any parson or parsons or be retained with any parson or parsons by oath promise lyuerey writing token bage or otherwise vpon diverse pains & forfaytures in such statutes contained / That notwithstanding diverse and many parsons haue take upon them some to give and some to receive lyuereyse and to receive / and be received contrary to the form of the said Statutes / And little or nothing is or hath ben done for the punishment of the offenderse in that behalf / By reason whereof many Murdures / Ryottes, routs unlawful assemblese mayntenaunces imbrac●ryse & other great inconveniences haue ensued and daily doth ensue to the disturbance and inquietacyon of the kings Subgieties & to the ●ette of th'execution of his laws / wherefore the king our most 〈◇〉 sovereign lord by thaduyse of his counsel willeth straytlye chargeth & commandeth all his true & faithful subjects & liegemen of what degree state or condition soever he or they be / that they & every of them fromhensfourthe observe keep & perform all & singular statutes & ordinances & every parte of the same aforetyme had or made against such as make unlawful reteynoures / and such as so be retained or that give or receive lyuerey contrary to the form & effect of the same Statutes & ordinances & that no parson ne parsons fromhensfourthe do retain ne be received contrary to the said statutes / ne that any parson or parsons heretofore in any wise retained by the kings letters myssyues placardes patents or other wise fromhensfourthe use or were any lyuerey Bage token or oderwyse call himself servant to any such parson to whom he or they haue ben so retained / vpon such pains & forfaytures as ben contained in the same statutes any commandment letters myssyues / placardes / commyssyones / or letters / patents under the kings great seal to the contrary made in any wise notwithstanding All which commandments / letters / myssyues / placardes / commyssyones & lcns patents of what date or nature so ever they be or to whom / or for what cause soever they were granted / the kings hygnes utterly hath revoked & by this proclamation clearly declareth them now & fromhesfourthe to be void & of no force streyngthe ne effect / And also the kings highness calling to his remembrance howe that many notable acts & Statutes haue been made & established in the days of his noble progenitoures kings of england for reformation & punishment of vacabundesidle & suspect {per}sones & avoiding of unlawful games & correction of vitellers vpon grievous pains contained in the same acts & Statutes And that notwithstanding little or nothing hath ben done within cities boroughs towns & other places of this his realm for punishment of the said vagabonds idle & susspecte parsons & for the avoiding of unlawful games & correction of vitellers by his Iustyces of pease / Mayres / Shereffes & other his officers thereunto authorized by reason whereof diverse horrible murdres & roboryes hath ben also committed & done & also decays of Cities / towns / & Borughes like to ensue to the great desolacion & rayns of this his realm. & also for lack of correction of by tellers the kings subjects hath sustained great damages & losses which premyises to avoyde his grace above all earthly things tenderly mindeth & to reduse the same his realm in his dayes into his ancient honour wealth & prosperity / His highness therfore wyllethe straightly chargeth & commandeth all & singular his Iustices of pease / Mayres Sherefz / bailiffs & other hede Officers Rulers of countries / Cities & Townys with in this his said realm that they & every of them forasmoche as to them & every of them concernyth do executes cause to be executed as well the statute of ●… nchester the statute for punishment of vagabonds the statute made for the avoiding of unlawful games & also the statute made for correction of vytellers as the said statutes made against them that retain or be retained vpon such pains as be contained in the said statutes & every of them to be executed & levied vpon the said offenders Mayres / Shrefes and other head officers aforesaid in case the kings grace finde any default offence remyse or negligence in them or any of them in observing & execution of the said statutes / and as they will answer to the king at their further {per}illes and to then ●… e that no person shall haue Hyrste the statute of wynchestre / made the .xiii. year of the reign of the kings noble progenitors king Edwarde the first as ensueth. ¶ forasmuch as daily roboryes murdres and brennynges be more often and commonly done within this our realm then ever was heretofore / and that felons haue not ben therfore attainted / by the oaths of the Iurours / which rather wilfully suffer Felonyes to be done to strange parsons / and to pass without punishment of endittement of the said misdoers / whereof great parte of the said misdoers be of the people of the same country / or at the leste if the said misdoers be of another country / the Receytours be of the neighbours of the same country / and the said Iurours do not regard nor fe●… e their oaths / where the said felonyes be done. ¶ And as to the restitution of them that were damaged and hurtyd before time / noo pain was purveyed for the concillement or Mysbehauoure of the said country or Iurours where such offences were done. ¶ The king our sovereign lord for to esschewe and abate the power of felons hath established a pain in this case / so that for fear of the said pain ●… ther than for fear and dread of their oaths / and that no parsons from henceforth offending shall not escape / nor no felouyes be conceyled. ¶ The king our said sovereign Lord commandeth that a Erye and proclamation be solemnly made in all shires Hundred{is} markets fairs & all other places where great assemble of people shalbe / So that by Ingnoraunce no parson shall excuse him / that every count from henceforth be kept so that 〈…〉 after any Roboryes and felonyes be done fresh suit be made from town to town and country to country. ¶ And also if need be that enquestes be made in town or towns by him or them that is sovereign of the town or towns / And after in hundred{is} and in franchises And in the county or Counties / and sometimes in two / three / or four shires in case when felonyes be done in marches of the same shire or shires / so that the said misdoers may be attainted according to their demerits / and if the country or Countres do● not take the body or bodies of such mysdowers / their punishment and pain shalbe such / That is to say every of the people in the country abiding there shall answer at the robberies and damages done there / So that the hundred or handmaides where as the robbery or robberies shal be done within the franchise or franchises within the said hundred or handmaides shall answer of the said robbery or robberies And if the robbery be done in the ends or the deuydynge of two hundreds / then shall ●… the the handmaides with the franchise within them answer / for the said misdeeds and offences done And the country or Countres shall haue no longer ●… e / after the robbery or robberies Felony or Felonyes done but .xl. dayes within which time the said country or countries shal make agreement or ●…pence of the said robbery or robberies and misdeeds / or elles answer the body or bodies of such misdoers. ¶ And furthermore the kings highness / for the farther sewertye of his subjects / chargeth & commaundth that all the gates in every great walled town or towns be shut at the son setting / and not open before son rising. ¶ And that no parson shalbe lodged nor harbergyd in the Subbardes nor in the foreign of any such To●… but by day ty●… nor yet by day time but if the 〈…〉 will answer for him.
