WHereas by Act of Common council made the 22th day of October in the time of the mayoralty of St Thomas low K ●, the Rule, The recital of ●h ●●t m●i●. ●n S●. T●●●as Low's mayoralty. Oversight and Government of the cars, Carts, Carters and Carmen, and of all other person or persons whatsoever working any cars or Carts within this City and Liberties, is committed to the Master, Wardens and Fellowship of Woodmongers London; And Provisions therein made( amongst other things) for the translation of all Carmen and other Persons that shall keep, use or work any car or cars, Cart or Carts within the said City and Liberties( and that then were or should thereafter be free of any other Company of this City) to the said Company of Woodmongers: The 〈◇〉 th● A●t m●●● t●● 〈…〉 of 〈◇〉 1654 And whereas by an other Act of Common council made the second day of August 1654 the number of cars of all sorts t● work within the said City and Liberties is limited to four Hundred and twenty, whereof two Hundred and eighty to be Street cars, and one Hundred and forty to be Wharfe-Carres, or for Wh●rfingers to carry abroad fuel from the●r Wharfes, and divers Rules, Directions, Provisions and Penalties thereby given, made and set down touching the licensing of Carmen and the better regulation of them, and sundry other matters: And the Master, Wardens and Assistants of the said Company of Woodmongers by the same Act impowred for licensing and allowing of the said Carmen, and to several other purposes, as in and by the said several Acts more fully may appear: Th●●●v●●●●l c●● i 〈◇〉 ●ari●t th●●●o●m●ngers. And for as much as Complaint hath been made as well by divers Citizens as by the Carmen, against the said Woodmongers, of sundry abuses committed in their said Government of the Carmen, and of many Inconveniences and grievances brought upon the people and Inhabitants of this City by the said Company, by means and pretence of the privilege and power granted them in and by the said several Acts of Common council. Be it therefore enacted, The repealing of the first of th● afo●●●●id Acts. granted and agreed by the Right honourable the Lord Mayor, the Aldermen his brethren, and the Commons in this Common council assembled and by the authority of the same; That the first of the said Acts before mentioned made in the time of the mayoralty of St Thomas low, and every Clause, Article and thing therein contained, Th●●e●●ing ●f 〈◇〉 much 〈◇〉 other Acts 〈…〉 p●●er 〈◇〉 Woo●m●●ngers to dipo●● or licence C●t●s or C●●men. and so much of the latter of the said two Acts of Common council as confers any trust or power to or upon the Woodmongers, in or about the disposing or licensing of cars or Carmen, or the regulating or ordering of the said cars or Carmen, or otherwise Interessing them in any matter or thing touching or concerning the said cars or Carrmen, and so far forth only as concerns the said Woodmongers, and also that concerns the admittance or allowance of one Hundred and forty cars to be Wharfe-Carrs, or for the use of Wharfingers, and all other Acts and Orders touching or concerning any the said matters or things, or in any other wise contrary or repugnant to any clause or matter hereafter in this present Act declared, appointed or contained, shall from hence forth be utterly repealed and made voided to all intents and purposes; The investing the government in the Presid●n● and G●vernours for th● Po●● of th● city of L●●d●n, &c. And that the Presiden and Governours for the poor of the City of London and the Liberties thereof shall from time to time hereafter have the rule, oversight and Government of the said cars, Carts, Carters and Carmen, and of all other person and persons whatsoever, working any cars or Carts within the City of London and liberties thereof during the pleasure of this Court and no longer, The extension and continuation of their power. and that in as large and ample manner as the said Company of Woodmongers have lawfully had and enjoyed, and as the said Woodmongers were appointed, limited and directed to do in and by the said last mentioned Act of Common council of the second day of August 1654. or any other Act of Common council, and according to the rules, directions and provisions in the same Acts or any of them mentioned and Comprised, which are therefore to abide and continue in full force and virtue to all other intents and purposes save only as to the authorizing or allowance of wharf cars and of the Woodmongers to intermeddle in the Government of the said cars or Carmen or otherwise touching the same, 〈◇〉 W●●●m●n●●●s a●● 〈…〉 ●g ●n 〈◇〉 ●●●n●●●● which so far forth and to those only purposes is repealed and made voided as aforesaid. 〈…〉 Also, It is enacted that there shall not hereafter be any car, Cart or cars, permitted or allowed to any wharf, wharfinger, or Woodmonger, or kept or worked by any wharfinger, or Woodmonger, after the first day of August next, but that the whole number of 420 cars to be licenced as aforesaid, A ●th● Ca●●s 〈…〉 to 〈◇〉 S●●●● Car●s and to carry a●●●●●s of 〈◇〉 shall be Street cars, and granted to Street Carmen only, and no other cars used or allowed to work within this City and liberties thereof, but that the carriage of all Wood, coals, and other fuel within the same City and liberties, shall be done and performed at such rates, and in all other respects, as other goods, and Commodities have used and ought to be carried, by the Street Carmen only and not otherwise, except such persons who do sand their own or other Carts out of the country to bring coals from wharfes, and also all persons who shall bring his own coals home to his house in London with his own Carts, not being traders in fuel. And if any wharfinger, Woodmonger, or other, shall presume to keep and work any Carr, Cart, or cars, contrary to the true meaning hereof, such person and persons, for every time so offending shall forfeit and pay for the first offence the sum of 40 shillings, to be recovered and obtained, Th● p●●●bles f r W●●●fing s and W o●m●nge●s off●●●ing. as is hereafter mentioned, and for the second and every other offence afterward, the said car, or cars, to be seized and carried to the new Store-yard on More-ditch and there kept and detained according to the custom of London. And for the better prevention of such deceit hereafter as divers Woodmongers have practised in the sale and measure of their coals, It is enacted that the twelve Seacoale-meaters of this City, The 〈◇〉 provid● S●●●●s ●o carry Co●●●s in. shall provide and keep in readiness a sufficient number of sacks of the just and full size and measure, and that all Seacoales hereafter to be sold by any Woodmonger, or others, shall be filled and brought home to the buyer in the said Seacoale-meaters sacks, and by some Street Carr, or cars of persons duly licenced and allowed as aforesaid, and bearing upon the said cars the mark of the Redcross for a note of their allowance as hath anciently been accustomend; The Redc●o s to be upon ●ver● Carr allowed. And further, that there shall be provided and kept by and at the charge of the Parishioners and Inhabitants of every Parish of this City and liberties, one or more sealed bushel or bushels( according as every Parish shall be greater or lesser) to remain in the hands of some fit person or persons, A sealed bushel to be kept by every Parish. to be therefore appointed in every Parish respectively, and sworn in the outer Court before the Lord mayor and Aldermen of this City, for the time being, who from time to time upon request of any such Parishioner or Inhabitant shall attend with one of the same bushels to measure or essay and make trial of the measure of any coals bought or brought home by or for any such Inhabitant or Parishioner, as aforesaid: And if any person or persons, shall bring home in his or their Cart, or Carr, to any buyer, any coals in any other Sack, or Sacks, then in the Sack, or Sacks, of the said common meaters of Seacoales to be therefore provided and kept as aforesaid, such person so offending shall forfeit and pay ten shillings for the first and second offence respectively, and for the third and every other offence, the Carr or cars of the offender to be seized and carried to the new Store-yard on More-ditch as aforesaid. And, Penalti●s how to be recovered It is enacted, that all pains penalties and forfeitures aforesaid, shall and may be recovered by action of debt, bill or information in the name of the Chamberleine of this City for the time being in the Court holden before the mayor and Aldermen of the said City in the Chamber of the Guild-Hall and after recovery thereof one moiety( after all charges deducted) shall be to the Informer, and the other moiety to the poor of Christ hospital in London to be employed for and towards their relief, in all which suits to be brought by this Act the Chamberleine shall recover his ordinary costs and charges to be expended in and for recovery of all such forfeitures against the offender and offenders. And lastly, whereas there hath been allowed out of the rent of cars the sum of one hundred and fifty pounds per annum, to be paid to the Governors of Christ hospital, toward relief of the poor there harboured: All●w●nce to Ch●●st hospital as anciently. It is enacted, that the same shall be from hence forth duly satisfied and paid yearly by the said President and Governors for the poor of the said City of London and liberties thereof, from midsummer last past during so long time as they shall have and continue the oversight, rule, government and benefit of the said cars, and Carmen, according to former directions and provisions in this behalf by former Act, or Acts Provided always that upon defect of payment of the said one hundred and fifty pounds, within ten dayes after every year, that then this present Act and every clause therein contained( as to the Government of the cars by the said President and Governors) be from thenceforth made null and voided. Power to the Presi ●nt and Governors for the poor, &c. To execute the or●ers made, &c. An● to make further orders. &c. And Be it further enacted by the authority aforesaid, that the said President and Governors for the poor of the said City of London and liberties thereof, shall have power and authority from time to time to execute such orders as are already made by the Lord mayor and Court of Aldermen, for the rule and Government of cars and Carmen, and to contrive, make and execute such further orders as shall be thought fit and requisite by them for that purpose being approved and allowed by this Court from time to time. saddler.
