the ward to whom the heritage may not destend/ till the age of. xiiii. years that is to say/ if the heritage come by the part of the father/ they of the part of the mother shall have the ward and contrary wise. ¶ And note well that if the garden in socage do wast he shall not be pechid of waist but he shall yield account to the heir when he shall come to his full age of. xxi. years/ and look the statute of marlebryge. capitilo. xv. for this matter/ Socage in ancient tenure is that where that people in ancient demesne hold which use no nother writ to have than the monstraver for to discharge them when yeyr lord distrayneth them for to do other service that they aught not to do/ & this wryt aught to be brought against the lord/ and those tenenties hold all be on certain service/ & they be free tenantis of auntion demesne/ Socage in base tenur is where a man holdeth in auntion demesne that may not have the monsttaruerunt/ and for that it is called the base tenure. ¶ To hold in fee ferme is to hold in fee simple yielding to the lord the valwe or at thee/ lest the forth part by year/ and he aught to do no nother thing but as it is contained in the feoffment/ and he that holdeth in fee ferme ought to do fealty & not relief. ¶ To hold in frank fee is to hold in fee simple lands pledable at the common law. ¶ To hold in fee base is to hold at the will of the lord. ¶ To hold in pure villennage is to do all that the lord will him command/ The definition of villeinage is villain of blood & of tenure/ and it is he of whom the lord taketh redemption to mary his daughter/ or to make him free/ and it is he whom the lord may put out of his lands and tenements at his will/ and also of all his goods and cattles. ¶ And note well that a sokman is no pure villain nor a villain owe not ward marriage nor relief nor to do no nother service real. ¶ And note well that the tenure in villeinage shall make no free man villain if it be not continued sith time out of mind nor villain land shall make no free man villain/ nor free land shall make no villain free but if that the tenant have continued free sith the time of no mind/ But a villain shall make free land villain by seisin or claim of the lord ¶ And note well that if a villain purchase certain land & take a wife and aleyu and dieth before the claim or seisin of the lord the wife shall be endowed. ¶ And note well that in case that the lord bring a praecipe quam reddat against the alien the which vonchith to warrant the issue or of the villain which is villain to the lord/ he shall have the voncher/ and by protestasyon the lord may save that notwithstanding that he plead with his villain/ yet his villain shall not be in fraunchisid. ¶ And note well that a bastard shall never be judged villain/ but by knowledge in cowert of record. ¶ And note well that if debt be dew by a lord to a freeman and he maketh ii men his executors the which be villeyns to the said lord & dieth the villeynies shall have an action of debt against their lord. And not withstanding that he do waste he shall never be impeached of that waist. ¶ And note well if he aleyne/ he in the rextion shall not have a wryt of entry in consinli casu. But he may enter & his enter is lawful ꝑ Robertum Thorp chief Justice. ¶ To hold in frank marriage is to hold in the second tail limit in the statute of westm second. Capitilo primo. And the feoffor shall acquyt the feoff of all manner of service unto the fift degree be past. & the feffour shall do all the service & suits during the said term/ & aft that heyris of the feoff shall do it/ for that that the puite of blood is past & if he be distrained for service he shall have a wryt of mesne agaynꝭ him supposing that he held the lands of him/ but he shall not have the foriugment if it be not in advantage of his issues And note well that after the four degree be past he shallbe attendant of as much service to the donor as the donor is attendant to the lord ꝑamount & if he do selony for which he is attain/ the king shall have his landꝭ for term of his life natural/ & after his death his issue shall inherytcas by force of that tail & i vis case none shall have his lands by way of escheyte no more than in any other tail/ And in case that the tenant die without heir of his body begotton the land shall revert to the donor as it should in the common tail/ And if a man let his land to another in frank marriage yielding to him a certain rent by year he shall hold this land in the tomyn tail and not in frank marriage for by the rent reserved these words in liberum maritagium be all utterly void so that the tenor shallbe intended after the tenuer in the common tail. ¶ And note well that the gift in frank marriage hath a condition anerid to it notwithstanding that it be not openly declared in the deed of the gift as it appeareth by the statute of westm second capitilo primo de donis condicionalibus ¶ And note well that a man shall not gift lands nor tenements in frank marriage but where the woman is privy of blood to the donor/ for else the man nor the woman shall have no nother estate by the feoffment but forterme of life ¶ To hold in frank almoyne is to hold lands or tenements for to serve god & holy church to endow without doing any other manner of service/ And note well that in this case le donor is measne & aught to acquit him freely against the chief lord/ & also they that hold i frank almoyn shall do no fealty/ but they that hold i frank marriage shall do fealty. To hold by elegit is where a man hath recoved debt or danage by wryt against another or by knowledge ori other manner/ he shall ha●e wethin the yeren against him Turrian wryt Judicial called elegit to have execution of the halff of all his lands and chatellies excepties oxyn and beasts of his plough till the debt or the damagys' be utterly leaved or paid to him & durig this term he is tenant by elegit. ¶ And note well if he be put out within the term he shall have assize of novel disseisin and after a redisseysyn if need be/ & this is given by the statute of westm̄. ij. capitelo. xvii/ and also by the equity of the same statute/ he that hath his estate if he be put out shall have assize and a redysseysyn if need be/ and also if he make his executors and die & his executors enter & after more waste than the foresaid some of money which was to be leanly amounteth the other shallbe discharged by & by of all the said money & shall recover the land/ and for the superfluity of the waist made above the that amounteth to the said some he shall recover his damagis single/ & ye same law is of his executors & also of him the hath his estate/ And note well that in an elegit/ if the sheriff return that he had naught the day of the reconnaissance made/ but that he purchased lands after the time/ then the part pleyntyf shall have a new wryt to have execution thereof/ the same law is of a stature merchant And note well vat for after a fierifacias a man may have the elegit but not contrary wise/ for so much that the elegit is of more higher nature than the fieri facias/ And note well/ that if a man recover by a wryt of debt & sueth a fieri facias & the sheriff return that the part hath no thing whereof he may make gree with the part then the plaintiff shall have a capias sicut alias/ & a plur es & if the sheriff return at the capias mitto vobis corpus & he have nothing whereof he may make gree to the part/ he shallbe sand to the prison of the fleet & there shall abide tylhe power to make execution of the same statute and if the oblige pay not the debt at the day/ and no thing of his goodys' lands or tenements may be found within the ward of the mayre or garden be foresaid but in other places without/ than the reconyse shall see we the reconysaunce & obligation with a certification to the chancery under the kings seal/ & he shall have owl of the chancery a capias to the sheriff of the count where he is to take him and to put him in prison if he be not a clerk/ till he have made grement of the debt/ And one quarter of the year after that that he shallbe take/ he shall have his land delivered to himself to make gree to the part of the debt/ and he may cell it while he is in prison & his sale shallbe good & lawful/ And if he do not 'gree within a quarter of a year or if it be returned that he be not found then the reconise may have a wryt of the chancery which is called extendifacias direct to all shyryfis where he hath lands to extend his lands & goods to him & to seize him in his lands to hold them to him and to his heirs and his assigns till that the debt be levied or paid and by this time he is tenant by statute merchant. ¶ And note well that in a statute merchant the reconise shall have execution of all the lands which the reconisour had the day of the reconisaunce made & any time after/ by force of the same statute. ¶ And note well that when any waste ordystruction is made by the reconise or by him that hath his estate/ the reconisour or his executors shall have the same law as is before said of the tenant by elegitg/ and that is by the statute merchant iate made at westm ¶ And note well if the tenant by statute merchant hold over his term he that hath right may sew against him a venire far. ad cōputand. or else enter by and by. ¶ There be three manner of rents that is to say rend service rend charge and rent sek rend service is where a man holdeth of another by fealty and for to do suit to his court and yielding to him a certain rent by the year for all manner of services. ¶ And note well that if the lord be seized of the service & rent beforesaid and they be behind and he distran and the tenant rescue the distress he may have assize or a wryt of rescous/ but it is more necessary for him to have assize than a wryt of rescous/ for so much that by assize he shall recover his rent and his damagiss/ but by a wryt of rescous he shall not recover but the thing and the damagis. ¶ And note well that if the lord be not seisid of the rent and service and they be behind and he dystrayn for them and the tenant take again the distress/ he shall not have assize but a wryt of rescous. ¶ And note well that if the lord distrayn his tenant in socage for knights service which is not with said of him and a vow for the same service in court of record he shallbe charged by the same service/ per ¶ ffynch termino hillare anno. xlvi. ¶ And note well that if the lord may not find a distress by. two. year/ he shall have against the tenant a wryt of cessavit per biennium/ as it appeareth by the statute of westm̄. two. capitilo. xxi. And if the tenant die the same time and his issue enter/ the lord shall have against the issue a wryt sur cessaunt/ or if the tenant alayn/ the lord shall have against the alieve the foresaid wryt But if the lord have issue and die and the tenant be in arrearage of the said rend and service in the time of the father of the issue and not in that time of the issue/ he may not distrain for the arrearages in the time of his father/ & he shall have no nother recover against the tenant or any other for that that such advantage is given by the law to the tenant. ¶ And note well that rend service is/ to the which belongeth fealty/ but to rend charge and rend sek longeth not fealty but it belongeth to rend service of common right. ¶ Rend charge is where a man grauntyth certain rent going out of his lands or tenements to another in fee simple or in fee tail or for term of life by deed upon condycionn that at what day that the rent be behind it shallbe well lawful to the grant or his heirs or assynies to distrain in the same lands or tenements. ¶ And note well that if the rent be behind it is well lawful to the grant by election to have a wryt of annuite/ or else he may distrain/ & if the distress be take against his will fro him & he was never seized before he hath no recover but by writ of rescous/ for the distress furst take gyffyth not to him seisi but if he hap the rend before for if he were seized of the rend before & after the rent be behind & he distrain & rescous to him be mad he shall have assize or a writ of rescous ¶ And note well that in every assize of rend charge and annual rent or in a writ of amnuite it behoveth to him that bringeth the wryt to show forth an especialte/ or else he shall not maytayne assize/ but in a mordauncest our or formedoun in the descender or other wryttis in the which title is given or comprisid of rend charge or anuell rend it needeth not to show especialte. ¶ And note well that if a man grant a rend charge to another/ and the grant purchase the halff of the land whereof the rent is going out/ all the rent is extinct and if the grant release to the grantor parcel of the rent/ yet all the rent is not extinct/ But in rend service not withstanding that the lord hath purchased the halff of the land whereof the rent is going out/ yet the rent is not extynct but for the halff/ and the cause is of the diversity for that that rend service may be severed to one parson but not rend charge. ¶ And note well that if rend charge be granted to two jointenaunties and the one release/ yet the other shall have the halff of the rent/ and also if one purchase the halff of the land whereof the rent is going out the other shall have the halff of the rent of his companion/ And if the dissersour charge the land to a stranger and the disseyse bring assize and recover the charge is defeated/ But if he that hath right charge the land and a stranger fain a false action against him and recover by default/ the charge abideth. ¶ And note well that in case that purparte be between two perceners and more land be allowed to one than to the other and she that hath more of the land chargeth her land to the other and she happyth the rend she shall maintain assize without especialte/ and if the grant have it in fee simple or in fee tail and hath issue and dieth/ if the issue bring a formedone or assysc of mordauncestour he shall never be charged to show an especialte. ¶ Rend sek is where a man holdeth of me by homage fealty & other service yielding to me a certain rent by the year and I grant this rent to another reserving to me the service. ¶ And not well that in rend sek if a man be seisid of the rent/ and the rent be behind he may not distrain but he shall have assize of novel disseisin. ¶ And note well that if rend sek be granted to a man and to his heirs and the rent be behind & the grantor die the heir may not distrain nor shall not recover the arrearages of the time of his father as it is before said of rend service. ¶ And in the same manner it is to say of rend charge or anuell rend/ But in all these rentis before said the heir may have for the arrearages in his own time such advantage as his father had in his life. ¶ And note well that in rend sek if a man be not seisid of the rent and it be behind he is without recover for that that it was his own folly at the beginning that rend sek is a thing against common right as well as rend charge/ But in assize of novel disseisin and in a wryt of entre sur disseisin brought of rent sek it behoveth of necessity to show forth a deed for vat that rend sek is a thing against common right except in the case before said where it was rend service before And assize of novel dissyesyn a wryt or entre sur cessaunt contain with in them no title but suppose a disseisin to be done to the plaintiff and of the intendment of the law the disseisin gyffyth no cause of averment against common right but of necessity it behooveth to show forth a deed Sewte service is to come to the court of three weeks to. three weeks by the hole year & for that a man shallbe distrained and not amercyed.
