And also that all such Persons whose names( in the Catalogue of Justices of the Peace) are marked with the letter[ m] are by Act of Parliament dated the 12th. of March Ann. Dom. 1659. appointed also to be Commissioners of the Militia, in the several Counties, Cities, towns, and Places where they are so marked, the rest of the Commissioners of the Militia in that Act, name( who are not in the Commission of the Peace) are placed together at the end of every such Catalogue of Justices of each County The Copy of the Commissions, delivered to the Officers of the Militia by the Council of State. Myms James Medlicot An Abridgement of the Act for settling the Militia within England and Wales Monday, March the 12th. 1659. Ordered by the Parliament that this Act be forthwith Printed and Published. BEe it Enacted by this present Parliament, and it is hereby Declared, that an Act of Parliament bearing date the six & twentieth day of July 1659. and all other Acts and Orders concerning the Misitia of the respective Counties in England and Wales, and the Powers and Commissions thereby given and granted, and all Men, Money, Horses, or Arms levied by virtue thereof, do from henceforth cease and determine, and are hereby vacated and made voided And it is hereby further Enacted that the Persons hereafter mentioned, shall be, and are hereby appointed Commissioners of the Militia in the respective Counties in England and Wales, and Town of Barwick upon Tweed. The Commissioners are most of them taken out of the List of the Justices of the Peace in each several County, and are marked in that List with the Letter( m) and such others of the Commissioners of the Militia as are not in the Catalogue of the Justices, are added and expressed at the end of every such List of Justices in each several County, City, and Town; So that all the Commissioners of the Militia are herein before fully name. Which said Commissioners, or any five or more of them in the several places where they are name Commissioners, have power to meet together, and to call before them all such persons as are fit and meet to bear Arms, and to cause them to be sufficiently Armed, Arrayed, and Weaponed, and to put them into Regiments, Troops, and Companies, and to conduct or cause them to be conducted into any place or places as well within, as out of such County, according to such directions as they shall receive from the Parliament, or Council of Stare, for suppressing of all Insurrections or Invasions; And shall have power to present to the Council of State for their approbation, the names of such persons( observing the qualifications therein mentioned) as they shall think fit to be Collonells, lieutenant, colonels Majors, Captains, and other Commission Officers of such Forces so to be raised, which Officers being so approved, shall have Commissions signed by the Council of State, or any 9 or more of them, and thereby have power to train and conduct all such persons so to be armed, according to the directions and to the intents and purposes aforesaid. And for the providing Horses, Arms and other necessaries for the arming and weaponing of such Forces, and for defraying incident charges, It is further Enacted that the said Commissioners or any five or more of them within their several Jurisdictions, have hereby full power and authority to charge any person with horse and arms in the same County or place where his, her, or their estates lie, provided, no person be charged with a horse & arms, unless he or she have five hundred pounds yearly revenue, or an estate of six thousand pounds in goods, money, or other estate equivalent thereunto, and so proportionably as the said Commissioners shall think fit, nor any person charged to find a foot soldier and arms, unless he have a personal estate of five hundred pounds, or a yearly revenue of forty pounds, and so proportionably for a greater or lesser revenue or estate, it shall be lawful for the Commissioners or any five or more of them, to join two three or more persons together in the charge for providing of horse and arms as aforesaid as shall appear to them to be most beneficial for the service of the Nation. Provided, that no person who hath not 100 l. a year in Lands Tenements or Hereditaments Leasehold or Coppyhold, shall be compelled to contribute towards finding a horse with arms, and that no person who hath not fifteen pounds a year, in Lands Tenements &c. or a personal estate worth 200 l. shall not be compellable to con●ribute in finding a Foot arms as aforesaid; And the said Commissioners or any five or more of them have power to examine complaints, and upon oath( which they have power to administer) to give redress as there shall be cause. And be it further Enacted that the said Commissioners or any five or more of them, in their respective Counties and places, shall direct and req●ire all pe●sons so charged as aforesaid to allow 2 s. per diem to such horsemen; and 1 s. per diem to every such foot soldier for every day they shall be absent by occasion of muster or exercise; And for the furnishing such forces with Drums, Colours, Ammunition, and other emergencies, the said Commissioners, or any five or more of them,( whereof none to be a Commission Officer) shall h●ve power to impose a rate upon their several Coun●ies, not to exceed in the whole one month ass●●●m●nt, at the rate of 35000 l. per month; which moneys are to be assessed, collected and paid a● the Parliament or Co●ncil of State shall from time to time direct unto such Collectors and Treasurers as the said Commissioners shall appoint, under such pena●ties, and by such ways and means, as in the Act for 35000 l. per mensem are prescribed: And in ●●se there shal be any sudden occasion to 〈◇〉 out s●●h Souldiers into actual Service, the per 〈…〉 so ch●rged, as aforesaid, are to furnish their men 〈◇〉 ●ay in hand, not exceeding one months pay, as 〈…〉 ll and by the Commissioners, or any five, or more 〈◇〉 them directed for re-payment whereof, & for satisfaction of such Officers as shall be with their Souldiers in such said actual service, not exceeding one month, as aforesaid, the Parliament doth hereby declare, the same shall be paid out of the public Treasury, and if they shall be continued longer in actual service, the like course shall be taken for the payment of such Officers and Souldiers, as is for the established Army. And be it further enacted, That the said Commissioners, or any five, ot more of them, upon the marching of any such forces,( allowing 6 pence a mile outward only) may charge Carts, Wag●ons, and Horses, for the carrying of Powder, Bullets, and other materials, and may imprison Muttineers and disordered persons, or such as shall neglect their duties at dayes of training or Mustering, and if drawn upon actual service, to be subject during that time, to such rules and orders as are mentioned in the general instructions for regulation of the Army. And be it further enacted, that such persons as shall refuse or neglect( by the time appointed by the said Commissioners) to provide such Horse, Horses, Arms, or other furniture, o● to pay su●h Sum or Sums of Money towards the providing and furnishing as aforesaid, that then the said Commissioners may inflict a penalty upon such persons not exceeding 20 l. and also by Warrant commit such persons to prison, there to remain without Bail or Mainprize, until they shall comform thereunto, and pay such penalty, or else by like Warrant, to levy the value of such Horses, Arms, or Furniture, and such penalties so inflicted by s●le of the Goods of such Refusers or Neglecters, rendering the overplus to the party distrained( all charges first deducted.) And be it further enacted, that if any person imbezel the Horse, Arms, or Furniture, wherewith he is entrusted, the said Commissioners may imprison such persons till they make satisfaction; and if any person shall not appear complearly furnished with the Horse, Arms, and other Furniture, wherewith he is entrusted, at the beat of Drum, sound of Trumpet, or other Summons, that then, and so often, the said Commissioners( if the default be in such person or persons so entrusted) nay imprison such person five dayes without Bail or Mainprize, or inflict the penalty, if a Horseman, not exceeding 20 s. and if a Footman, not exceeding 10 s. to be paid down without delay; And if any person so charged as aforesaid, shall upon such Summons refuse to deliver his Horse, Arms, or other furniture, the Commissioners may inflict the penalty of 5 l. upon such Refuser, to be levied by sale of his Goods; And the said Commissioners or any three of them, may examine any person upon O●th, touching the ability of such persons so to be charged and assessed, and of all misdemeanours tending to the hindrance of the service aforesaid. And for the more speedy execution hereof; Be it further enacted, that the said Commissioners may as often as they shall think fit appoint general meetings, and at such meetings appoint one or more Treasurer or Treasurers, Check or Checks, for the receiving and paying of all such moneys as by virtue hereof shall be levied, of all which receipts and disbursements, the said Treasurers and Receivers, Check or Checks, are every six months to give their accounts in writing to the Parliament if then Sitting, and in the intervals to the Council of State, or whom they shall appoint to receive them. And be it further enacted, that any five or more of the said Commissioners, may Summon all and every such person or persons who are possessed of any Sum or Sums of money, Horses, Arms, or Ammunition, relating to the said Militia, and so require them to give a just account thereof upon Oath, and to pay and deliver all such Sums of money, Horses, &c. remaining in their hands, to such persons as the Commissioners hereby appointed, or any five or more of them shall appoint, and in case of non-payment, to levy the same by distress and sale as aforesaid, and for want of distress, to imprison their persons till they comform; All which moneys so to be levied and received, are to be employed for carrying on the said service, and at such general meetings, the said Commissioners are to divide themselves into such numbers and divisions, as may be most expeditious for the service. And for the better securing of the peace of the Nation, the said Commissioners or any five or more of them, may by Warrant under their Hands and Seals employ such persons as they shall think fit, of which the Constable or his Deputy within their precinct to be one, in the day time to search for, and seize all Arms in the custody of any Popish Recusant that hath been in Arms against the Parliament, or any other whom the Commi●sioners shall Judge dangerous to the Peace of the Nation, and to secure such Arms for the use of the Commonwealth, or with them to Arm such well-affected persons as they shall think fit, and the persons so employed may enter into the House or Lodging of any such person and there seize and take away what Arms they shall find, and to give an account thereof to the said Commissioners. And all high Constables, Petty Constables, and other Officers, are to be aiding and assisting to the said ●ommissioners in the Execution of the premises, and for so doing, shall be saved harmless by Authority of Parliament. And be it further enacted, that where any person shall be charged to find a Horse, Horses, and Arms in such County, City, or Place where he doth not reside; That then the Commissioners shall sand notice of such charge to the Servant of such person there residing, or in case he have no such Servant there, then to the Tenant or Tenants of such person so charged, who are required to Convey the same with all speed to their Master or Landlord respectively, and within such time as the Commissioners shall appoint, bring an account of their Master or Landlords answer to the said Commissioners; And if the Landlord shall refuse or neglect to provide what he is so charged with, that then the Tenant or Tenants, shall be compelled to do what the Landlord ought to have done; And upon the like neglect of the Tenants, that then, and upon every such defauls, the said Commissioners may by Warrant levy all such penalties, as by this Act are appointed by distress and sale of the Offenders Goods. And it is hereby further ordained, that all such Tenant or Tenants shall defaulk all such Sums of money as they shall disburse for their Landlords by reason of distress, or otherwise for any default in manner aforesaid o●t of the next rent due to his Landlord, any Contract to the contrary notwithstanding, and the said Tenant or Tenants shall be indemnified for so doing by Authority of Parliament, unless the Landlord shall within a month make it appear to the Commissioners that the default and penalties were occasioned by the neglect of such Tenant or Tenants. Provided always that where any person shall be charged with a horse and arms, and shall not by the Commissioners be suffered to put Riders upon them, or to have his arms born by such person as he shall sand in, that then the said Commissioners are to take care that immediately after the service ended such horses be redelivered to such persons as sent them in, unless such horses be lost in actual service, and that their arms be detained in such hands as the Commissioners thought fit should ride and bear the same, to the end they may be in readiness for future service, as well as others. Provided always that no person shall either ride a horse or carry arms in this service, that hath been in arms against the Parliament or aided or assisted therein, unless he hath since manifested his good affections to the Parliament. Provided also that no person shall be employed in this service as a Commission Officer, but such or the Sons of such who have adhered to the Parliaments cause, unless such Sons have shewed their disaffection to the Parliaments cause. Provided that if any Person shall be charged with a horse and arms, in the County or place where his orher chief Mansion, house is for his or her whole estate, that then upon certificate that such person is so assessed for his whole estate in the said County or place, such person shall be discharged from any assessment elsewhere, where his estate lieth. Provided that no Commissioner nor Commissioned Officer shall exercise any the powers or authorities herein mentioned, or do any thing in pursuance thereof, until in the presence of five or more of the said Commissioners, he shall first aclowledge in these words following( to wit) I do aclowledge and declare, that the War undertaken by both houses of Parliament, in their defence against the Forces raised in the name of the late King, was just and lawful, and that Magistracy and Ministry are the ordinances of God. Monday March the 12th. 1659. Ordered that this Act be Printed and published. FINIS.
