ACT For a leavy Of Horse and Foot Within this KINGDOM, FOR THEIR NECESSARY Defence. edinburgh, Printed by Evan tiler, Printer to the Kings most Excellent Majesty, 1650. Edinburgh, 25 June, 1650. THe Estates of Parliament having considered the dangerousposture of affairs in this kingdom, both in respect of intestine and foreign enemies, And although it hes pleased God, to break the power of malignants in this kingdom, Yet knowing that they will be uncessant in their designs and attempts in laying hold of all opportunities to involve this kingdom in new troubles, And withall, having received several intelligences of imminent dangers to the cause and this Nation from abroad by approaching of an army of Sectaries towards this Kingdom. And being obliged in discharge of the trust Committed to them to take care of the safety of the Nation, As they resolve for themselves to use all lawful means and peaceble ways to prevent the dangers, so they have thought fit to give warning to the several shires and burghs, That according to the law of God, nature and nations, and according to the duties which they by so many sacred bonds owe to the Covenant and cause, to the King and Kingdom, they might be in a condition and posture for defending all those and whatsoever is near and dear to them against all invasion. Likeas for the stoping of the mouth of calumny removing all scrouples and mistakes, and clearing to the consciences of all the lawfulness, necessity and justice of their resolutions & proceedings, & that they may have the greater assurance of Gods blessing and presence to all their indevores, The Estates of Parliament declare and assure that they enjoin the following levy of horse and foot for this end allanerlie of mere, just and necessary defence of this Kingdom from invasion, without any design or intention of invading, any who shal not first invade this kingdom; And therefore the saids Estates of Parliament do hereby ordain the whole shires and burghes within this kingdom presently to raise and have inreadinesse the whole number of horse, men, and arms, and the foot appointed to be levied by the act of Parliament of the 6 day of August. 1649. Together with what was not put forth of the third part of the horse & fourth part of the foot, comform to the act of levy of the 28. day of Febr. 1649. And siclike the hail Burrows of this Kingdom to raise & have in readiness the proportion of horse according to the said act of the 28, of February 1649. So far as already is not put forth by them, Or in their option three Foot for every horse & man, & then according to the Act 6. of August. 1649. For the present levy; all which are set down in the list hereunto subjoined. And ordains the forces foresaid To be brought to Randevoweses against such dayes as are designed by the Parliament by a particular Act of the date of their presents herewith sent, and that at such a convenient place within the Shire as the Committee of war, with advice of the officers shal think fit, And appoints them at that time and place to be enrolled and listed under their respective officers, And either to march if they shal receive orders, or to return to remain with their out-putters in case they receive not orders from the Parliament or their Committee; Providing always, that it is not hereby to be understood that the Committee of Estates shall have any power to give orders to the said forces for bringing them forth of the shires for any other ends then for the just and necessary defence of this kingdom from invasion as is expressed in the narrative of this Act. And the saids Estates of Parliament ordains every troop to consist of 75. Troupers, and every regiment of horse to be made up of 6. troops at least, and 8. troops at most, sicklike every company of foot to consist of 126 souldiers, and every regiment of foot to be made up of 8. companies, And likewise they ordain the present standing troops be recruited and made up to the number of 75. in every troop out of the number of horses to be now levied forth of the several shires respective, and these recruites not to be brought forth of the shires till there be a necessity of bringing forth the new levy foresaid, according to this present Act, And sicklike that these recrutes be dismissed with the new leavy, when the same shall be dismissed; And farther, the saids Estates of Parliament declare they will nominate and appoint the officers of regiments, troops and companies from a colonel to a Captain inclusive without prejudice to the commits of shires in time coming anent any power whatsomever granted to them for nomination of their own rootmasters conform to any preceding acts of levy, and do give power and war● and to the Committees of War of the several shires with advice of the colonels respective, according to their several divisions if they be present to nominat and appoint the officers inferior to a Captain, and to the Magistrates and Counsels of Burghes to make choice of their officers under the degree of a Captain according to the proportions to be put forth by them, Providing always they make choice of such as are fit for the service, and are qualified as is expressed in the 26. Act seventeenth of February, 1649. which ordains that such as are malignant and disaffected to the present work of reformation, and Covenants, and against whom there is just cause of Exception or just ground of jealousy because of their disaffection, or any person given to drunkenness, Swearing, Uncleanes, or any other Scandalous offence, Be not made choice of, but onlyable men, and such who are of known affection unto, & approved fidelity and integrity in the cause of God, & of a blameless and Christian Conversation. And ordains the saids Committees of war and counsels of Burghes, after they have made choice of their under officers, to return a roll of their names to the Committee appointted for purging the army, before the day of their randezvows. And gives power to the Committees of War and counsels of Burghs within their several Jurisdictions respective, To divide and lay on proportionally the horse according to the maintenance upon the several heritors and others liable in putting forth the same; And It is declared That the greatest rent of these to be joined for making up one horse shall provide the horse, And the rest that join, to contribute according to one hundereth and threescore pounds for ilk horse and man, With power also to the Committees of war of the several Shires respective, to set prices upon horses fit for the service, And to take them as they shall find necessary for the good of the same, And Sicklyke appoints the heritors and others liable in putting forth horse and Foot to bring them to the rendezvous well mounted and armed under the pain of 200. marks for ilk horse & man, and 100. marks for ilk Footman. To be payed by the heritors & others failing to bring sufficient horse, men and arms respective to the randezvows as said is, To be exacted by the select persons nominate in the several shires for viewing of the horse and arms; And this penalty to be exacted by and attour the putting forth of the horse, men and arms as is afforesaid; And in case of their return from the rendezvous, appoints the Committees of War of the several Shyrs to take the particular heritors and others liable in putting forth Horse and Foot obliged for having them in reddinesse within 24. houres after advertisement from the Parliament or Committee of Estates, under the pain aforesaid, Andappoints the counsels of Burghs to take the out-putters within brughs, obliged in the likemanner under the same pain. And further the saids Estates upon consideration of the great abuses in former levies committed by officers in taking of money from the heritors & others aforesaid who are liable in putting forth of horse-men and foot in place of their said men, Declare That whatsoever officer shall be found to have done so, shall not only be cashiered from his charge, but also branded with one mark of infamy and disgrace, and shal be obliged to repay the quadruple, & to be imprisoned ay and while he pay the same, Excepting such officers who are to levy their horsemen in the shires beyond Spey, who are hereby permitted to take 200. pounds for every horse and man, or the man well mounted in the option of the outputter; Providing The said Officers make up their number of good sufficient able horse and men at the day of Randezvows appointed for the said shires beyond Spey, as said is. And the saids Estates of Parliament do give power to the saids Committees of War in the several shires of this kingdom with advice of the colonels To do all things comform to the former acts of Levies as they shall find necessary for the more speedy and effectual raising and having in readiness at the rendezvous, the Horse and foot abovewritten, And appoints the saids Committees, after the receipt of this act, to sit continually & every day till they execute the same, And return immediately an account of their diligence to the Parliament or Committee of Estates, With power to them to fine those of their number who shall be absent in 20. marks Scots for every dayes absence.
