ANNO. XXXII. HENRICI OCTAVI. ❧ THE SVBSIDYE OF THE temporalty. THE kings most loving subiectes in this present parliament assembled, lovingly calling to their remembrance, the innumerable benefits and goodness, which they always haue found in the kings most royal majesty, their natural and most dread sovereign lord, reignynge over them the space of . XXXI. yeres full and more, during the which they haue welthyly lived, and prosperousely continued under his majesty, well defended, governed, and maintained from and against all maner of enemies, to their no little surety wealth quiet and rest: howe his highnes also by the inestimable grace that god hath given him,& his onely high prudence wisdom and study, hath brought his said true subiectes out of all blindness and ignorance into the true and perfect knowledge of almighty god, by his most holy word: Thabolyshing also of the bishop of Rome& his usurped authority, by whose subtle imagination, practise, inventions and devises, exceeding sums of money haue wont daily and yearly to be conveyed out of this realm for payment of byshops bulls, breves, and dispensations, and the money commonly called Peterpence, with untrue& feigned pardons, by the which and dyvers other like, and the gatherers of the same, being no small number( specially of pardoners) the kings loving subiectes haue been greatly heretofore disceyued spoyled and hindered: whereof by his princely policy and wisdom they be delivered and lawfully discharged. considering also the exceeding great costs charges and expenses that his highnes hath sustained in and about the repression of the great late rebellion in lincoln shire, and the north partes of this realm: what yearly costs and charges also his majesty is at, and of long time hath been, for and about the establyshynge of three presidents and discrete several counsels, as well in the marches of Wales, and the shires thereunto adjoining, as in the north and west partes of this realm: By reason whereof his true subiectes poor and rich without tract of time, or any great charges or expenses, haue vndelayed justice daily admynystred unto them. Further the great and exceeding charges also his highnesse was at, the year last paste, in and for the preparation of an army by the sea, ryggynge vyctualynge and setting forward his majesties navy of ships with artyllerye, and other habyllementes of war, for the defence of his said loving subiectes, and his realm, against such ennemyes as than moved the pretensed inuasyon into the same, and utter destruction therof. moreover, the great and most extreme charges, costs and expenses his majesty hath sustained, and contyneweth daily, in edifying, new making, building, fortyfyenge, and preparing, as well of the towns, castles, and fortresses of Calays, Guysnes, Ruysbanke, and hams, Barwyke, Carlyle, and other fortresses, set and being nere unto the borders of Scotlande, as the castles, Blocke-howses and Fortresses newelye made edified and builded in the downs at dover, Folkeston, Rye, Chalshotspoynte, the cow vnderwighte, two bulwarks above Grauesende, one bulwark at Higham, two other bulwarks on Essex side, that is to say, thone at Tilbury, and the other over against gravesend, with diverse other at Plymmouth, Dartmouthe, Falmouthe, Fawey, the Torrebay, Portlande, and other: And the great charges that his highnes must continually sustain in and about the munytynge, and fortifieng of the said castles, fortresses, and bulwarks with all maner of habylementes of war, with the great yearly and continual charges, for thengarnishynge of the same with captains, lieutenauntes, porters, soldiers, gunners, and men of war for the sure defence therof. The great costs also and expenses by his majesty sustained in and about the making of the haven at dover, a singular wealth surety commodyty and profit to the hole realm, and the preservation of the navy of the same. finally the long and continual charges and expenses his majesty hath had and continually doth sustain in and about the maintenance of an army for the defence of his ennemyes within his dominion of ireland, and for the conducyng and bringing the same to good rule order and cyuyle subiection; as well for the utility and prosperity of his true and loving subiectes of this realm, as for the surety of the same. All which, with many other notable things done by his majesty for their surety, peace, quiet, preservation, wealth, commodity, and other exceeding benefactes, which were very long and tedious herein to be rehearsed, they well considered, could never haue been done compassed nor perfected without marvelous intolerable costs, charges, and expenses. Therfore though they reckon themselves far unable, and of small power to do any thing, that might be gratefulle to so noble a prince and sovereign, that hath so benygnelye haboundauntlye, gracyouslye and polytykely, declared his virtue, great goodness, and magnytude towards them, as their hartes wolde serve, yf their powers were according to the same: Yet to the intent, his majesty may perceive their loving minds, good wills, and towardenesse, to be such as can not forget his highnesse great goodness so haboundauntelye shewed for their wealth, surety, and quyetenesse, they of their own free wills, liberality, and assent, like true, natural, faythefulle, and most loving subiectes, of singular love, zeal, and obedience they owe towards the kings majesty, their most dread sovereign and most benign lord and king, myndynge to support and bear with him, after their simple powers, somme what towards the alleviation of his said great and most exceeding charges and expenses, they haue of one hole assent and agreemente, with the consent of the lords spiritual and temporalle in the said parlyamente also assembled, and by authority of the same, given and granted unto the kings highness, towards his foresaid great costs and inestimable charges, four hole xv. and .x. to be had paid taken and levied of the movable goods, cattelles, and other things usual to such .xv. and .x. to be contributorye and chargeable within the shires cities boroughs and towns, and other places of this his realm, in maner and form afore time used( except the sum of .xxiiii. M. li. therof fully be deducted, that is to say .vi. thousand pound of either of the hole .xv. and .x. of the sum that a .xv. and x. atteyneth unto, in relief comfort and discharge of the poor towns cities and boroughs of this his said realm wasted desolate or destroyed, or over greatly empoueryshed, or else to such .xv. or .x. over greatly charged: the same sum of .xxiiii. M. li. of the said four hole .xv. and .x. that is to say, severally for every of the said .xv.& .x. vi. M. li. after such rate as was afore this time made unto every shire to be divided, in such maner and form as heretofore for one hole .xv. and .x. was had and divided, the said four hole .xv. and .x.( the exceptions and deductions aforesaid thereupon had) to be paid in maner and form following. That is to say: The first hole .xv. and .x. to be payed to his highness in the receit of his exchequer, the .iiii. day of February next coming. The second hole .xv. and .x. to be paid to his said highness, at the receit of his Eschequire, the .iiii. day of February in the year of our lord god that shall be. M. v. xli. The thyrde hole .xv. and .x. to be paid unto his highness at the said receipt of his exchequer in the fourthe day of february than next following. And the fourth hole .xv. and .x. to be paid to his said highness at the said receyt of his foresaid Eschequire the fourth day of February, in the year of our lord god, that shall be a thousand five hundred forty and three. ¶ And be it further enacted by thauctoritie aforesaid, that the knights elected and returned of and for the shires within this realm, for this present parlyamente, citizens of cities, and burgeys of boroughs and towns, where collectors haue been used to be name and appoynted for the collection of any .xv. and .x. before this time granted, shall name and appoint yearly sufficient and able persons for the collection of the said .xv. and .x. in every of the said shires cities boroughs and towns. And also such person or personnes, so by them to be name and appoynted for the collection of the said .xv. and tenth, shall severally appoint and allotte in to handmaides, rapes, wapentakes, cities, boroughs, and towns. And also the said personnes so name and appoynted for the collection of the same .xv. and .x. shall be charged and chargeable vpon his or their account or accounts in the Eschequire to be made, with all such sum or sums of money, as the handmaides, rapes, wapentakes, cities, boroughs, and towns, where he or they shall so happen to be appoynted, amount unto, and of no more sum or sums: And upon the payemente of such sums of money, as he shall be charged with, shall be discharged, and haue his Quietus est, the none accounting, or none payment of any other his fellows, or the insufficiency of them not withstanding. And the names and surnames of every of the said collectors for the said .xv. and .x. to gether with the place allotted to their collection and charge, the said knights, cytisens, and burgesis for the shire city and borough, whereof they be elected name and returned, shall certify every year before the king in his chauncerye yearly at the utas of saint johan Baptist ensuing. And yf default of any such certifyenge be had or made: than the lord chancellor for the time being, shall name and appoint collectors for the collection of the same hole four .xv. and .x. in maner and form as the said knights of the shire should haue done, and as afore time haue ben used, the which said collectors and every of them, shall haue like allowance vpon their accounts for their fees wages and rewards for the collection of the said xv. and .x. in as large maner and form as any collector or collectors of .xv. and .x. haue had at any season in time paste. And also that no collector that shall be name and charged for the collection of any of the said xv. and .x. shall be made collector, or charged with any of the residue of the said .xv. and .x. And that the barons of the Eschequyre for the time being, shall and may from time to time award such processes for the speedy payment therof, against the collector and collectors of the same, as by their discretions shall be thought convenient. ¶ And because the said .xv. and .x. granted as is aforesaid, extendeth but to a small sum of money towards, the recompense of the charges of our said sovereign lord, before this time sustained in his most royal affairs for the commen wealth of this realm, as is afore rehearsed, his said loving commons, haue granted unto the same our sovereign lord, by the authority of this present parlyamente, a yearly subsidy, by the space of two yeares, now next ensewynge, to be taxed, set, levied, and paid of every person, of what estate or degree he be of, according to the tenor of this act, in maner and form following. That is to say, of every person born under the kings obeisance, and chargeable to this subsidy, for every pound yearly during of the said two yeares, that the same person, or any other to his use, haue in fee simple, fee tail, term of life, term of yeares, by execution, by ward, by copy of court roll, or at coil, any honours, castles, manors, lands, tenements, rent, service, hereditaments, annuyties, fees, corrodyes, or profits of the true just and clear yearly value of .xx. li. or above, each of the said two yeares( lands and tenements chargeable to the dysme of the clergy onely except) .xii. d. And of every alien or stranger born out of the kings obeisance, as well denysen, as other, for every pound yearly in either of the said two yeares, that the same alien or stranger, or any other to his use hath in form before said, in lands tenements,& other the premises, of the clear yearly value of .xx. s. or above( except before excepted). ii.s. And of every person born under the kings obeisance, yearly during every of the said two yeres for every pound as well in coin,& the value of every pound that any such person hath of his own, or to any other use, as also plate, stock of merchandise, all maner of cornes and blade severed from the ground, household stuff, and of all other goods movable, as well within this realm as without, and of all such sums of money, that to him is owyng, whereof he trusteth in his conscience surely to be paid( except and of the premises deducted such sums of money as he oweth, and in his conscience truly intendeth to pay. And except also the apparel of all personnes belonging to their bodies, saving jewels, gold, silver, ston, and other) .vi. pence. So that all the foresaid substance, coins, debts, plate, goods, and cattles, and other the premisses, extend and be to the value of .xx. pound sterlynges, or above( except before excepted.) And of every alien and stranger born out of the kings obeyssaunce, as well denisen as other, inhabiting within this realm, yearly during either of the said two yeres, for every pound that he hath in coin, and the value of every pound in plate cornes grains and blades of cornes severed from the ground, merchandise, household stuff, or other goods, jewels, or cattles movable, as is before said, as well within this realm as without, and of all sums of money, that to him is owing, whereof he trusteth in his conscience surely to be paid( except and of the premisses deducted such sums of money as he oweth, and in his conscience intendeth truly to pay .xii. pence. so that all the same substance, coignes, debts and plate, goods, and cattles, and other the premisses, extend to the value of twenty shillings sterling, or above. ¶ And it is further enacted, by authority of this present parlyamente, that every such person, as well such as be born under the kings obeisance, as every other person stranger born, inhabytynge within this realm, which at the time of the said assessing or taxation, yearly to be had or made, shall be out of this realm, and shall haue goods or cattles, lands, or tenements, fees, or annuities, or other yearly profits within this realm, shall be charged for the same, by the certificat of the inhabitants of the parties, where such goods, cattles, lands, tenements, or other the premisses than shall be, or in such other place, where such person or his factor, deputy, or attourneye, shall haue his most resort unto, within this realm, in like manner as yf the same person were or had been at the time of the assessing within this realm, abiding, or dwelling. And that all coygne, plate, goods, and cattalles, being in the rule and custody of any person or personnes, to the use of any other person within age, or of full age, or to the use of any corporation, fraternity, guild, mystery, or any commynaltye, being corporate, or not corporate, be and shall be ranted, set, and charged, by reason of this act, as the value certified by the presenters of that certificat, to be sworn in every of the said two yeares. xii.d. of the pound. So that the same goods be of the value of .xx. li. or above: and the sums as afore is rehearsed, taxed, to be levied and taken of them that shall haue such goods in custody, or otherwise charged as afore is rehearsed, the same person to be discharged against him or them, that shall haue them at the time of the delivery therof, or at his otherwise departure from the custody or possession of the same, all goods, cattals, jewels, and ornaments of churches or chapels, and all other things ordained for the honour and service of almighty God, always of and for any charge to the said subsidy forprised and except. The which said subsidy in& for every of the said two yeres, as is aforesaid, shal be assessed, levied, taken, and paid of every person chargeable to the same subsidy granted by this act, according and after the rate of such yearly substance and value of lands, tenements, and other the premisses, goods, and cattals, as every person so to be charged, shall be of, at the time of the said yearly assessing or taxation, vpon him to be made, and in none other wise. And the said subsidy shall be yearly taxed, assessed, and ranted, according to this act in every shire, ridding, lethe, wapentake, rape, city, borough, town, and every other place, within every of the said two yeres, between the first day of september, and the .xx. day of October. And the said sums of every shire ryddyng city town, or other place aforesaid, of and for the said subsidy to be taxed and ranted yearly by commissioners of and to the same limited, or two of them at the leste, with the names of the high collectors, shall be certified into the kings exchequer every of the said two yeres, before the .xvi. day of Nouembre,& the said sums, in maner and form before said taxed, shal be yearly paid into the kings receit of his exchequer, at westminster, to the use of our said sovereign lord, every of the said two yeres before the .vi. day of February yearly, during the said .ii. yeres. And the sums abovesaid, of& for the said subsidy yearly taxed set asked demanded taken gathered levied and paid unto the use of our said sovereign lord, in form beforesaid, as well within the liberties franchises sayntuaries ancient demayn, and other what so ever place exempt or not exempt, as without: Except such shires places and persons as shal be forprised in& by this act: any grant chartre use or liberty by reason of any letters patents, or otherwise privileged prescription, allowance of the same, or what so ever other matter of discharge heretofore to the contrary had made granted used or obtained, not withstanding. ¶ provided alway, that the assessing, leuyenge, and gathering of the said subsidy, or any part therof in any liberty or franchise, be not in any wise hereafter prejudicial or hurtful to any of the lords of the said liberties or franchises, of for or concerning their said liberties or franchises. ¶ And furthermore be it enacted, that for the assessing and ordering of the said subsidy yearly during the said two yeres, to be duly had, that the lord chancellor of England, lord treasurer of England, the lord President of the kings most honourable council,& the lord privy seal, for the time being, or two of them at the least, whereof the lord chancellor of England for the time being to be one of them, shall& may name and appoint of and for every shire and ridding within this realm, and also of& for every of the cities of London, coventry, chester, new Salisburye, Canterburye, Norwych, bristol, Wourcester, york, lincoln, Bathe, exeter, hereford, and Rochester, and for every of the towns of Southampton, Leicester, Shoresbury, Notingham, Kingston vpon Hull, Oxeforde, new Wyndesore, Gloucestre, Colchestre, great yarmouth, Iopeswich, Northampton and Derby, and of and for the borough of South work,& isle of wight, such certain number of persons, as to them shall be thought convenient of every of the same shires, ryddynges, laths, wapentakes rapes cities boroughs, and every other place, and isle of wight, as of other inhabitants of the same shires ryddynges laths wapentakes rapes cities towns boroughs& isle, to be commissioners with in the said shires ryddynges wapentakes laths rapes cities towns boroughs and isle, whereof they be inhabitants in the same, and of& for the honourable households of the king our sovereign lord, the queen,& the prince, certain of the head officers of the same to be commissioners of the same households, in what shire or other place, the said households shall then happen to be: And the lord chancellor and other with him afore name, in like maner may name& appoint of every other city borough or town corporat, not being before expressed .vi. v. iiii. iii. or .ii. of the head officers, and other sad and honest inhabitants of every of the said other cities boroughs and towns corporate, according to the number& multitude of people being in the same, the which persons, yf any such be there unto name of the said inhabitants of the said cities boroughs and towns corporat, not expressed before by name, shall be joined and put as commissioners with the persons name for such shires and ryddynges as the said cities boroughs& towns corporate, not expressly before name, be set and haue their being, which persons so name for and of the said cities boroughs& towns corporat, not before name expressly, by reason of their dwelling in the same, shall not take vpon them, ne none of them to put any part of their commission in execution for the premisses, out of the said city borough or town corporate, wherein they being so name onely for the same, be dwelling:& also not to execute the said commission, within the city borough or town corporat where they be so dwelling, but jointly with two at the least of the other commissioners within the shire ridding and in that commission where they be so dwelling, at such dayes& times as the said other commissioners for the same shire& ridding shall there unto lymit& appoint within the same city or town corporat, whereof they so be, and not out of such city or town,& in that maner to be aiding and assystynge with the said other commissioners, in& for the good execution of the effect of their said commission, vpon pain of every of the said commissioners so name, for every such city borough& town corporat, being not before expressed by name, to make such fine as the said other commissioners in the commission of& for the said shire ridding name, or four of them at the least, shall by their discretions set& certify in to the kings exchequer, there to be levied unto the use of our common lord the king, in like maner as such or like sums had ben set and ranted vpon every such person for the said subsidy, the which commissioners so name of and for the said cities boroughs and towns, not before specially name, and onely put in the said commission by reason of their dwellings in the same, shall not haue any parte of the portion of the fees or rewards for the commissioners and their clerkes in this act afterward especifyed. And that the chancellor of england for the time being, shall make& direct out of the court of the chancery, under the kings great seal, several commissions, that is to say, to every shire, riddyng, laths, wapentakes, rape, city, town, borough, isle and households, unto such person or persons, as by his discretion& other with him afore name, in like maner& form as afore is rehearsed, shal be thought sufficient for the sessynge& leueyng of the same subsidy in all shires and places, according to the true meaning of this act, which commissions shal be yearly directed and delivered to the said commissioners, or to one of them, before the .vi. day of August: And to every of the said commissioners .x. cedules, containing in them the tenor of this act, shalbe affiled, by the which commission, the commissioners in every such commission name according to this act,& every number of them unto two of them at the least, shall haue full power and authority, to put the effect of the said act in execution: And by authority of this act after such commission to them directed, may yearly, during the said two yeres, by their assents and agrementes, sever themselves for the execution of their commission in handmaides, laths, wards, rapes, wapentakes, towns, parishes, and other places within the limits of their said commission, in such form as to them shall seem expedient to be ordered,& between them to be communed and agreed, vpon which seueraunce every person of this present parliament that shal be commissioner, shalbe assigned in the hundred where he dwelleth in place by their commission. ¶ provided alway, that no person be or shall be assigned any commissioner, to& for the execution of this present act, but onely in the shear where he dwelleth and inhabiteth. And that no person, being assigned to the contrary hereof, in any wise shall put in execution the effect of this act, or any parte therof. ¶ And it is enacted by authority of this present parliament, that the commissioners and every of them, which shall be name limited& assigned, according to this act to be commissioners in every shire, rydding, laths, wapentakes, rapes, city, town, borough, isle,& in the said households, or any other place, and none other, shal truly effectually and diligently for their partes execute the effect of this present act, according to the tenor ther of in every behalf: and none otherwise by any other means, without omission, favour, dread, malice, or any other thing to be attempted or done by them or any of them to the contrary hereof. And the said commissioners, and every nombre of them unto two of them at the leste, and none other for the execution of the same commission& act, shall yearly during the said two yeres between the first day of September and the .xx. day of October, after commissions delivered to them in form above said, direct their several or iont precept unto .viii. vi. v. iii. ii. or mo, as for the nombre of the inhabitants shalbe requisite, of the most substantial discrete& honest persons inhabitants, by the said commissioners, or two of them at the leste to be name, of and in handmaides laths rapes wapentakes ward parish town or other place, as well within the liberty franchise sanctuary as without, within the limits of the shires, riddynges, laths, wapentakes, rapes, cities, towns, boroughs or yle aforesaid,& other places with in the limits of their commissions, and to the constables, subconstables, bailiffs, and other like officers or ministers of every of the said handmaides, towns, wards, laths, wapentakes, laths, parishes, and other places before said, as to the said commissioners of every nombre of them, unto two of them by their discretion in division, shall seem expedient, as by the maner and use of that parties shall be requisite, straytelye by the same precept charging and commanding the same inhabitants constables and other officers aforesaid, to whom such precept shalbe so directed, to appear in their proper persons before the said commissioners, or such nombre of them, as they shall diuyde themselves, unto two of them at the leste, at certain dayes and places by the said commissioners, or every nombre of them, unto two of them at the least, within city boroughs or town corporate, or without, in any other place as is aforesaid, by their discretions to be limited, there to do and accomplish all that to them on the parte of our sovereign lord the king shalbe enjoined touching this act. commanding further by the same precept, that he to whose hands such precept shall come, shall show or deliver the same to the other inhabitants or officers name in the same. And that none of them fail to accomplish the same vpon pain of. xl.s. ¶ And it is ordained by the said authority of this parlyamente, that the said day and place prefixed and limited in the said precepts, every of the commissioners then being within the shire, and having no sufficient excuse for his abscense, shall at the said day and place prefixed, for that part whereunto he was limited, appear in his proper person, and there the same commissioners being present, or two of them at the least, shall call or cause to be called before them, the said inhabitants and officers, to whom they haue directed their said precepts,& which had in commandment there to appear by the said precept of the said commissioners. And yf any so warned make default, unless he shall then be letted by sickness or lawful excuse and that let then to be wytnessed by the oaths of two credible persons, or yf any so appearing, refuse to be sworn in form following, to forfeit. xl.s. and so at every day, at any time during the said two yeres prefixed for the same cause, unto the time the number of every such place haue appeared& certified in form under written. And every of them so making default, or refusing to be sworn, to forfeit. xl.s, and vpon the same appearance had, one of the most substantial inhabitants or officer so there being warned& appearing before the said commissioners, shalbe sworn yearly during the said .ii. yeres vpon a book after this form openlye before the commissioners. ¶ I shall truly inquire with my fellows that shalbe charged with me, of the hundred, wapentake, ward, town, or other place, of the best and most value of the substance of every person, dwelling or abiding within the limits of the places, that I and my fellows shalbe charged with, and of other, which shal haue his or their most resort unto any of the same places& chargeable with any sum of money, by this act of the said subsidy,& of all other articles that I shalbe charged with, touching the said act, and according to the intent of the same, and thereupon as nere as shall come to my knowledge truly present& certify before you the names and surnames substance and valves of every of them, as well of lands tenements and other hereditaments possessions and profits recited in the said act, as of goods& catals, and every of them chargeable by the said act, without concelement favour love affection dread fear or malice, so help me god& the contents of this book. And every other person that shall appear there yearly by the said precepts, shall make like oath:& vpon the oath so taken as is before said by thinhabitauntes and officers of every hundred ward wapentake town or other place, the said commissioners shall yearly openly there rede or cause to be read unto them the said rates,& openly declare theffect of their charge unto them, in what maner& form they ought and should make their certificates, according to the rates& sums therof abovesaid, and of all maner of persons as well of alyens and strangers inhabited within this realm, as of such as be born within the kings obeisance chargeable to this act,& of the possessions goods& catels of fraternities guyldes, and other as is abovesaid, and of persons being in the parties or beyond the see, having goods or catelles lands or tenememtes within this realm as is before said, and of all goods being in custody to the use of any other as is abovesaid. By the which information& showing the said persons shall haue such plain knowledge of the true intent of this present act, and of the maner of their certificat, that the same persons shall haue no reasonable cause to excuse them by ignorance, and after such oath and the statute of the said subsidy,& the maner of the said certificat to be made in writing, containing the names and surnames of every person, and whether he be born without the kings obeisance,& the beste value of every person in every degree, as well of yearly value of lands and tenements, as such like possessions and profittes, as the value of goods& cattalles, and in every thing to their said certificat requisite and necessary to them declared, the said commissioners there being, shall by their discretions appoint and lymit unto the said persons, an other day and place to appear afore the said commissioners, and charging the said persons that they in the mean time shall make diligent inquiry of the premises, and then there every of them vpon pain of. xx.s. to appear at the said new prefixed day and place, there to certify unto the said commissioners in writing, according to their said charge, and according to the true intent of the said grant of Subsidy, and as to them in maner afore said hath then ben shewed and declared by the commissioners, at which day and place so to them prefixed, if any of the said persons make default, or appear, and refuse to make the said certificat: that then every of them so offending to forfeit. xl.s. except onely a reasonable excuse for his default, by reason of sickness, or otherwise by the oaths of two credible persons ther witnessed be had. And of such as appear redy to make certificat as is aforesaid, the said commissioners there being, shal take and receive the same certifycat, and every part therof, and the names, valves, and substance of every person so certified, and if the same commissioners see cause reasonable, they shall examine the said presenters therof. And there vpon the same commissioners at the said dayes and places, by their agreement among themselves, shall yearly during the said two yeres, openly there prefyx other dayes or day, at a certain place or places, within the limits of their commission, by their discretion for their further proceeding to the said yearly assessing of the said subsidy, and there vpon at the said day of the said certificat, as is beforesaid taken, the same commissioners shall make their precept or precepts to the constables, subconstables, bailiffs, or other officers of such handmaides wapentakes towns or other places aforesaid, as the same commissioners shal be of, comprisynge and containing in the same precept, the names and surnames of all persons presented before them in the said certificates, of whom the said commissioners, or two of them at the least, shal then haue vehement suspect to be of more and greater value or substance in lands tenements goods cattalles, or sums of money owyng to them, or other substance beforesaid, then vpon such person or persons shal be certified. commanding the same constables, bailiffs, and other officers, to whom such precept shalbe directed, to warn such persons, whose names shalbe comprised in the said precept, at their mansions, or to their persons, that the same persons name in such precepts and every of them, shall personally appear before the said commissioners, at the same new prefixed day and place, days and places ther to be sworn and examined by the said commissyoners, of their substance and value, and sums of money owing to them, and other what so ever matter concerning the premises, or any of them, according to this act. At which day and place so prefixed, the said commissioners then there being, or two of them at the least, shal cause to be called the said persons whose names shalbe comprised in the said precept, as it is before said, for their examination. And if any of those {per}sons, as is before said, to be examined, which at any time after the warning,& before the prefixed day shall be within such place, where he may haue knowledge of his said apparance to be made, make default& appear not, unless a reasonable cause, or else a reasonable excuse, by the oaths of two credible persons, before the said commissioners be alleged for his discharge: that then every of them so making default, to be taxed and charged with and at the double sums of the rate, that he should or ought to haue ben set at, for and after the best valu of his substance, vpon him certified, if he had appeared, by discretion of the commissioners there being. And in like maner if any of them suspected, as is before said, appear and refuse to be sworn in form following, than every such offendoure to be taxed and charged, with and at the double sum of the rate that he should or ought to haue ben set at, for and after the best value of his substance vpon him certified, by the said persons that made the certificat as is before said, by the discretions of the commissioners there then being. And every of the persons so there appearing, whose names shal be expressed in the said precept, and in whom any vehement suspect was or shal be had in form above said, shall openly there be sworn in this maner. ¶ I shal faithfully truly and plainly, according to my knowledge, show unto you the kings commissioners, and to other by you assigned, the best and greatest value or above, with all mine yearly profits in lands tenements rents or such other like possessions, yearly profit for fees, and the best and greatest value of al my goods and cattalles, and sums of money to me owing, according to the grant of this act of Subsidy, and truly answer to that I shall be examined of, touching the premises, without coueyn or deceypt, so help me god and the holy contents of this book. ¶ AND if any person that should appear be excused in form before said by witness of credible persons, the same persons shalbe examined by their oaths of his or their value and substance so lacking and excused, and by the best of that certificat or knowledge, or of the other first certifycat vpon him or them made, the same person so lacking and excused of his appearance be set and ranted by the said commissioners, or other wise to be set and ranted in this case, as shall seem best by the discretions of the said commissioners. ¶ AND EVERY spiritual person yearly during the said .ii. yeres, shalbe ranted and set according to the rate above said, of and for every pound, that the same spiritual person, or any other to his use hath, by discente, bargain, or purchase, in fee simple, fee tail, term of yeres, execution, by ward, by copy of court roll, in any maner lands, tenements, rents, services, or hereditaments, after the true, just, and clear yearly value thereof in form above remembered: so that it extend to the value of twenty pound or above. And if any maner of person, certified or ranted at any maner of value, offer himself to be sworn and examined by his oath at any of the said prefixed days,& do swear for his discharge in that he is certified above his value or substance, so that he come before the extretes of the said assessing( as shal be afterward declared) be delivered by the said commissioners into the kings exchequer, the same person shalbe received and his oath taken. And all persons so offering themselves to be sworn, and al other sworn and examined at calling by the said commissioners as is abovesaid, shal be ranted and charged, according to the value and substance shewed by his or their disposition, or his or their oaths made at the time of their examination,& none otherwise. And all persons set ranted& taxed as is beforesaid, shal be bound and charged by the same. And the sum or sums vpon him set to be due towards the payment of the subsidy, and to be levied as hereafter shal be specified. ¶ And it is also enacted by the said authority, that every person yearly during the said two yeres, as is aforesaid, be ranted taxed and set, and the sum on him set to be levied in such place, where he at the time of the said certificat to be made, shal keep his house or dwelling, or where he than shall be most conversant abiding or resiant, or shall haue his most resort,& shal be best known at the time of the said certificat to be made, and no where else. And yf any person chargeable to this act at the time of the said assessing, happen to be out of this realm, or far from the place, where he shalbe known: than he to be set where he was last abiding in this realm, and beste known, and after the substance value and other profits of every person known by the examination certificat, or other maner of wise, as is aforesaid, the said commissioners .vi. v. .iiii. iii. or .ii. of them, shall yearly during the said two yeres, after the rate aforesaid, set and tax every person according to the rate of the substance value of lands goods and other profits, whereby the greatest and most sum, according to his most substance by reason of this act, ought or may be set or taxed. ¶ provided alway, that no person that shalbe taxed for payment of this subsidy, for and after the yearly valu of his lamdes tenements or other real possessions or profits in any of the said two yeres, be set or taxed for his goods and cattalles, and other movable substance in either of the said two yeres, and he that shall be taxed or charged for the same for his goods cattalles or other movables, in either of the said two yeres, shall not be charged taxed or chargeable for his land or other real possessions or profits in either of the said two yeres: nor that any person to be double charged for the said subsidy, neither set or taxed at several places by reason of this act, any thing in this present act contained not withstanding. ¶ And that it be ordained by the said authority of this present parliament, that no person having two mansyons or two places to resort unto, or calling himself household servant, or waytynge servant to the kings highness, the queen, the prince, or other lord or lady, master or mistress, be excused upon his saying from the tax of the said yearly subsidy, in neither of the places where he may be set, unless he bring a certificat in writing from the commissioners, where that he is so set in dede at one place. And yf any happen to be set in two places upon certifycat thereof made, the beste and most sum upon him so taxed to be taken and abide, and the other to be discharged: So that the same certifycat of his assessing and payment be made thereof in writing under the seals of the commissioners, or two of them: which certificat so made, shall be at all times sufficient discharge for him, as well against any collector, that shall demand the same upon him ranted or taxed, as against the king, and all other personnes. And yf any person that ought to be set by reason of his remouynge or resorting to two places, or by reason of his saying, that he is elles where taxed, or by reason of any priuyledge by his dwelling or abiding in any place, not being foreprysed in this act, or any other wise, by his coueyn or craft, happen to escape from the yearly sessynge and be not set, and that proved by presentment and examination, or infourmation before any two of the said commissioners, or the barons of the kings Eschequyre, or two Iustyces of the peace of that country, where such person dwelleth: than every person, that by such means or otherwise, wylfullye by coueyn shall happen to escape from the assessing of the said subsidy, or any of them, and not be ranted taxed and set, shall be charged vpon the knowledge and proof therof with and at the double value, that he should or ought to haue been set at before, according to his hauour, the same double to be levied gathered and paid of his goods and cattalles, lands and tenements, towards the said subsidy, and further to be punished by the dyscretions of the Barons, Iustyces, or commissioners, before whom he shall be conuycted for his offence and deceit in that behalf. And that every commissioner assigned and deputed according to this act for thordynge of this subsidy, dwelling within the precinct and lymytte of his commission, for his own substance in lands and goods shall be valued and ranted yearly, during the said two yeres, by the examination of four three or two other commissioners of the said shire, ridding, lethe, wapentake, rape, city, borough, or town corporate, or other place, where the same commissioner so dwelleth or keepeth his house, and after such value and rate of him known, the same commissioner so dwelling within the lymytte of his commission, to be yearly set and taxed by the other said commissioners, and as well the same upon himself taxed, as the sums made by the presenters sworn, as is afore said, shall be written and set in the extreates, thereof to be made with other inhabitants of that parties, and so to be gathered and levied in like maner as it ought or should haue been, yf the said commissioner had not been in the commission of the place, where he so dwelleth. And that all personnes of the estate of a Baron or Barons, and every estate above, shall be examined and charged of their freehold and valewes, as is aforesaid, before the chancellor, treasurer of england, and lord ivy seal, for the time being, or other persons by the kings authority to be limited yearly during the said two yeres,& they to be charged after the form of the said grant, according to their examination aforesaid. And the sums vpon them set, with the names of the collectors appointed for gathering& paying for the same, be extreted delivered and certified at dayes& places above specified by the said chancellor, treasurer and lord ivy seal, for the time being, or such other persons as shal be limited by the kings highnes, and after the taxes and assesses of the said sums vpon and by the said examination& certificat, as is afore said made, the said commissioners or two of them at the leste, yearly within three weeks next ensuing the feast of saint michael by the writing extreted of the said tax therof, under the seals and signs manuel of two of the said commissioners at the lest to be made, shalbe delivered unto sufficient& substantial inhabitants constables subconstables bailiffs or other officers ioyntely of handmaides towns parishes& other places afore said with in their limits, or to other sufficient persons inhabitants of the same onely, by the discretion of the same commissioners, and as the place or parties shal require, as well the particular names and surnames as the remembrance of all sums of money taxed& set of and vpon every person as well man as woman chargeable to this act, householder& all other inhabitants and dwellers within the said parish towns and places contributaries to this subsidy, by authority of which writing or estrete so delivered, the said officers or other persons so name and deputed severally, shal haue full power and authority, immediately after the delivery of the said writing or estrete, to demand levy& gather of every person therein specified, the somme or sums in the same writing or ertrete comprised,& for none payment therof to distrain the same person or {per}sons so being behind by their goods& cattalles, and the distress so taken to keep by the space of .viii. dayes, at the costs& charges of the owner therof. And yf the said owner do not pay such somme of money as shal be taxed by this act, within the same .viii. daies than the said distress to be appreised by .iiii. iii. or .ii. of thenhabitantes where such distress is taken& sold, for the payment of the said money. And the overplus coming of the sale therof, yf any be, to be immediately restored to the owner of the same distress. Which said officers& other persons so deputed to ask take gather& levy the said sums, shall answer& be charged for their portions only to them assigned& limited to be gathered levied& comprised in the said writing or extrete to them as is before said delivered unto th use of our common lord the king,& the said somme in that writing or extreate comprised, to pay unto the high collectors or collector of that place, for the collection of the same, in maner and form under written, thereunto to be name and deputed, and the same inhabitants and officers so gathering the same particular sums, for their collection therof shall retain for every. xx.s. so by them received& paid. ii.d. that to be allowed at the payment of their collection by them to be made to the high collector. ¶ And further be it enacted by the said authority of this present parliament, that the said commissioners or the more part of thē, as shall take vpon them the execution and business of the said commission, shall yearly during the said .ii. yeres, name certain sufficient& able persons, severally by discretions of the same commissioners, in shires riddinges laths wapentakes rapes cities towns corporate and other what so ever places, aswell within places privileged as without, not being forprised in this act, to be high collectors,& haue the collection and receipt of the said sums, set and leuiable within the precinct limits& bounds where they shalbe so limited to gather& receive: to every of the which collectors so severally name, the said commissioners or two of them at the lest yearly during the said two yeres, within three weeks next after the said hole some of the said subsidy be set by all the limits of their commission, or in such limits as the same high collectors shalbe severally so assigned, shall under their seals& signs manuel deliver one extreat in parchment to every of the same collectors comprising in it the names of all such persons as were assigned to leuye the said particulars,& the sums of every hundred wapentake town or other place aforesaid, according to the extreate so first therof, as is before said, delivered,& as the collector so to be assigned shalbe charged with, evenly concordant and agreeing unto the hole somme, comprised, in the said particular estrete limited to his collection, as is beforesaid. And every such collector, so yearly deputed, having the said extrete in parchment, as is afore said, shall haue authority by this act, yearly during the said two yeres, to appoint dayes and places within the circuit of his collection, for the payment of the said subsidy to him to be made. And therof to give warning by proclamation or otherwise, to all the said constables or other persons or inhabitants having the charge of the said particular collection within the handmaides parishes towns or other places by him or thē limited, to make payment for their said particular collection of every somme as to thē shall appertain. And yf at the said day& place so limited& prefixed, by the said collectors, the said constables officers or other persons or inhabitants as is before said, for the said particular collection appointed& assigned within such hundred city town or other place, do not pay unto the said collectors the somme within their several handmaides towns parishes& other places due& comprised in the said estretes therof to them delivered by the said conmissioners or some of them, as it is afore said, or so much therof as they haue or might by any mean receive, the said .ii. d. for the said particular collection as is beforesaid, always to be therof allowed, except, that than it shalbe lawful to the said high collectors, and every of them,& to their assygnes, to distrain every of the said constables, officers and other inhabitants for their said several& particular collection of the said sums comprised in the said estrete& writing therof to thē& every of thē, as is before expressed, delivered, or for as much of the same somme, as so than shall happen to be gathered levied& behind unpaid, by the goods& cattals of every of them so being behind, and the distresses so taken to be kept appreised and sold, as is aforesaid,& therof to take& levy the somme so than being behind vnpayd,& the overplus coming of the sale of the said distresses, yf any be to be restored and delivered unto the owner in form above remembered. ¶ provided alway, that no person inhabited in any city borough or town corporat, shal be compelled to be assessour or collector of or for any parte of the said subsidy, in any place or places out of the city borough or town corporate, where he dwelleth. ¶ And it is also by the said authority enacted, that yf any inhabitant or officer or what so ever other person or persons, charged to or for the collection or receipt of any part or portion of the said subsidy, in any of the said two yeres, by any maner of mean according to this act, or any person or persons for themselves, or as keeper gardien deputy factor or attorney of& for any other person or persons of any goods& catals,& the owner therof at the time of the said assessinge to be made, being out of this realm, or in any other parties not known, or of& for the goods& catals of any other person or persons of any fraternity guyld mystery or other what so ever commonalty being incorporat, or not incorporat,& all persons having in their rule governance or custody any goods or catals at the time of the said assessing, or any of them to be made, or which for any cause for& by collection or for him self, or for any other, or by reason that he hath the rule governance or custody of any goods or cattals of any other person or persons, fraternity or guyld, or any such other like, or as factor deputy or atturneye, or for any person shalbe taxed valued ranted or set to any somme or sums by reason of this act,& after the taxation& assessing vpon any such person or persons shal be charged with the receipt of the same, happen to die or depart from the place, where he was so taxed and set, or his goods and cattals be so eloyned, or in such privy and covert maner kept, that the said person or persons charhed with the same by estretes or other writing from two of the said commissioners as is afore said, can ne may levy the same somme or sums, comprised in their charge by distress within the limits of their collection, as is before said, or can not sell such distress or distresses as be taken for any of the said yearly payments before the time limited, the high collectors for his payment to be made in the kings receit, than vpon relation therof made, with due examination by the oath of such person or persons as shal be charged with& for the receipt or collection of the same, before two of the commissioners, where such person or persons, or other as is afore said, their goods or catals were set or taxed, and vpon plain certificat therof made into the kings eschequire by the said .ii. commissioners, as well of the dwelling place names& sums of the said persons, of whom the said sums can not be levied& had, as is beforesaid, than as well the said constables and other inhabitants appoynted for the particular collection against the high collectors, as the high collector vpon his account in the said exchequer to be discharged therof,& process to be made for the king out of the same exchequer, by the discretions of the barons of the same eschequire, against such person, his heirs or executours, so being behind with his payment. And over that the same two commissioners, to whom any such declaration of the premises shall be made in form abovesaid, fro time to time shall haue full power& authority during the said two yeres, to direct their precept or precepts unto the said person or persons charged with any somme, of for& vpon any such person or persons, or other, as is abovesaid, or to any sheriff stuarde bailiff, or other whatsoever officer minister person or persons of such place or places where any such person or persons, so owing such somme or sums, shall haue lands or tenememtes or other hereditaments, or real possessions goods or catals, whereby any such person or persons so indebted, his heires executours or assigns, or other having the custody governance or disposition of any goods catals lands or tenements, which ought or may by this act leefully be distrained or taken from the same, haue or shall haue goods catals lands tenememtes or other possessions, whereof such somme or sums which by any person or persons, may or ought to be levied, be it within the lymytte of such commission, where such person or persons was or were taxed or without, in any place within this realm of england, by which precept as well such person or persons as shall be charged to leuye such money as the officers of the place or places, where such distress may be taken, shall haue full power and authority to distrain every such person indebted charged or chargeable by this act, or his executours or administrators of his goods& cattals his gardiennes factors deputies lessees or farmers and assigns:& all other persons, by whose hands, or out of whose lands any such person should haue rent fee annuity, or any other profit, or which at the time of the said assessynges shall haue goods& cattals, or any other movable of any such person or persons being indebted or owing such somme,& the distresses so taken cause to be kept apprized and sold, in like maner and form as is before said, for the distresses to be taken vpon persons to be taxed to the said subsidy, and being sufficient to distrain within the limits of the collectors inhabitants or other officers charged with and for the same sums so upon them to be taxed. And yf any such distress for none payemente happen to be taken out of the lymytte of the personnes charged and assigned to leuye the same, the person so charged for the leuye of every such somme, by distress, shall perceive and take of the same distress, for the labour of every person, going for the execution thereof, for every mile that any such person so laboureth for the same two pence, and every farmer, tenant, gardien factor, or other what so ever person distrayneth or oterwyse charged for payment of any such somme or sums, or any other sum, by reason of this act, shall be of such somme or sums of him or them so levied or taken, discharged and acquitted at his next day of payemente of the same, or at the delivery of such goods and cattalles, as he that is so distrained had in his custody or governance, against him or them that shall be so taxed and set, any grant or wryttinge obligatory, or other what so ever matter to the contrary made heretofore not withstanding. ¶ And yf such person, that should be so dystrayned, haue no lands nor tenements sufficient, whereby he or his tenants and farmers may be dystrayned, or haue eloyned alyened or hid his goods and cattalles whereby he should or might be distrained, in such maner that such goods and cattalles shall not be known nor found, so that the sum of or by him to be paid in the said form, shall ne can be conveniently levied, than upon relation therof unto two of the commissioners, where such person or personnes was taxed and set, by the oaths of him or them that shall be so charged with the leuye and payment of that sum or sums, the said commissioners shall make a precept in such maner as is beforesaid, for to attach take and arreste the body of such person or persons, that ought to pay the said sums, and by this act shall be charged with and for the same sum or sums, and them so taken saufely to keep in prison within the shire or other places, where any such person or persons shal be taken or attached, there to remain without bail or main prise unto he haue paid the sum or sums, that such person or persons for himself, or for any other by this act ought to be charged with, and also for the fees of every such arreste to him or them that shall execute such precept. xx.d. And that every officer, unto whom such precept shalbe directed, do his true diligence to execute the same vpon every person, so being indebted, vpon pain to forfeit to our said common lord the king for every default in that behalf. xx.s. And that no keeper of any gaole, from his gaole suffer any such person to go at large by letting to bail or otherwise to depart out of prison, before he haue paid his said debt, and the said. xx.d. for the said arrest, vpon pain to forfeit to our said sovereign lord. xl.s. And the same jailer to pay unto our said common lord the double sum as well of the rate, at which the said person so enprisoned was taxed at, as of the said. xx.d. for the fees, and like process& remedy in like form shalbe granted by every two commissioners, at like information of every person or {per}sons, being charged with any somme of money for any other person or persons by reason of the said subsidy, every of the said two yeres,& not therof paid, but wilfully withdrawn, ne the same leuiable within the limit, where such {per}son was thereunto taxed. And yf the somme or sums being behind unpaid by any {per}son or {per}sons, as is before said, be levied and gathered by force of the said process to be made by the said two commissioners, or yf in default, or for lack of payment thereof, the person or persons, so owing the said somme or sums of money, by process of the same commissioners to be made, as is before said, be committed to prison, in form above remembered, than the said two commissioners, which shal award such process, shal make certificat in the said exchequer of that that shall be done in the premisses in the term next following, after such sum or sums of money so behind shal be levied& gathered, or such person or persons for none payment of the same committed to prison. And yf it happen any of the said collectors so to be assigned, or any mayor, sheriff, stuarde, constable, the head boroughs, householder, bailiff, or any other officer or minister, or other what so ever person or persons, to disobey the said commissioners or any of them, in the reasonable request to them made by the said commissioners for the yearly execution of their said commission, during the said two yeres: or yf any of the officers or other persons do refuse that to them shal appertain or belong to do, by reason of any precept to him or them to be directed, or any reasonable commandment instance or request touching the premises, or other default in any appearance, or collection to make: or yf any person being suspect as is aforesaid, do refuse to be examined, according to this act; approved by examination before the said commissioners, or two of them, or will not appear before the same commissioners, vpon warning to him made, or else make resistance or rescue vpon any distress vpon him to be taken, for any parcel of the said subsidy, or commit any mysbehauoure in any maner of wise contrary to this act, or commit any wilful omission, or other what so ever wilful none doing or misdoinge contrary to the tenor of this act or grant, the said commissioners& every nombre of them unto two of them at the leste, upon probable knowledge of any such mysdemeanours had by information or examination do set vpon every such offender for every such offence in name of five by the same offender to be forfeited. xx.s. or under, by the discretion of the said commissioners. And further the said commissioners and every nombre of them, unto two of them at the leste, haue authority by this present parliament, to punish every such offeder by enprisonment, there to remain and to be delivered by their discretion, as shall seem to them convenient the said fines, yf any such be, to be certified by the said commissioners, that so assessed the same, into the said kings Eschequire, there to be levied and paid by the collectors of that parties for the said subsidy, returned into the said exchequer, to be therewith charged with the payment of the said subsidy, in such maner as yf the said fines had ben set and taxed vpon the said offenders for the said subsidy. ¶ It is also enacted by the said authority of this present parliament, that every of the said high collectors, which shall account for any part of the said subsidy in the kings exchequer, vpon their several said accounts to be yelden, shall be allowed yearly during the said two yeres for every pound limited to his collection, whereof any such collector shalbe charged and yield account .vi. d. as parcel of their said charge, that is to say .ii. d. therof for such persons as then haue had the particular collection in the towns and other places, as is aforesaid, specified in his collection, and other ii. d. therof every of the same chief collectors there accountant to receive to their own use, for their labour and charge in and about the premisses and. ii.d. residue to be delivered and paid by the said collectors so being therof allowed, to such of the commissioners, as shall take vpon them the business& labour for and about the premises, that is to say, every collector to pay that commissioner or commissioners, which had the ordering and writings for the said subsidy, where the said collector or collectors had their collection, for expense of the said commissioners, so taking vpon them the said business and labour of their clerkes writing the said precepts and estretes for the said collections: the same last. ii.d. to be divided among the said commissioners, having regard to the labour and business taken by them, and their said clerkes in and about the premisses, for which part so to the said commissioners attaynynge, the said commissioners .vi. v. iiii. iii. or .ii. and every of them iontlye and severally for his or their said part, may haue his remedy against the said collector or collectors, which therof be or might haue ben allowed by action of debt, in which the defendant shal not wage his lawe, neither protection nor essoing to be allowed. And that no person now being of the number of the company of this present parliament, nor any commissioner shall be name or assigned to be any collector subcollectour or presenter of the said subsidy, or of any part therof, nor no commissioner shall be compelled to make any presentment or certificat, other then in to the kings exchequer, of for or concerning the said subsidy or any part therof, in any of the said two yeres. And likewise that none other person, that shall be name or assigned to be commissioner in any place, to& for the execution of this act of subsidy, in any of the said two yeres, be or shalbe assigned or name head collector in any of the said two yeres of the said subsidy, neither of any parte therof. And that every such person or persons which shalbe name and appoynted as is before said to be head collectors, in and for one of the said two yeres, shall not be compelled to be collector in the second year of the same two yeres. And the said collectors which shall be assigned and name for the said subsidies, or for any parte thereof, and every of them, be& shalbe acquitted and discharged of all maner of fees rewards, and of every other charge in the kings exchequer or else where of them, or any of them, by reason of that collection payment or accounts, or any thing concerning the same to be asked. And after the taxyng and assessing of the said yearly subsidy, as is before said, had and made, and the said estretes therof in parchment unto the said collectors in maner and form before rehearsed delivered, the said commissioners, which shall take vpon them thexecution of this act within the limits of their commission, by their agreement, shall haue metinges together, at which metinge every of the said commissioners, which then shall haue taken vpon them the execution of any parte of the said commission, shal by himself or his sufficient deputy, truly certify and bring forth unto the other commissioners, name in the same commission, the certificat and presentement made afore him and such other commissioners as were limited with him in one limit, so that the same certificates may be accounted and cast with the other certyfycates of the other limits within the same commission. And than the said commissioners and every nombre of them unto two at the leste, yf they be in life, or their executors or administrators of their goods, yf they be than dead, shall iontlye& severally as they were divided within their limits, under their seals yearly during the said two yeares, by their discrecions make one or several writings indented, containing in it as well the names of the said collectors, by the said commissioners for such collection and account in the exchequire and payment in the said receipt deputed or assigned, as the gross and several sums written unto every such collector to receive the said subsidy, and also all fines amerciaments and other forfaytures, yf any such by reason of this act happen to be within the precinct and limit of their commission, to be certified into the kings exchequire by the said commissioners yearly during the said .ii. yeres, by the said .xvi. day of Nouembre: In which writing or writings indented, so to be certified, shal be plainly declared and expressed, as well the hole& entire somme and sums of the said subsidy severally limited to the collection of the said collectors, as the names of the said collectors severally deputed and assigned to the collection of the said sums, so that none of the said collectors so certified in the said exchequire, shall be compelled there to account or to be charged but onely to and for the somme limited to his collection, and not to or for any somme limited to the collection of his fellows, but that every of thē shal be severally charged for their partes limited to their collection. And yf the said commissioners joined in one commission, among themselves in that matter can not agree, or yf any of them be not redy or refuse to make certificat with tother of the same commissioners, that than the same commissioners may make several indentures in form afore said, of their several limits or separations of collectors, within the limits of their commission vpon and in the handmaides wards wapentakes laths rapes tithinges or such like divisions within their said several limits of their said commission as the places there shall require to be severed and divided, and as to the same commissioners shall seem to make their divisions of their limits or collections for the several charges of the collectors, so that alway one collector shall be charged, and account for his parte to him to be limited onely by himself, and not for any some limited to the parte of any of his fellows, and the charge of every of the same collectors to be set and certified severally vpon them, and every such collector vpon his accompty and payment of the sums of money, limited within his collection, to be severally by himself acquitted and discharged in the said exchequire, and not to be charged for any portion of any other collectors. And yf any commissioners after he hath taken certificates of them that( as is afore said) shall before any such commissioner be examined, and the sums ranted and set, and the books and writings therof being in his hands, or yf any collector or other person charged with any receyt of any parte of any of the said subsidy, or any other person taxed or otherwise by this act charged with& for any parcels of the said subsidy, or with any other sums or fine amerciament penalty or other forfeiture, happen to die before such commissioner collector, or other what so ever person or persons haue executed accomplished satisfied or sufficiently discharged it, that to every such person shall appertain or belong to do, according to this act, then the said executours and heirs of every such person,& all other seized of any lands or tenememtes, that any such person being charged by this act,& decessing before he be discharged therof, or any other to his use onely had of estate of inheritance, at the time that such person was name commissioner collector, or in any otherwise charged with& for any manner of thing to be done satisfied or paid by reason of this act,& all those that haue in their possessions or hands any goods or cattalles, that were to any such person at the time of his death, or lands or tenements that were the same persons at the time that he was, as is afore said, charged by this act, shall be by the same charged to do& accomplysh in every case, as the same person so being charged should haue done, and might haue been compelled to do, if he had ben in plain life, after such rate of the lands& goods of the said commissioner or collector as the party shall haue in his hands. And yf the same commissioners for causes reasonable them moving shall think not convenient to join in one certificat, as is before said, then the said person or persons that shall first join together, or he that shall first sole certify the said writings indented as is afore said, shall certify the names of all the commissioners of that commission, whereupon such writing shal be there then to be certified with the divisions of the handmaides, wapentakes wards tithynges or other place to and among such commissioners of the same commission, with the names of the same commissioners, where such separations or division shall be, with the gross sums of money, as well of and for the said subsidy taxed or set of or within the said handmaides wards wapentakes, or other places to him or them divided or assigned, that shall so certify the said first writing, as of fines amerciaments penalities and other forfaytures, yf any happen to be within the same limits, where of the said writing shall be so certified, and after such one writing indented, which( as is aforesaid) shall be certified, and not contain in it the hole and full sums set and taxed within the limits of the same commission: the other commissioners of the same, every of the said .ii. yeres, at the said xvi. day of Nouembre yearly, or within .iiii. dayes then next immediately following, shall certify in to the said exchequer by their writing or writings indented to be made, as is afore said, the gross sums set& taxed within the places to them limited for the said subsidy, and other fines amerciaments penalities& forfaytures, with the names of the handmaides wards wapentakes and other places to them assigned, or else by the said writing indented to certify at the said place, by the said .xvi. day of Nouembre, or within .iiii. dayes next following, reasonable causes for their excuses, why they may not make such certificat, of and for the said subsidy, with fines amerciaments penalities and other forfaytures grown or set by reason of the causes of their lets, or of their non certifieng as is abovesaid, or elles in default therof process to be made out of the kings exchequer against the said commissioners and every of them, not making certificat as is afore said, by the discretion of the barones of the said exchequer. ¶ And be it enacted by the king our common lord, by the assent of the lords spiritual and temporal, and the commons in this present parliament assembled, and by the authority of the same, that as well all such persons as shall haue any collection or receipt of the said subsidy, or any part therof, at the receiptes of the king our sovereign lord of his exchequer, or else where in any other place or places within this realm of England, as all other the kings subiectes, shall at all& every time hereafter from hence forth, and from the feast of the purification of our Lady next ensuing, by the space of one hole year then next following, take and not refuse in any payment any ducats, corownes, crusades, or any other gold coined in the parties beyond the see, bearing their true weight according to such value as was limited by the last proclamation therof made the .xxvii. day of March, in the .xxx. year of the reign of our said sovereign lord the king. And yf any person hereafter that shall haue the receipt, or any collection of the said subsidy or any part therof, to the use of our said sovereign lord the king, at the receipt of his exchequer, or else where in any shire, riddyng, city, town, or other place, do refuse or deny to take in payment of the said subsidy, or any parte or parcel therof, gold, groats, half groats, or pennies, or any of thē, yf any refusal of any such golds groats half groats or pennies, or any of them be had in the said receipt or else where, contrary to the proclamation therof made as is afore said, and that proved by witness, information, or examination, or otherwise, before the kings iustices of either bench, or before the barons of his exchequer, or any of them: or yf such refusal of any such golds groats half groats or pennies, or of any of them be had by any collector or other person having the gathering of the said subsidy, or any parte therof in any shire rydding city town or other place,& that the refusal as is afore said, be proved by witness, information, examination, or otherwise, before any iustices of peace sheriff mayor bailiff or other head officer of that shire riddyng city town or other place, where such refusal is had: then the person or persons that so offered and tended the said golds groats half groats or pennies, or any of them, that shall be so refused, shall be of that somme so tended and refused, quite& discharged by this act against our common lord the king, and the other person or persons that refused the same, in like maner as yf he had paid the same golds groats half groats or pennies, or any of them so refused in dede, without any bill tayll or other discharge therof to be had or shewed, and the said receyuour collector or other person, that shall refuse the said golds groats half groats or pennies or any of them, shal be charged with the sum so by him refused, to and against our said sovereign lord, in like form as yf he had received the same somme in dede. And that all and every other person and persons shall receive and take the said golds groats half groats, pennies, or any of them, after the rates and value before rehearsed,& as the said golds groats half groats and pennies, or any of them be coined for and now currant, as well of and by the officers of our said sovereign lord, as of every other person or persons in all receiptes and payments from hence forth to be made or had, vpon pain of imprisonment of every person refusing such golds groats half groats or pennies, or any of them, or otherwise to be punished by the discretion of the iustices of peace mayres sheryffes bailiffs, or other head officers of every shire city borough or town within this realm. ¶ And be it further enacted by the authority aforesaid, that every alien and stranger born out of the kings obeisance, inhabitynge within this realm, which at the time of the said first assessing to be made, shall be of the age of .xii. yeres, or above, not having goods or cattalles to the said value of. xx.s. shall pay .iiii. d. to be assessed by the said assessors,& by them to be certified unto the said commissioners and to be streated in to the exchequer, and to the said collectors by the said commissioners to be delivered, and the same to be collected and gathered by the said collectors, in every shire city borough town and other place, in such maner and form, to every purpose and intent, as afore is limited and decla-clared for the subsidy above said, and the same four pence to be paid in the kings exchequer, to the kings use, afore the .viii. day of february next coming. And that every person and persons, with whom such alien or stranger shall happen to be dwelling at the time of the assessing and taxation of the same within this realm, shalbe charged and chargeable to the payment of the said. iiii.d. ¶ And it is also enacted by the authority aforesaid, that every such person so to be name collector, for any of the said .xv. and .x. shall haue lands tenements or other hereditaments of an estate of inheritance of the clear yearly value of .x. li. or above, or elles in coin plate household stuff, merchandise or other substance to the value of an. C. marks, to his own use and behove, or above. And yf it shall so happen, that there shalbe no such person, of the said yearly value of lands, or of the said value of goods, as afore is said, within any such shire city borough or town, where such collector or collectors haue ben used to be name: than the said knights of the shires cytizens of cities, and burgesses of boroughs and towns where that shall so happen, shall name and appoint for the said collection, of every of the said hole .xv. and .x. such persons and persons as be and shall be of the best and most value in lands or goods, at the time of the nomination of the said collector and collectors within any such shire city borough or town, whereby the kings majesty shall and may be the better answered and paid in his said receit. ¶ provided always, that this act of subsidy, ne any clause or article therein contained, do extend to charge the goods of any orphante or orphantes born under the kings obeisance, in any other maner and form, then as the goods and substance of every other person born under the kings obeisance, be chargeable unto this act of subsidy: this act of subsidy, or any article therein contained, to the contrary not withstanding. ¶ provided also that this grant of subsidy, nor any other thing therein contained, do in any wise extend to charge the inhabitants and dwellers within ireland, Wales, Calyce, hams, Guysnes, and the marches of the same, jernesey and Garnesey, or any of them, of for or concerning any manors lands tenements, or other possessions, goods, cattelles, or other movable substance, which the said inhabitants or dwellers, or any other to their use haue within Irelan, Wales, Calyce, hams, Guysnes, or other marches of the same, jernesey and Garnesey, or in any of them, of for any concerning any fees or wages, which any of the said inhabitants or dwellers haue of our sovereign lord the king, for their attendance and doing service to out said sovereign lord in ireland, Wales, Calyce, hams, Guysnes,& the marches of the same, Garnesey and jernesey, or in any of them: any thing in this present act to the contrary not withstanding. ¶ provided also that the said grant of subsidy, in form afore said, to be taxed and levied, nor the said subsidy nor any part therof, in any maner of wise extended or be prejudicial or hurtful to the inhabitants or resiants at this present time within the .v. ports corporate or united to the same .v. ports, or to any of the same .v. ports, of or for any part or parcel of the said sums granted in this present parliament, of the said inhabitants now resiants, or any of them to be taxed set asked levied or paid, but that the said inhabitants& now resiantes of the said .v. ports and their membres,& every of them, be& shalbe of& from the said grant and payment of the said subsidy, and of& from every parte& parcel of the same acquitted& discharged: any matter or what so ever other thing in this present act made or had to the contrary not withstanding. ¶ provided also that this present act of subsidy, ne any other thing therein comprised, extend to any of the english inhabitants or resiantes in any of the Counties of Northumberland, Cumberland, Westmerland the town of berwick, and the byshoprycke of Durram, nor to any of thē, of to or for the said taxynge leuyeng gathering or payment: but that the english inhabitants of the said counties byshoprycke town and every of them, shall be of and from the said subsidy, and of every parcel therof utterly acquitted and discharged: any thing in this present act before rehearsed to the contrary not withstanding. ¶ provided that all letters patents granted by the kings highness, or any of his most noble progenitors, to any cities, boroughs, or towns within this realm, of any maner liberties pryuiledges or exemptions from the burden and charge of any such grants of . XV. X. and Subsydyes, which be at this present time in force and vaylable, shall remain good and effectual to the said cities borowghes and towns here after, according to the purportes thereof, though the inhabitants of the same, shall vpon the great and weighty considerations of the kings majesties great and inestymable charges before expressed, be for this grant charged and contrybutorye in like maner and sort, as all other cities, borowghes, and towns, which be not in any wise so pryuyleged, or from such grants of .
