THE copy OF THE Kings majesties Letters Patents for the making of Allomes, in ENGLAND, SCOTLAND, and IRELAND, or in any other his majesties Dominions made to WILLIAM TVRNOR, &c. THis Indenture made the one and twentieth day of april, in the yeeres of the reign of our sovereign Lord james, by the grace of God King of England, Scotland, france,& Ireland, defender of the faith, &c. That is to say, of England, france& Ireland the eighth, of Scotland the three and fortieth. between our said sovereign Lord the Kings majesty on the one part, and William Turnor, Richard Bowdeler and Thomas jones of London marchants on the other part witnesseth: That wherea● our sai● Soue●●igne Lord the Kings majesty, The letters Patents to the Lord Sheffeylde and others. by his Highnesse letters Patents, sealed with the great seal of England, bearing date at Westminster the third day of january in the fourth year of his reign of England, france and Ireland, and of Scotland the fortieth: For the considerations therein expressed, did give and grant unto his trusty and right well-beloved Edmond Lord Sheffeild, Lord President of the North parts, and to sir Thomas chaloner knight, sir david Fowlys knight, and sir John Bourchier knight, then by the name of John Bourchier esquire, and to every of them, their and every of their executors, administrators, and assigns, diuers absolute, full, and free licenses, powers and authorities as therein are mentioned, for touching or concerning the sole and onely making of Allomes and the liquours thereof within the realms of England, Scotland,& Ireland, and every or any of them, and in all other his majesties dominions, for the term of one and thirty yeeres next ensuing the date of the said letters Patents( except as in the same letters Patents is excepted) yielding& paying therefore yearly unto his majesty, 31. yeeres. his heires and successors, from and after the term of two yeeres next coming after the date of the said letters Patents, the yearly rent or yearly sum of seven hundred pounds of lawful English money, at such place and times, and in such maner and form as in and by the said letters Patents the same is limited and appointed to be paid, as, in, and by the said letters Patents more plainly appeareth. The Patentees grant to the Merchants undertakers. And whereas the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlys, and John Bourchier by their Indenture bearing date the third day of February, in the said yeeres of the reign of our said sovereign Lord the Kings majesty that now is, of England, france and Ireland the fourth, and of Scotland the fortieth, did grant to the said William Turnor and unto Nicholas crisp, Ellys crisp, William hind, and Abraham Chambrelane of London Merchants, and to every of them, their executors, administrators and assigns, and to their deputies, factors, seruants and assigns, and to all and every of them full and absolute power and authority, that they their executors, administrators, factors, deputies, seruants& assigns, should or might at all times, and from time to time during the said term of one and thirty yeeres in the said letters Patents mentioned, dig open and work for all maner of mines and ewers of Allomes, and the liquours thereof, as well within all or any the several lands or grounds of the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlys, and John Bourchier, or any of them within the county of york and elsewhere wheresoever within the said realms of England, Scotland and Ireland, as in& vpon such other grounds, lands and possessions within any his majesties dominions, as they the said William Turner, Nicholas crisp, Ellys crisp, William hind, and Abraham Chambrelan, or any of them, their or any of their executors or assigns should agree and compound for with any the owners thereof in as large and ample maner as the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis and John Bourchier, and every or any of them their heires or assigns, could or might in al such places as are mentioned in the said recited Indenture( except as in the said Indenture is excepted) together with such free ingress, egress, and regress, and such other authority, benefit, liberty and privilege as in the said Indenture is at large expressed and declared. By which Indenture it was covenanted, concluded and agreed by and between all the parties to the same Indenture: That from and after all allowances, payments, disbursements, and deductions of all such sum and sums of money as they the said William Turnor, Nicholas crisp, Ellis crisp, William hind, and Abraham Chambrelan, their executors, administrators or ●… ssignes, had or should pay or disburse in or ●… 'bout the making of Allomes, or the liquours ●… hereof, together with the interest thereof after ●… he rate of ten in the hundred for the forbea●… ance of one whole year. That the twentieth part of all such clear gains and proceed of all such Allomes as should be made vpon the grounds of the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, and John Bour●… hier, or any of them, which vpon every account to be made, should appear to remain or come of the sale of the said Allomes to bee made, should be yearly during the residue of ●… he said term, vpon every account to be made paid and allowed unto such of the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, and John Bourchier, their heires, executors or assigns, as should haue any houses built or erected vpon any of their grounds rateablie and proportionably according to the number of tons of Allomes that should bee made vpon such their grounds respectively in lieu and recompense of such their grounds and buildings thereupon made or to be made, for the making of Allomes. And the said William Turnor, Nicholas crisp, Ellis crisp, William hind, and Abraham Chambrelan, did in and by the said Indenture for them and every of them their heires, executors, and administrators by several covenants, covenant and grant to and with the said Edmond Lord Sheffeild, his executors and assigns, and to and with the said sir Thomas chaloner, his excutors or assigns, and to and with the said sir david Fowlis, his executors and assigns, and to and with the said John Bourchier, his executors and assigns, that they the said William Turner, Nicholas crisp, Ellis crisp, William hind, and Abraham Chambrelan, their executors, administrators or assigns, should from time to time after all allowances, payments, disbursements, and deductions of all such sum and sums of money as they the said William Turnor, Nichollas crisp, Ellis crisp, William hind, and Abraham Chambrelan, their executors, administrators or assigns, had or should pay or dis●… urse in or about the making of Allomes, and ●… he liquours thereof together with the interest ●… hereof after the rate of ten in the hundred for ●… he forbearance thereof for one whole year, ●… ay unto the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, and John Bour●… hier, and to every of them severally and re●… pectiuely, and to the several and respective ●… xecutors, administrators or assigns of them, ●… nd every of them one several and respective ●… ourth part of a moiety, or of one half of the whole clear gains and proceed thereof re●… aining, by the making, uttering and sale, ei●… her within any the Kings realms or Domini●… ns, or without, of all or any Allomes, and of ●… ny profit which should be or appear to haue ●… ome unto the hands of the said William Turnor Nicholas crisp, Ellis crisp, William hind, and A●… raham Chambrelan, their executors, administrators and assigns, or any of them by any Al●… omes, by them or any of them, made, uttered, transported, sold, or remaining vnuttered o●… vnsould. The release of Magdalen hind. And whereas since that time the said William hind made and declared his last will& testament and thereof ordained one Magdale●… late his wife to be his Executrix which Magdale●… by her deed bearing date the twentieth day o●… april now last past, did grant& release to th●… said William Turnor Nicholas crisp Ellys crisp and Abraham Chambrelan all her interest in and to th●… said letters Patents and Indenture before mentioned? and in and to the licenses powers privileges and authorities thereby or by either o●… them given and granted as aforesaid, by vertu●… whereof they the said William Turnor, Nichola●… crisp, Ellis crisp, and Abraham Chambrelan, wer●… lawfully possessed of all the licences, powers privileges and authorities by the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, and John Bourchier, by the said Indenture granted and of all that other moiety of th●… clear gains that had or should arise, come o●… grow by the said letters Patents, and the licences, privileges and authorities thereby granted or by the making of any Allomes or liquour thereof. And whereas the said sir Thomas Cha●…loner being by virtue of his majesties said let- Patents, Sir Thomas Challoners fourth part. and the grants and covenants of the said last mentioned Indenture lawfully interested, in and to haue one fourth part of the moiety or one half of the whole clear gains and proceed coming arising and remaining, by the making, uttering, or sale within any the Kings realms or Dominions, or with out, of any the said Allomes, or the liquours thereof, at any time during the said term of one and thirty yeeres in the said letters Patents mentioned, and of all such profit as should be or appear to haue come to the hands of the aforesaid William Turnor, Nicholas Crisp, Ellis Crisp, William hind deceased, and Abraham Chambrelan their executors administrators and assigns or any of them, by any Allomes by them or any of them during the said term of one and thirty yeers, made, uttered, transported or sold, or remaining vnuttered or vnsould by his Indenture tripertite, bearing date the last day of February in the yeeres of the reign of our said sovereign Lord King james of England france and Ireland the fifth, and of Scotland the one and fortieth. For the causes and considerations therein expressed, did grant, bargayn and sell, convey, assign, and set over unto Sir William Fleetewood Knight, his executors administrators and assigns, two parts of his the said Sir Thomas Challoners fourth part into three parts being divided of the said moiety, or one half of the said whole clear gains, proceed, and profit, and all the estate, right, title, term, interest and demand of him the said Sir Thomas chaloner, of, in, and to the said two parts of his the said Sir Thomas Challoners fourth parte into three partes being divided. L. Sheffeilds fourth part. And whereas the said Edmond Lord Sheffeild, being by virtue of his majesties said letters Patents and the grants and covenants before recited, lawfully interested in, and to haue one fourth part of the moiety, or one half of the whole clear gains and proceed and profit aforesaid, by one Indenture bearing date the first day of March, in the yeeres of the reign of our said sovereign Lord King james, of England, france and Ireland the sixth, and of Scotland the two and fortieth: For the considerations therein expressed, did give, grant, bargain and sell unto Christopher Turnor of Reading, in the county of berkshire Clothier, the moiety or one half of his said Patentees part, which is the moiety or one half of the fourth part of a moiety or one half of the clear gains, proceed, and profit aforesaid,& by one other Indenture bearing date the eleventh day of the said month of March, for the considerations therein expressed, did give, grant, bargain and sell unto Alexander Stafford of holborn in the county of Middlesex gentleman, his executors, administrators, and assigns, all that other moiety of his said Patentees part, which is the moiety, or one half of the fourth part of a moiety, or one half of the whole clear gains proceed and profit which ●… hold come by the making of Allomes,& the ●… iquors thereof; and also one equal third part of one other fourth part of one other moie●… je or one half( being the one third part of the ●… aid John Bourchiers patentees part) of the whole ●… leare gains proceed and profit which should ●… ome by the making of Allomes,& the liquours ●… hereof, which said third part was granted, or ●… entioned to be granted by the said John Bour●… hier, in or by his dead unto the said Lord Shel●… eild his executors and assigns during the term in the said letters Patents mentioned, and also the said twentieth part of all such clear gains, and proceed of all such Allomes as should bee made vpon any the grounds of the said Lord Sheffeild, during al the residue of the said term, by virtue of the said letters Patents, and of all or any the Indentures in the said last recited Indenture mentioned and recited, which should be or appear to haue come to the hands of the said William Turnor, Nicholas crisp, Ellis crisp, William hind deceased, and Abraham Chambrelan their executors, administrators, and assigns, or any of them, by any Allomes by thē, or any of them then to fore, or then, or then after to be made uttered, transported, or sold: to be had& holden to him the said Alexander Stafford his executors, administrators and assigns for and during so long time as in the same last recited Indenture is limited and expressed: both which said last recited Indentures made by the said Edmond Lord Sheffeild unto the said Christopher Turnor and Alexander Stafford, were made unto them at the onely instance and request of the said William Turnor vpon trust& confidence reposed by him the said William Turnor in them the said Christopher Turnor and Alexander Stafford, and to and for the onely benefit and behoof of him the said William Turnor his executors, administrators, and assigns. Articles quadripartite. And whereas in and by certain articles of agreement, indented quadripartite made, concluded and agreed vpon the sixth day of May, in the year of our Lord God one thousand six hundred and nine, between the right honourable Robert earl of salisbury, Lord High Treasurer of England, and sir Iulius Caesar knight, chancellor, and under Treasurer of his majesties Exchequer of the first part; and the said Edmond Lord Sheffeild, John Bourchier then esquire, and now knight, Christopher Turnor, and Alexander Stafford of the second part, the said sir Thomas chaloner, sir david Fowlis, and sir William Fleetwood knights of the third part: And the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan of the fourth part, reciting as therein is recited, and reciting also: The stock. That whereas there was a stock& diuers other disbursements of money laid out by the said William Turnor, Nicholas crisp, Ellis crisp, William hind deceased, and Abraham Chambrelan, for the perfecting& effecting of the said works, concerning the making of the said Allomes, and the liquours therof, which stock, and other the disbursements laid out by the said William Turnor, Nicholas crisp, Ellis crisp, William hind deceased, and Abraham Chambrelan, in, and about the making and perfecting of the said alum works, amounting to a great sum of money, as it had been already audited, examined, and allowed. The said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, for the considerations therein after in the said articles quadripertite mentioned, did bargain and sell unto our said sovereign Lord the King, together with the interest& increase growing by the said disbursements then already past. And also all that the said moiety and hal●e part to the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, belonging of all the clear profit which might or should grow, for, by, or in respect of the said stock, disbursements, and increase, and all the benefit of all that moiety which they the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, then had, or should, or might then after haue by virtue of the said letters Patents, or by reason of any composition then to fore made, with the said Lord Sheffeild, and others the said Patentees or any of them, for, and concerning onely the said moiety of the benefit of the said letters Patents, or by any other means whatsoever: In consideration whereof, the said Lord Treasurer and sir Iulius Caesar knight, by the said articles of agreement quadripertite, did agree for, and on his majesties behalf, that our said sovereign Lord the Kings majesty, his heires, and successors should pay or cause to be paid; and the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, their executors, administrators, and assigns, should haue& receive of his majesty, his Heires and successors, as well the yearly sum of six thousand forty ●… nd four pounds of lawful English money to ●… e paid yearly to the said William Turnor, Nicho●… as crisp, Ellis crisp, and Abraham Chambrelan, ●… heir executors, administrators or assigns, by ●… is majesty, his Heires or successors, as the same ●… hold arise out of the Allomes which should ●… hen after be made, during so many yeeres as ●… ere in the said letters Patents mentioned, and which were then to come and unexpired: as also the sum of one thousand and seven pounds of lawful money of England to bee paid in such maner and form as in the said articles of agreement quadripartite is mentioned and expressed. Particular payments and charges. And the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, did thereby for them their executors, administrators and assigns, covenant and promise to save, and keep harmless our said sovereign Lord the King, his Heires, and successors, of and from the particular payments& charges therein after particularly mentioned. And in consideration of the payments of the said yearly sums last mentioned, and of the discharging of his majesty his Heires and successors, off and from the payment thereof, the said Lord Treasurer and sir Iulius Caesar, by the said articles of agreement quadripartite, did agree for& on his majesties behalf, that his said majesty, his Heires and successors should pay, or cause to be paid●… and the said William Turnor, Nicholas crisp, El●… crisp, and Abraham Chambrelan, their executor●… administrators or assigns, should haue of hi●… majesty his Heires or successors out of the Allomes to be made as is aforesaid, the sum of one thousand pounds of lawful English money( over and above the sums aforesaid) to be paid unto them or some or one of them, at or before the first day of may, which then should be in the year of our Lord God, according to the computation of the Church of England, one thousand six hundred& sixteen; And also that his majesty his Heires or successors should pay or cause to be paid; four thousand pound. And that they the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, their executors, administrators, or assigns, should haue of his majesty his heires and successors, the sum of four thousand pounds of like lawful money of England, to be paid out of the Allomes as aforesaid,( over and above the sums aforesaid) to be paid unto them or one of them in manner and form in the said articles of agreement quadripartite mentioned. One thousand pound per annum. And also that from, and after the first day of May, in the year of our Lord God one thousand six hundred and seventeen, our said sovereign Lord the Kings majesty, his heires, and successors, should pay, or cause to be paid. And the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, or some, or one of them, their, or some or one of their executors, administrators, or assigns, should haue and receive of his said majesty, his Heires, and successors, the yearly sum, or payment, of one thousand pounds of like lawful English money, to be paid out of the said Allomes, as is aforesaid,( over and above the sums aforesaid) to bee paid yearly,& every year vpon the first day of May, yearly and every year, for and during so many of the yeeres as were in the said letters Patents, mentioned, and which from and after the said first day of may, in the said year of our Lord God( according to the computation of the Church of England) one thousand six hundred, 3. Ian. 1637 666. pound, 13. shillings, 4. pence. and seventeen, should by effluction of time be then to come& unexpired. And at or before the third day of Ianuarie, which then should be, in the year of our Lord God( according to the computation of the Church of England) one thousand six hundred thirty and seven, being the full end, and determination of the said term of one and thirty yeeres mentioned in the said letters Patents, as the same by time should expire the sum of six hundred, threescore and six pounds, thirteen shillings, and four pence, of like lawful English money( over and above the sums aforesaid, the said several payments to be made at such place, and places, as in the said articles is expressed and specified; And in and by the said articles of agreement quadripartite it is mentioned, that the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, Houses, implements, stocks, and profits of W. Turner &c. sold to his majesty. did also for the considerations therein mentioned, bargain, sell, and assign, unto our said sovereign Lord the King, all those houses, implements, horses, stocks, necessaries, commodities, profits, and things, by them, the said William Turnor, Nicholas Chrispe, Ellis crisp, and Abraham Chambrelan, or any of them there then used, employed, or occupied, for, with, or about, or in respect, of the working, or making of Allomes, or the liquours thereof. And also all contracts, covenants, promises, assurances, conveyances, rights, titles, accounts, and demands, which they, or any of them, could, or might haue, take, or use, with, ●ouching, or against any person, or persons, ●or, or in respect of any matter, or thing concerning the said making of Allomes, or the liquours thereof, for which purpose they should allow all things done by his majesty in their names in these behalf. His majesty to discharge W. Turnor, &c. of al charges. In respect whereof, the said Lord Treasurer, and sir Iulius Caesar, by the said articles of agreement quadripartite, did also agree on his majesties behalf, That hi majesty, his heires, and successors, should free, exonerate, and discharge the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, their, and every of their executors, administrators, and assigns, against all other person and persons, whatsoever, for, or in respect of any thing to be performed on the parts, or behalf of the said William Turnor, Nicholas Crisp, Ellis crisp, and Abraham Chambrelan, their executors, administrators, or assigns, or any of them, for, or in respect of any such contracts, covenants, promises, assurances, conveyances, rights, titles, actions, or demands, before bargained, sold, granted, or assigned to his majesty as is aforesaid. And the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, sir William Fleetewood, John Bourchier, Christopher Turnor, and Alexander Stafford, by the said articles of agreement quadripartite( for the considerations therein after mentioned) did bargain, sell, and assign over unto our said sovereign Lord the King, all those four parts of the aforesaid moiety, which they, the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, sir William Fleetwood, John Bourchier, Christopher Turnor, and Alexander Stafford, or any of them, then had, might, or ought to haue, by virtue of the said letters Patents, and by reason of the said Indenture, composition, and agreement, made between them, the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, and John Bourchier, and the said William Turnor, Nicholas crisp, Ellis crisp, William hind deceased, and Abraham Chambrelan, as is aforesaid, or betwixt any of them, Three thousand pound to be paid to sir Thomas chaloner and others. or by virtue of any the before recited Indentures. In consideration whereof the said Lord Treasurer of England, and sir Iulius Caesar knight, by the said articles of agreement quadripartite, did agree for, and on his majesties behalf, that his majesty, his heires and successors, should pay, or cause to be paid, and that the said sir Thomas chaloner, sir david Fowlis, sir William Fleetwood, John Bourchier, Christopher Turnor, and Alexander Stafford, their executors, administrators, or assigns, should haue, and receive of his majesty, his heires, and successors, the full sum of three thousand pounds, of lawful money of England( over and above the six thousand forty four pounds, and the other sums to be paid as aforesaid) to be deuidedly paid to them, the said sir Thomas chaloner sir david Fowlis, sir William Fleetwood, John Bourchier, Christopher Turnor, and Alexander Stafford, and to every of them severally, and respectively, and to their several and respective executors, administrators, and assigns, in maner and form in the said articles expressed and specified. And also that his majesty, his heires and successors, should pay, or cause to be paid; And that the said Lord, sir Thomas chaloner, sir david Fowlis, sir William Fleetwood, John Bourchier, Christopher Turnor, and Alexander Stafford, their executors, administrators, or assigns, should also haue, and receive of his majesty, his heires, and successors, yearly, and every year, during the residue of the said term of one and thirty yeares in the said letters patents mentioned, from& after the said first day of May, six thousand pound per annum to the Lord Sheffield and others after the first of May 1617. in the said year of our Lord God( according to the computation of the church of England) one thousand six hundred and seventeen, the yearly sum of six thousand pounds of like lawful money of England, to be severally and deuidedly paid to them, the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, sir William Fleetewood, John Bourchier, Christopher Turnor, and Alexander Stafford, their executors, administrators and assigns, in manner and ●… orme in the said articles also mentioned and ●… xpressed. 1000 pound to the Lord Sheff●ild and others 3. And that our sovereign Lord the King, his heires and successors, should likewise ●… ay, or cause to be paid: and that the said Lord ●… heffeild, sir Thomas chaloner, sir david Fowlis, ●… r William Fleetewood, John Bourchier, and Christo●… her Turnor, their executors, administrators, or ●… ssignes, should also haue, and receive from ●… ur said sovereign Lord the King, his heires ●… nd successors, at, or vpon the third day of Ia●… uary, which shalbe in the year of our Lord ●… odd( according to the computation of the ●… hurch of England) one thousand six hundred thirty and seven being by effluction of ●… me the full end, and determination of the said term of one and thirty yeeres mentioned in the said letters patents, the sum of one thousand pounds of lawful English money to be paid unto them, the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, sir William Fleetewood, John Bourchier, and Christopher Turnor, and to their executors administrators, or assigns, at the place, or places in the said articles mentioned, deuidedly, respectively, rateably, and proportionably, according to the several sums to them quarterly paieable in maner and form as is aforesaid: as in and by the said articles of agreement quadripartite, His majesties letters patents of his royal assent to the articles quadrepartite. amongst other things therein contained more at large it doth and may appear. And whereas our said sovereign Lord the Kings majesty, by his highnesse letters patents, sealed with the great seal of England, bearing date at Westminster the Nine and twentieth day of October now last past before the day of the date of these Presentes, having had consideration of the premises, hath for his highnesse, his heires, an●… successors, of his especial grace, certain●… knowledge, and more motion allowed, ratified, approved, and confirmed, all and singula●… the said agreements made betwixt the said Lord Treasurer of England, and chancellor of the Exchequer on his majesties behalf, and and the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, sir William Fleetewood, sir John Bourchier, William Turnor, Nicholas Chrispe, Ellis crisp, Abraham Chambrelan, Alexander Stafford, and Christopher Turnor, in maner and form as is aforesaid, and all& singular the articles indented therein before, in, and by the said letters Patents recited, and to the same articles indented, and to all,& singular the agreements therein contained according to the tenor, form, and effect thereof, did give his royal consent, and agreement; and did by the same letters Patents will, and command, that the same, and every of them, should be duly performed and executed, according to the tenor and true meaning of the same, as in, and by the said letters Patents at large it also doth and may appear. Now this Indenture further witnesseth, His majesties grant. that our said sovereign Lord the King, for, and in consideration of the sum of three thousand pounds of lawful money of England, into the receipt of his majesties Exchequer, to his Highnesse use, by the said William Turnor, Richard Bowdeler, and Thomas jones, before the date of these presents, well and truly paid, and for, and in consideration of the yearly rents, or sums of money hereafter, in, and by these presents reserved, and covenanted to be paid, and also for diuers other good causes, and considerations, his Highnesse hereunto especially moving, of his especial grace, certain knowledge and mere motion, and also by, and with the aduise of the said Robert earl of salisbury, Lord high Treasurer of England, and sir Iulius Caesar knight, chancellor and under-treasurer of his majesties Exchequer: Hath given, granted, assigned, and set over, and by these presents, for his Highnesse, his Heires, and successors, doth give, grant, assign, and set over, unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, all that the said stock, and other the disbursements laid out by the said William Turnor, Nicholas crisp, Ellis crisp, William hind deceased, and Abraham Chambrelan, or any of them, in, and about the making, and perfecting of the said alum works, together with the interest, and increase, growing, and to grow, by the said disbursements: moiety of the clear profits. And all the said moiety, and half part, of all the clear profit which hath grown, or shall or may grow, for, by, or in respect of the said stock, disbursements, or increase, and all the benefit of the same moiety, and all the houses, implements, horses and other stocks, necessaries, profits, commodities, and things, and all contracts, covenants, promises, assurances, conveyances, rights, titles, actions, and demands whatsoever, in,& by the said articles of agreement, indented quadripartite granted, bargained, sold, assigned, or set over, or mentioned, to be granted, bargained, sold, or set over, by them the said William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, or any of them, unto our said sovereign Lord the Kings majesty, and all those parts of the aforesaid moiety, or one half of the clear gains, proceed, and profit remaining, or coming, or which shal come by the making, uttering, transporting, or sale of all, or any Allomes within any his majesties realms or Dominions, or without,& of all, or any other Allomes whatsoever, in, and by the said articles of agreement indented quadripartite, granted, bargained, sold, assigned, or set over, or mentioned to be bargained, sold, assigned, or set over by the said Edmond Lord Sheffeild, sir Tho. chaloner, sir david Fowlis, sir William Fleetewood, John Bourchier esquire, now knight, Christopher Turnor, and Alexander Stafford, unto our said sovereign Lord the King. And also all the lands, mines, houses, lands, mines, Allomes. buildings, powers, privileges, authorities, liberties, bargains, contracts, stocks, goods, chattels, debts, profits, commodities, and advantages whatsoever, concerning the alum, mines, and works in the said county of york or elsewhere, together with all Allomes heretofore made, and to be made, from and after the said eighteen day of December now last past, and the making of Allomes, and the liquours thereof, within the said realms& Dominions, and al other things whatsoever which were granted by the said Edmond Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, sir William Fleetewood, John Bourchier, Christopher Turnor, Alexander Stafford, William Turnor, Nicholas crisp, Ellis crisp, and Abraham Chambrelan, or any of them, unto our said sovereign Lord the King, in, or by the said articles of agreement, indented quadripartite herein before mentioned. And all the right, title, term, interest, benefit, profit, remedy, advantage, and demand whatsoever of our said sovereign Lord the King, his heires and successors, of, in, to, and for the same, and every of them, and every part and parcel thereof. And also our said sovereign Lord the King for the considerations aforesaid, of his further especial grace, certain knowledge, and mere motion, hath, with, and by the advice of his privy counsel; given and granted, and by these presents, for him, his heires and successors, doth give and grant absolute, full, and free licence, power, and authority unto the said William Turnor, Richard Bowdeler, and Thomas jones, and every of them, their, and every of their executors, administrators, and assigns; That they, and every of them, their, and every of their executors, admimistrators and assigns by themselves, or any of them, or by their, or any of their Deputies, Factors, assigns, or seruants, shall and may at all times, and from time to time during all such and so much of the said one and thirty yeeres to be accounted from the said third day of january as by course and effluction of time is yet to come and unexpired, authority to dig and work. dig, open,& work for all maner of mines, and oars of Allomes, and the liquours thereof, and the same to convert and use to their and every of their most profit and commodity, as well in, and vpon all, or any the lands, grounds, and possessions of the said Lord Sheffeild, sir Thomas chaloner, sir david Fowlis, and sir John Bourchier, and every, or any of them, within the said County of york, as in, and vpon such other lands, grounds, and possessions, within the said realms of England and Ireland, and either of them, and in all other his majesties dominions, belonging or appertaining to them, or either of them, as they, or any of them shall agree or compound for with the owners thereof, where it shall bee thought fit by them, the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, or any of them, to be most meet and convenient, as well within liberties as without. And to the intent that the said William Turnor, Richard Bowdeler, and Thomas jones, and every of them, their, and every of their executors, administrators, deputies, factors, and assigns, shall and may enjoy the sul and sole benefit and profit of making and digging of and for Allomes,& liquour for Allomes within his majesties realms and dominions, during all the residue of the said term of one and thirty yeeres; Prohibition and restraint for all others but the Patentees. his majesties will and pleasure is, and by these presents his Highnesse of his especial grace, certain knowledge, and mere motion, and of his supreme and absolute power and authority, which he forbiddeth to be disputed, argued, or brought in question, doth straightly charge and command all, and and every person, or persons whatsoever, of what estate, degree, or condition soever, he or they, or any of them be, that none of them, other then the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, deputies, seruants, factors, or assigns, or some of them, shall during the residue of the said term of one and thirty yeeres, attempt, presume, or go about any maner of way, di●… ectly or indirectly, in any lands, grounds, or ●… ossessions, within this his majesties realms of England and Ireland, or either of them, or any other his majesties dominions, thereunto belonging, to dig, open, or work for any mines, or aores, of the said Allomes, or the liquours thereof, or any thing belonging to the same, vpon pain of forfeiture, of all and every such Allomes, and the liquours therof, for which any person or persons shall so dig, open, or work, in any lands, grounds, or possessions, within his majesties said realms of England or Ireland, or either of them, or in any his majesties dominions thereunto belonging, contrary to the true intent and meaning of these presents. All which said forfeitures, the Kings majesty, for him, his heires, and successors, doth by these presents give and grant unto the said William Turnor, Richard Bowdeler,& Thomas jones, their executors, administrators, or assigns. And also vpon such further pains, penalties, and imprisonments, as his majesty his heires or successors by any the laws or statutes of this realm of England, or by his Highnesse prorogatiue and royal jurisdiction, may any way appoint, assess, or adjudge in that behalf. And also that it shall and may be lawful to and for them the said William Turnor, Authority to transport. Richard Bowdeler, and Thomas jones, and every of them, their, and every of their executors, administrators, deputies, factors, and assigns, at all and every time and times hereafter, during all the residue of the said term of one and thirty yeeres, to transport, carry, and convey any alum or Allomes, to any place or country whatsoever, or wheresoever, and the said Allomes and the liquours therof, so by them transported, to utter, sell, and put to sale to any person or persons, at, and for their most benefit, profit and advantage, according to the true meaning of these presents. And that they the said William Turnor, Richard Bowdeler, and Thomas jones, and every of them, their, and every of their executors, administrators, deputies, factors, and assigns, at all times hereafter, during all the said term, shall be free, and discharged of, and from, all, and all maner of customs, subsidies, impost, and other payments and duties whatsoever, due or paieable to his majesty, his heires or successors, for, or in respect of the importation or transportation of any alum, made, or to be made within his majesties said realms of England or Ireland, or the dominions of the same, or any materials necessary for the use or making of the same to any place or country whatsoever, or wheresoever, any law, statute, ordinance, provision, restraint, or any other matter or thing whatsoever to the contrary thereof in any wise notwithstanding. A warrant to all officers to suffer the Patentees to transport their Allomes. And therefore our said sovereign Lord the King doth by these presents for him, his heires, and successors, straightly charge and command all and singular his majesties Customers, controllers, Surueiers, Searchers, Waiters, and other the officers and ministers of his Highnesse, his heires and successors, to whom in that behalf it shall& may appertain, that they, and every of them, do quietly permit and suffer the said William Turnor, Richard Bowdeler, and Thomas jones, and every of them, their, and every of their executors, administrators and assigns, from time to time& at all times during the residue of the said term●… of one and thirty yeeres in the said first recite●… letters Patents, granted or mentioned to be granted, which are yet to come and unexpired, to ship, lad, freight, transport, convey, and carry out and from any port, haven, creeke, or other place of lading, or unlading, within the same his majesties realms of England and Ireland, or any of them, or any other his majesties dominions, to them, or either of them, belonging, or appertaining 〈◇〉 any Allomes, or the liquours thereof by them made or wrought, within his majesties said realms of England or Ireland, or any part thereof, into any the parts beyond the seas, as is aforesaid, without any custom, subsedie, or other duties ●… herefore, or for any part or parcel thereof, to be rendered, yielded, answered or paid unto his majesty, his heires, or successors, of, or for the same. And these presents, or the inrolements ●… hereof, shall be from time to time to the said Customers, controllers, Collectors, surveyors, Searchers, and other officers and ministers a sufficient warrant and discharge in that behalf. The Patentees to haue place in the custom to appoint officers and to examine Masters& Owners of Ships. And furthermore our said sovereign Lord the King for him, his heires, and successors, of his highnesse especial grace, certain knowledge and mere motion doth by these presents give, and grant unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and to all, and every other person, and persons which by them, or any of them, by writing under their, or any of their hands and seals, shalbe in that behalf deputed, and assigned full, and free power, licence, and authority during the continuance of this present grant, and demise at their pleasures as well to be present, and attendant and to haue place in all maner of custom houses, Ports, havens, creeks and places of lading, and unlading of any manner of goods, wears and merchandises, into, or out of the said realms and Dominions: As also to be present with all and every the Customers, Collectors, controllers, searchers, Surueiers, Waiters, and other officers and ministers, having charge for and concerning the lading, or unlading of any goods, wears, or merchandises whatsoever, Or of the custom, Subsedie, or Impost due unto his majesty. For, or vpon the same for their better receiving, and enjoying of the benefit of this present grant, at all times, and places when, and where the said Officers, or ministers, or any of them shall by reason of their said several Offices, haue cause, or occasion to be; And also in every place, or places as well in ships arrived with alum& riding in any Port, road or river as on the land, to make and appoint such, and so many watchmen, waiters, and officers, and to see provide, and use such reasonable ways, orders, and means as they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, deputies, and assigns, and every of them, shall and may be justly, and truly informed of all and singular such parcels, and quantities of alum as shall at any time, or times during this present grant, be brought into or transported from any port or place of the said realms and Dominions or any of thē, And also that it may be lawful, to and for the said William Turnor, Richard Bowdeler, and Thomas jones their executors, administrators, deputies, and assigns, and to, and for every of them, from time to time during this present grant, to examine such and so many Masters and Owners of Ships, Ba●kes, and Lighters and all Key-keepers and Mariners for, and concerning any maner of alum which may happen to be brought into, or transported from or out of some or any of the said Ports, havens, creeks, and places of lading, and unlading, or the members of the same, vpon their several oath, and oaths, in as large and ample maner and degree in all things as any Customer, Collector, controller, Searcher, Surueyer, Wayter, or other Officer of the customs in whatsoever Port, haven, Creeke, place, or places of this realm haue, might, or ought to haue done, or hereafter shall, may, or ought to do, without the let, disturbance, or denial of any Officer, or other person or persons whatsoever. And that all Masters of Ships shall answer in this behalf as well for every person of their company of Mariners, Authority to take bonds in the Kings name for payment of moneys vpon the sale of Allomes, or any thing thereunto belonging,& may sue execution thereupon with as large a privilege as his majesty may do in his own case. and sailors as for themselves according to the laws in that case made and provided. And that the said William Turnor, Richard Bowdeler, and Thomas jones their executors, administrators, and assigns shall, and may from time to time during this present grant take sufficient bond, or bonds obligatory in the name of his Highnesse, his heires, and successors of all and every person and persons whatsoever, with sureties or otherwise for the payment of all, and singular sum and sums of money which are or shall be, or may grow due for or vpon the sale of any alum, or for, vpon, or by reason of any bargain, sale, or contract made, or to be made of, or for any other goods commodities, or things whatsoever touching or concerning the said alum mines, or alum work, or any part or parcel of the same, or touching or concerning any thing thereunto belonging, by these presents demised or mentioned to be granted as aforesaid, as to them the said William Turnor, Richard Bowdeler, and Thomas ●… ones, their executors, administrators, deputies, factors or assigns, or any of them, shall seem meet and convenient: And to detain& keep the said bonds, and every of them, in their or some of their own hands, and to demand, sue for, receive, haue, and take the full benefit, and advantage of the same, and of every of them, to ●… heir own proper use. And that the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them, shall haue full power and authority in his Highnesse name, at their pleasures to implead, sue, prosecute, all and every such person and persons, their heires, executors, administrators and assigns, which shall so become bound as is aforesaid, of, and for all and every such sum and sums of money, penalties, and forfeitures, as shall grow, or become due, or payable by reason, or means of any such bonds or writings obligatory; And also all and every person and persons, their heires, executors, administrators, and assigns, who shall by any means be found to be indebted, chargeable, or answerable to our said sovereign Lord the King, his heires and successors, or to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns, or any of them, for, or in respect of the said alum mines, or alum works, or any part thereof, or of any thing or things whatsoever concerning the same or any part or parcel thereof, And the same sum or sums of money, penalties, forfeitures, and all and every part and parcel thereof which shall bee recovered or had of the bodies, goods, lands, tenements, or hereditaments of any of them the said person, or persons, their heires, executors, and assigns, and every of them, to levy, hold, and take execution thereof to the use of the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns. And furthermore to do make, take& prosecute in such and the like maner and form as our said sovereign Lord the Kings majesty, his heires, or successors, in or by, his or their royal prerogative, power, and authority in his Highnesse, or their own proper name, or names, or any other whatsoever right or title should or might haue done if this present grant to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns, as before in this behalf made, had never been had, nor made according to the true intent and meaning of these presents. And also that these presents or the enrolment therof shall be from time to time as well to the chancellor, Treasurer, and Barons of the Court of Exchequer for the time being, and to all other the officers and ministers of the same Court, as also the Barons Iustices and ministers of his majesty, his heires, and successors, of any other Court of Record for the time being, and to every of them, and to the Attorney and counsel learned in the law of his majesty, his heires and successors, and to every of them, a sufficient warrant and full discharge, to hear, determine, sue, prosecute, levy, and make execution against all and every person and persons, their heires, executors, administrators, and assigns, by, or vpon whom any of the said sum or sums of money, penalties, or forfeitures due or paieable vpon, or by reason of any such bonds, for or concerning alum, or the said alum mines, or works, or touching or concerning any thing thereunto belonging before by these presents demised and granted, or mentioned to be demised or granted, or any part or parcel thereof be or shall be charged, due, liable, or demaundable in the name of our said sovereign Lord the King, or in the name of his Highnesse heires, executors, admi●istrators, or succ●ssors, at the pleasure of them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators or assigns, or any of them, to the proper use and behoof of them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns in maner and form, and according to the true intent& meaning of these present Indentures without any account, or other profit or thing whatsoever, to our said sovereign Lord the King his heires, executors, administrators or successors therfore to be had, paid, or done. The yearly rents or payments by these presents reserved, and covenanted to be paid, always excepted, and fore-prised. And that the said William Turnor, The Patentees may assign over bonds taken in their own names to the King, and ue out execution in the Kings name, to their own uses. Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, shall, and may from time to time during the continuance of this present grant, assign and convey unto our said sovereign Lord the King, his heires, and successors, all, or any Bonds or Obligations made or to be made, for, or vpon any bargain, sale, or contract made, or to be made, for, or concerning the said Allomes, mines, alum works, and the forfeitures, penalties, and sums of money, in the said Bonds, or Obligations, or any of them contained, and thereupon to sue and take execution in the name of our said sovereign Lord the King, his heires, or successors, against any person or persons whatsoever, their goods, chattels, lands, tenements, or hereditaments, whatsoever liable to the payments of the said sums of money, penalties, or forfeitures in the said bonds, or obligations contained, and the same sums of money, forfeitures, and penalties, to receive, haue, and take to the onely proper use and behoof of them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, in manner and form and according to the true intent, and meaning of these present Indentures, and according to the course of our Court, or Courts of Iustice without any account, or other profit or thing whatsoever to our said sovereign Lord the King, his heires, or successors, therefore to be had, paid, or done, the yearly rents or payments by these presents reserved and covenanted to be paid always excepted, authority to search, seize, make confiscate, take and carry away all Allomes brought in, and a grant therof of the Kings part to the Patentees. and fore-prised. And our said sovereign Lord the Kings majesty for his Highnesse, his heires, and successors, covenanteth and agreeth to& with the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them; That they, and every of them, their and every of their executors, administrators, and assigns, deputies, seruants and factors, shall, and may from time to time during the residue of the said one and thirty yeeres before mentioned; with a Constable of the place, or officer of our customs, respectively at their will, and pleasure, as well by night as by day go aboard, view, search, and survey every ship, vessel or bottom, riding or lying within any the ports, havens, creeks, or places of lading or unlading, within the said realms and dominions,& at all times to enter& go into any cellar, vault, warehouse, shop, or other place or places, to search& see, if any sort or kind of alum in the said ships, vessels, or bottoms, cellars, vaults, ware-houses, shops, or other places, bee, or shall bee there hidden and concealed, having been made or brought in, or shipped or laden to be transported from, or out of any his majesties said realms or Dominions, contrary to the tenor hereof, and to open any cases, casks, chests, farthels, packs, fats, or any other bulk whatsoever, wherein any alum shall be suspected to be laid up, packed or concealed; And also to seize and make confiscate, and to take and carry away all and every quantity and quantities of Allomes so found,& to be found to be made, brought into, or shipped or laden to be transported or carried from, or out of any his majesties said realms, or dominions, contrary to his majesties said pleasure, as aforesaid, all and every which said Allomes and the liquours thereof so forfeited and confiscate, his majesty doth by these presents as much as in his Highnesse is, give and grant to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, to the use of the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, deputies, factors, or assigns, without any account, or other thing therefore to his Hignesse, his heires or successors, to bee rendered, A Prohibition that none shall bring in any Allomes or use, or spend being brought in, other then the Patentees. or made for the same. And our said sovereign Lord the King, for him, his heires, and successors, doth by these presents, straightly prohibit and forbid all& every person, and persons whatsoever, other then the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, that they, nor any of them, do or shall at any time or times hereafter during the residue of the said term of one& thirty yeeres before mentioned, use, spend, or occupy within his majesties realms of England or Ireland, or either of them, or any the dominions belonging to the same, or either of them, any Allomes or any liquours of Allomes, which shall hereafter bee brought, either from or out of the realm of Scotland, or from or out of any the parts beyond the seas, into the said realms of England and Ireland, or either of them, or any of the dominions thereof, vpon pain of his majesties high displeasure, and vpon such further pains, penalties,& punishments, as by any the laws or statutes of this realm, can, or may be inflicted vpon them for their contempt and disobedience in that behalf. None shall transport Allomes brought in other then the Patentees. And also that no other person or persons whatsoever, other then the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, shall at any time or times hereafter during the residue of the said term of one and thirty yeeres, transport, convey, or carry out of any the said realms of England or Ireland, or any the dominions thereof, any Allomes or liquours of Allomes, which shall at any time hereafter be brought into the said realms of England or Ireland, or either of them, contrary to the true intent& meaning of these presents: And further, that if any Allomes at any time or times hereafter during the said term shal happen to be by any means whatsoever brought in or imported into any his majesties said Realms or dominions, last before mentioned, and shall be there sold, spent or used by any other person or persons, other then the said William Turnor, Richard Bowdeler, and Thomas jones, their exetors, administrators or assigns, or any of them contrary to the true intent& meaning of these presents: Defalcation out of the rent for all alum brought into this realm. That then his majesty, his heires and successors, shall and will defalk and allow unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators,& assigns, and it shal& may be lawful to and for them, and every of them vpon the passing of their accounts, or payments of the rents hereby reserved, and vpon such proof made of the selling, spending, or using of any such Allomes brought into the said realms or dominions, and not by him or them seized as aforesaid, contrary to the true meaning of these presents, as by the Lord Treasurer of England for the time being shall be allowed to be sufficient to defalk and detain in their own hands, and to their own use so much of the yearly rents and payments due and paieable, or covenanted to be paid unto his Highnesse, his heires or successors, by virtue of these presents, as the value of the Allomes so to be brought in and sold, spent, or used contrary to the true meaning of these presents as aforesaid, shal amount unto after the rate of five and twenty shillings the hundred weight for all such alum as shal be so brought in or imported into any his majesties said realms or dominions, and there sold, spent, or used by any person or persons, other then the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators or assigns, at any time or times before the four and twentieth day of june now next coming: And for all such alum as shall be so brought in or imported sold, spent or used as aforesaid, at any time or times after the said four and twentieth day of june now next coming after the rate of six and twenty shillings the hundred weight: and so from time to time according to such prizes as for the time being alum shall be sold for within this realm. And his majesty for him, his heires, and successors, doth by these presents will, require, and authorize the Lord high Treasurer of England for the time being, the under-treasurer, chancellor, and Barons of the Exchequer of his Highnesse, his heires and successors for the time being, to give full allowance thereof accordingly; And that these presents or the enrolment thereof, shall be a sufficient warrant and discharge as well to the Lord Treasurer, chancellor, and Barons of the Exchequer of his highnesse, his heires, and successors for the time being, as to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them, to make and haue such allowance and defalcation as is aforesaid, any thing or matter whatsoever to the contrary thereof, in any wise notwithstanding. And further our said sovereign Lord the King, for the considerations aforesaid, for him, his heires and successors of his highnesse especial grace, certain knowledge, and mere motion, doth also by these presents give and grant unto the said William Turnor, Richard Bowdeler, and Thomas jones, and every of them, their executors, administrators and assigns, and every of them: That they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators and assigns and every of them, at all times hereafter, and from time to time during all the residue of the said term of yeeres in the said first recited letters Patents granted, or mentioned to be granted, shall haue full and free liberty, licence, power, and authority to employ, hier, and set on work, all, and all maner of strangers, as well aliens as Denizens, being in league or amity with our said sovereign Lord the K. majesty, his heires& successors for the carriage, shipping, lading, transporting, and unlading of Allomes, coals, urines, and all and all maner of other matters, materials; or things whatsoever being fit or necessary, in, or about the working or making of Allomes, or the liquours thereof, or any ways or means whatsoever incident or belonging thereunto: And also that they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and all and every other person or persons whatsoever, that they or any of them shall employ, in or about the carriages or transportation as aforesaid, according to the true intent and meaning of these presents, shall and may also at all times hereafter, and from time to time during the said term aforesaid, quietly and peaceably pass by sea with all their allomes and all other their provisions of coals, urine, and all other things which shall be requisite and necessary to be used and employed in or about the making or working of the said Allomes, or the liquours thereof. Habendum. To haue, hold, and enjoy all and every the said licenses, powers, privileges and authorities, and all and singular other the premises herein before mentioned, to be hereby given, granted, assigned or set over, and every part and parcel thereof unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, from the four and twentieth day or june last past before the date hereof, for and during so many yeeres of the said term of one and thirty yeeres to be accounted from the third day of Ianuarie, in the fourth year of the reign of the Kings majesty over the realm of England, being the day of the date of the said first mentioned letters Patents, as aforesaid, as from the said four and twentieth day of june shal be behind or unexpired; to the onely proper use and behoof of them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, without any account or other thing thereof or therefore to be rendered or paid to our said sovereign Lord, the King, his heires, and successors, or any of them( otherwise then according to the true intent and meaning of these presents) and in as large, ample, and beneficial maner and form, according to the true meaning of these presents as his majesty, his heires, successors, or assigns, or any of them, may, might, or ought to haue take or enjoy the same. And as largely amply,& beneficially as his majesty may give, grant, or assign over the same, or any part thereof, any law, statute, act of Parliament, ordinance, proclamation, letters Patents, restraint,& imperfection of, or in these presents, or other thing had, or made, or to bee had, made, committed, or omitted, to the contrary of these presents, in any wise notwithstanding, yielding and paying. red. And the said William Turnor, Richard Bowdeler, and Thomas jones, for themselves, their, and every their heires, executors, administrators and assigns, and for every of them do covenant, grant, and agree, to and with our said sovereign Lord the King, his heires and successors by these presents, well and truly to pay, to our said sovereign Lord the King, his heires, or successors, at the receipt of the Exchequer of our said sovereign Lord the Kings majesty, his heires, or successors, for and in the name of the rent of the first year to be accounted, First year 5. thousand pounds. from the said four and twentieth day of june now last past, the sum of two thousand pounds of lawful money of England, at, or vpon the four and twentieth day of june next coming after the date hereof: 2. year three thousand pounds. And for and in the name of the rent of the second year, the sum of three thousand pounds of like lawful money of England in maner and form following;( That is to say) on the five and twentieth day of December, which shall be in the year of our Lord God, one thousand six hundred and ten: one thousand and five hundred pounds of lawful money of England; and on the four and twentieth day of june then next following the like sum of one thousand and five hundred pounds of ●… awful money of England; and from thence●… oorth for and in the name of the rent of every ●… eere, for and during the term of five yeeres, ●… hen next ensuing after the said first year, and ●… econd year, lastly above mentioned, 11000. li. per annum, during five yeeres. the ●… eerely sum of eleven thousand pounds ●… eerely of like lawful money of England, ●… t two daies or times in every of the same ●… ue yeeres by equal portions, that is to say, ●… t and vpon the five and twentieth of Decem●… er, and the four and twentieth day of june, ●… nd then and from thenceforth from and af●… r the end and expiration of the said five yeers ●… st mentioned, for the rent of every year of ●… he then residue to come and unexpired of the ●… id term of one and thirty yeeres, 10000. li. per annum, after seven yeeres. the yearly ●… mme of ten thousand pounds yearly of like ●… wful money of England, at two daies or times ●… n every year by even and equal portions: That is to say, at and vpon the five& twentieth day of December, and the four and twentieth day of june by even and equal portions, yearly to be paid, at the place aforesaid: provided always, and it is covenanted, granted, condescended, and agreed by and between the said parties, to these presents: That if the said several yearly rents, proviso to sequester, for non payment of rent. and sums of money by these presents reserved, or covenanted to be paid to our said sovereign Lord the King, his heires or successors, or any of them shall happen to be behind, unpaid, in part or in all, by the space of forty daies next after any of the daies aforesaid, in which the same ought to be paid, during the residue of the said term of one and thirty yeeres, before, in, and by these presents granted or mentioned as aforesaid: That then, and so often it shall and may be lawful to& for our said sovereign Lord the King, his heires, and successors, to sequest●r, and expel the said William Turnor, Richard Bowdeler,& Thomas jones, their executors, administrators, deputies, assigns, and every of them, of and from the possession and receipt of all and singular the premises by these presents granted, and the same to resume and take again into the hands of his Highnesse, his heires, and successors, until all and every the arrearages, of the same yearly rents or sums of money by these presents reserved, or agreed to be paid to his majesty, his heires, or successors, shall bee unto his Highnesse, his heires, or successors, well and truly paid, or otherwise actually and truly to his majesty, his heires, and successors, out of the profits of the same, remaining in the hands of his Highnesse, his heires and successors, shall bee truly answered and paid. The Patentees to re-enter after payment. And that yet nevertheless from and immediately after full payment of the same arrearages of the same rents or sums of money, and not before, it shall and may be lawful to, and for the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns to haue again, and repossess the premises to them by these presents granted, according to the true intent and meaning of these presents: The Kings charge to all Officers. And our said sovereign Lord the King intending that this present grant, and the covenants therein contained, shall take the better effect, doth by these presents of his especial grace, certain knowledge, and mere motion for his Highnesse, his heires, and successors, straightly charge and command all and all maner of Officers, clerks, Ministers, makers and keepers of the entries of ships and shippers, and other officers, clerks and Ministers whatsoever to whom it shall appertain: That they, and every of them shall quietly permit and suffer the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and their deputies, and factors, and every of them to see, and haue and at their wils and pleasures to make, and take at all times, from and after the date hereof true copies of all entries of ships, and Shippers, entries within any the Ports, havens, creeks, and places of lading, and unlading, and the members of the same, or to them, or any of them, belonging within his majesties, realms and dominions for the certainty, and content of al maner of alum, which shall be arrived, shipped or brought to be discharged, or which shal be shipped, or laden to be transported contrary to the Orders in that case provided, or contrary to his majesties proclamations lately published for the general and absolute prohibition and forbidding of the bringing in of alum into the same his majesties realms and dominions, and contrary to the true intent and meaning of these presents: And that no Customer, Collector, controller, Searcher, or other officer or minister of the customs,& Imposts, shal take or receive any entry, or entries, or suffer any entry or entries to be taken, or any composition to be made directly, or indirectly for the custom, Subsedie, or Impost of any parcel or quantity of alum, to be brought in, or carried out as aforesaid, nor shall by any means give any warrant, or in any maner give toleration, or sufferance for the lading or transporting of the same: And that all the Key-keepers, and keepers of Wharfes, or other places, of, or within these Realms& dominions aforesaid, or any the Ports, havens, or Creeks of the same, from time to time during the continuance of this present grant, shall not suffer any parcel, or quantity of alum brought from any the parts beyond the seas as aforesaid, to be landed, or discharged, and laid on land at any key, wharf, or place within their several charge. And that no ship or other vessel whatsoever, which during this presents grant shall arrive, and come into any part of his majesties said realms, or dominions from any the parts beyond the seas laden, or fraughted with alum, more or less, shall be suffered to discharge by Lighter or otherwise, any alum whatsoever, or to come or to fall unto any Key or wharf whatsoever to discharge and unlade any part of her said lading, before such time as the keeper of every such Key, or wharf from time to time hath given notice therof unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, and administrators, deputies, seruants, or factors, or any of them, and shall haue order, and command from them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors or administrators, or from some or one of them, for the landing and disposing of the alum so brought in as is aforesaid, vpon pain of our displeasure, and of such pains, penalties, punishments, and imprisonments, as by any laws, or statutes of this realm, can or may be inflicted vpon them for such their offences committed, contrary to the said orders, and Proclamation, and contrary to the true meaning of these presents. And that no Water-man, mariner, or other person or persons, shall carry, receive, or convey, any maner of alum, from, or out of any ship or vessel, contrary to the said orders and proclamation aforesaid, or any of them, and contrary to the true intent and meaning of these presents, vpon pain of imprisonment, and of his majesties indignation and displeasure, and of such further punishments as by the laws of this realm of England may be inflicted vpon him or them so offending for such their contempt. A warrant and charge to al Officers to aid and assist the Patentees in this behalf. And our said sovereign Lord the King of his further especial grace, certain knowledge, and mere motion, doth for his Highnesse, his heires and successors, straightly charge and command, as well all and every Iustices of Peace, Maiors, Sherriffes, Constables, bailiffs, Headboroughs, and other officers, of, and within all and every city, borough town, or place, within his Highnesse realms and dominions: And all and every the Customers, controllers, Searchers, and other the officers& ministers of his Highnesse, his heires, and successors, within any the said ports, havens, Crekes or places whatsoever: As also all and every the officers, and ministers which now haue, or at any time during this present grant, shal haue any office, or authority from or under the jurisdiction of the Lord high admiral of England, for the time being, that they, and every of them shall from time to time during the said term by these presents granted, be aiding and assisting to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them, and to their and every of their factors, deputies, and seruants, in the due execution of all, and singular the premises, according to the true intent and meaning thereof, for the most benefit of the said William Turnor, Richard Bowdeler, and Thomas jones, their excutors, administrators, and assigns, their and every of their deputies, and factors, in as beneficial and diligent wise, order, degree, and maner whatsoever, as they, and every of them, should, or ought to haue been to our said sovereign Lord the King, his heires, and successors, by any maner of means, if this present grant had not been had or made, vpon pain of his majesties indignation, and displeasure,& under such pains, and penalties by fines, imprisonments, or otherwise as by the laws and statutes of this realm, or by his majesties prerogative royal, can or may be inflicted vpon them, or any of them, for their negligence, or contempt in that behalf. The King will not discharge the alum forfeited. And our said sovereign Lord the King of his farther especial grace, certain knowledge, and mere motion doth for his Highnesse, his heires, and successors, covenant, grant, and agree to and with the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them, by these presents: That our said sovereign Lord the King, his heires, or successors, shall not, nor will, at any time hereafter during the term, in, and by these presents granted, pardon, release, or in any sort discharge any alum so forfeited, or any penalties or duties, due for the same, nor shall or will at any time or times disannul, revoke, or countermaund the said authorities, licenses, or liberties herein before especially mentioned, or granted, for and concerning the sole and onely making of Allomes, and the liquours thereof, nor make or grant any other licence, or toleration whatsoever to any other person, or persons whatsoever, for or concerning the making of alum within his majesties said realms and dominions, or any of them, or for or concerning the bringing in of alum, from any foreign parts into his Highnes said Realms and dominions, or any of them or the transporting or carrying of alum from or out of the same realms and dominions, or any of them, contrary to the true meaning of these presents; Nor shall command, do, or execute, or cause to bee commanded, done, or executed any other act, or acts, thing, or things, whatsoever, whereby, or by means whereof any decay or hindrance shall grow or happen, of, or in the said sole and onely making of Allomes, or the liquours thereof, or of the said prices of the said Allomes, or of any part thereof, or whereby, or by means whereof, they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, or any of them, shall not, or may not take the full and whole benefit of these presents, according to the true intent& meaning hereof. If the King shall not perform these grants and covenants vpon declaration, &c. the Patentees shall haue recompense by defalcation out of their rent. And our said sovereign Lord the King, for him his heires, and successors, doth further covenant, promise and grant, to and with the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns by these presents; That if our said sovereign Lord the King, his heires, or successors, shall do, or cause to be done, or witting suffer, or permit to be done, any matter or thing whereby, or by means whereof the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators or assigns, shall be restrained, hindered, or barred from the enjoying, or having of any benefit, profit, privilege or liberty, which by and according to the true intent& meaning of these presents, and according to the covenants, grants, or agreements in these presents mentioned, and of the part and behalf of his majesty, his heires and successors, they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, ought to haue and enjoy: That then in such cases vpon declaration made by them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators or assigns, or any of them unto the Lord Treasurer of England, and chancellor of the Exchequer of his majesty, his heires, and successors for the time being, of the losses, damages, and hindrances which they, or any of them shall receive for want of due performance of any the said grants, covenants, promises, or agreements, on the one part of his majesty, his heires or successors to be performed, observed or kept, and such proof made thereof as by the said Lord Treasurer and chancellor for the time being, shall be allowed to be sufficient, that then and in such cases, the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, shall from time to time haue recompense and satisfaction, for and in respect of all and every such their said losses, damages and hindrances, by defalcation of so much money out of their yearly rents then next paieable unto his majesty, his heires, or successors, for, or in respect of the premises: As by the said Lord Treasurer, and chancellor of the said Exchequer, for the time being, shall be thought fit and reasonable. And his majesty doth by these presents for him his heires, and successors, charge and command the Treasurer and chancellor of the said Exchequer for the time being, from time to time to make deduction,& defalcation unto them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators and assigns accordingly: And these presents or the enrolment thereof, shall bee from time to time unto the said Treasurer, and chancellor of the said Exchequer, for the time being, a sufficient warrant and discharge in that behalf. The covenant for the ways. And further his majesties will and pleasure is; And his majesty doth by these presents of his especial grace, certain knowledge, and mere motion, for his Highnesse, his heires, and successors, grant unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them by these presents, that they, and every of them, their, and every of their seruants, deputies, and ministers, which are or shall be used or employed in, for, or about the said alum works, or Allomes, or the businesses of the same, shall and may at all times hereafter, during the continuance of these presents, grant, haue, and enjoy sufficient way-leaue and stath-leaue, and free egress, regress, way, and passage, and power, liberty, licence, and authority to go, pass, stay, or abide with their, and every of their Carts, wanes, Carriages, and otherwise, in, by, and through all place and places, meet and convenient within his majesties said realms and dominions, and and every of them, without let, denial, or interruption. And that neither they the said William Turnor, The Patentees& their partners to be freed from service. Richard Bowdeler, and Thomas jones, and their partners, or any of them, their, or any of their executors, administrators, assigns, seruants, deputies, and ministers, or any of them, nor their, nor any of their goods, cattle, or carriages, shall at any time hereafter be charged, or taken to service, or for any services or use of or for his majesties, his heires, or successors, whereby, or by means whereof, the said works, or any of them, shall, or may be in an wise letted or hindered: But for the better furtherance& aduancement of the said works; To take carriages. The Kings majesty doth also further of his especial grace, certain knowledge, and mere motion, charge and command all Iustices of Peace, Maiors, Sheriffes, bailiffs, Constables, and other his majesties officers, and ministers whatsoever, to whom in that behalf it shall or may appertain, That they, and every of them, shall, and do from time to time, do their best endeavours, furtherances, and assistances, for, and on the behalf of the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, deputies, factors, and assigns; That they may from time to time, and in all places, be furnished and provided of all such, and so many carts, wanes, ploughs, Teames, and other ways for carriages, as shall be fit, convenient, and necessary to be employed, used, or occupied, in, or about the said alum works or houses aforesaid: The said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, seruants, or assigns, paying such rates, prices, or wages, for the same as by the said Iustices and other officers shall be thought reasonable and convenient; And to the end that the said William Turnor, Richard Bowdeler, To be freed from bearing Offices. and Thomas jones, their, and every of their executors, administrators, partners, deputies factors, agents, seruants, and assigns, may the more freely, and with the greater liberty, employ their whole endeavours, in and about the working and making of the said Allomes, and the liquours thereof, during all the residue of the said one and thirty yeeres before mentioned: We do by these presents, of our especial grace, certain knowledge, and mere motion, give and grant, to the said W●lliam Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, Partners, deputies, factors, agents, seruants, and assigns, and to every of them, That they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, Partners, deputies, factors, agents, seruants, and assigns, and every of them, at all times hereafter, and from time to time, from and after the day of the date of these presents, for and during so long time of all the residue of the said one and thirty yeeres before mentioned, as they or any of them shall be interested in, or employed in or about the said Allomes, or alum works, shall not be called nor compelled to use, exercise, or serve in any public or private office, or other service, either to us, or to our heires, or successors, without the con●… ent, and good liking of him, or them that shal ●… r may be so called; But shall be free, and free●… y acquitted, exonerated and discharged, of, and ●… rom the bearing, executing, or undergoing, of ●… ll, and all maner as well of public, as private, Office, and Offices, place, function, or service, ●… hatsoeuer, either to us, or to our heires, or suc●… essors, or in any public, or private Office, ●… eruice, and employment, whatsoever, in the Common-wealth: saving onely, and except ●… such Offices, services, and employments, as are ●… nd hereafter shall be fit and necessary to bee ●… xercised, and used in and about the working ●… nd making of Allomes, or the liquours there●… f, or, in, or about such other necessary imploi●… ents touching or concerning the same. covenants to discharge his majesty of all paiements and charges &c. in the Articles quadripartite. Turnor, Richard Bowdeler, and Thomas jones, their executors or administrators, shall before the end and expiration of two yeeres and a half next after the date hereof, erect and build so many alum houses, more within the realms of England or Ireland, or the dominions of the same, as with those already erected will be sufficient for the making of the quantity of two thousand tons of alum yearly at the least. And for that his Highnesse out of his Princely care of his subiects good, Price of Allomes. will not admit the price of alum spent within his majesties dominions, to be by this means enhanced: The ●… aid William Turnor, Richard Bowdeler, and Thomas ●… ones, do covenant, grant, and agree for them●… elves, their executors, administrators, and as●… gnes, and every of them, W. Turnor &c. their covenant for the quantity of Allomes. to and with our said ●… oueraigne Lord the King, his heires, and suc●… essors by these presents: That they the said William Turnor, Richard Bowdeler, and Th. jones, their executors, administrators, and assigns, shall and will from time to time during all the now residue to come of the said term, haue in their custody, in known warehouses, or cellars within the city of London at all times, the quantity of one hundred tons of good, serviceable, and merchantable alum. And that from the said warehouses, or cellars all persons residing within his majesties Dominions, shall and may freely and at their pleasure, buy and haue thereof for five and twenty shillings of lawful money of England the hundred weight, from the day of the date hereof until the said four and twentieth day of june now next ensuing. And from, and at, all times after the said four and twentieth day of june next coming during the residue of the said one and thirty yeeres last mentioned, for and at the rate of six and twenty shillings of lawful English money the hundred weight as aforesaid: And so after that rate for any greater or lesser quantity without any farther or other cha●ge or payment, unless his majesty, his heires, o●… successors, shall at any time hereafter think●… fit and suffer them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, to sell alum to be spent within his majesties dominions, at any higher price, then is herein before expressed; And then in such case for and at such higher price, as his majesty, his heires, or successors, shall so think fit, and suffer alum to be sold for, and not otherwise; And to that intent the said William Turnor, Richard Bowdeler, and Thomas jones, do also covenant, grant, and agree for themselves, their heires, executors, administrators, and assigns, and for every of them, to and with our said sovereign Lord the King, his heires, and successors, by these presents: That if his majesty, his heires, or successors, shall at any time hereafter think fit, and shall licence and suffer the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, to sell alum to be spent within his majesties dominions, at any higher price then is herein before expressed, and shall cause the same to be signified unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, and Administrators, under the hand of the Lord Treasurer of England for the time being in writing: That then, and from thenceforth, and for so long time, onely as they shall be so suffered, or licenced, to sell at any higher price, they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns shall pay yearly unto his majesty, his heires or successors, so much good and lawful money of England, as shall be at any time raised, improoued, and advanced by reason of such signification given, as aforesaid, above the prices, before limited. And shall pay the same vpon due account at such place and daies as in these presents are formerly mentioned, for the other payment to be made unto his Highnesse as aforesaid, And that they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns, or any of them, or any other person or persons, for them or any of them, shall not at any time or times hereafter, during the now residue to come of the said one and thirty yeeres last before mentioned, receive nor take from the day of the date hereof unto the four and twentieth day of june now next ensuing, above or any more then five and twenty shillings of lawful English money for one hundred weight of alum, and so after that rate, nor from and after the said four and twentieth day of june next ensuing after the date hereof above, or any more then six and twenrie shillings of lawful English money for one hundred weight of alum, by them sold to be spent and used within his majesties said dominions, and so after that rate for a greater or lesser quantity( foreign alum being at this time near about the same price) unless the pleasure and allowance of his majesty, his heires and successors, of some greater or higher price, shall under the hand of the Lord Treasurer of England for the time being be signified unto the said William Turnor, Richard Bowdeler, and Thomas jones, or the suruiuers or suruiuer of them, their, or any of their executors, and administrators, for the same as aforesaid. And to the intent that the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns, may furnish the realm of Scotland from time to time with allomes made in England, Scotland, or Ireland, or some of the dominions of the same, and not be hindered or damnified by the importation of foreign Allomes, or the liquours thereof into his Highnesse said kingdom of Scotland, or any the dominions thereof, Our said sovereign Lord the King willeth and granteth by these presents; And the said William Turnor, Richard Bowdeler, and Thomas jones, for them, their heires, executors, administrators, and assigns, do covenant, promise, and grant, to and with our said sovereign Lord the King, his heires, and successors by these presents: That they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, or assigns, shall and will from time to time, and at al times, from and after the four and twentieth day of june next coming after the date hereof, provide and procure at their own costs and charges, that there shall be and remain in readiness at all times, and from time to time during the residue of the said term of one and thirty yeeres within some convenient storehouses or other places within his majesties said kingdom of Scotland, fit and commo●ions for the access and repair of his majesties said subiects of Scotland; and not far from the city of edinburgh, so many tons of good merchantable alum made within his majesties said kingdom of England or any other his majesties kingdoms or dominions; as by the privy counsel of our said sovereign Lord the King, his heires, or successors of the said kingdom of England for the time being, or any three or more of them, whereof the Lord Treasurer of England for the time being to be always one, shall from time to time be ordered, appointed, and commanded, and the same Allomes to be from time to time uttered& sold, to all, or any of his majesties said subiects of his said realm of Scotland, for the use of the said realm of Scotland, at such low and under prices as by the said privy counsel of his majesty, his heires, or successors of his said kingdom of England, or any such three or more of them as is aforesaid, shall from time to time be limited, set down, and appointed, which prices his majesties will and pleasure is, shall be from time to time so low, and under the prices for which like Allomes brought from beyond the seas thither, can be sold or uttered for, as that marchants and others may be discouraged and forbear to bring any Allomes into the said realm of Scotland. And his majesty doth further, for him his heires, and successors, covenant, promise, and grant, to and with the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, by these presents, That they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, shall from time to time during the residue of the said term of one and thirty yeeres, haue defalcation, allowance, and deduction out of the yearly rents, sums of money and paiements, by these presents, reserved of so much money as shall make up every hundred weight of Allomes which shall be so sold in the Realm of Scoland by the direction, and appointment of the said privy counsel of his majesties said kingdom of England, to be of the full value and price of six and twenty shillings for every such hundred weight. And that these presents, or the inrolements, or exemplifications thereof shall be from time to time as well to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, and administrators, to retain, hold and keep in their own hands as to the Lord Treasurer and chancellor of the exchequer of his majesty, his heires and successors for the time being, from time to time, to make defalcation and deduction therof, accordingly out of the said yearly rents, sums of money and payments, before by these presents reserved: And his majesty doth further by these presents, for him, his heires, and successors, covenant and grant, to and with the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns: That if any allomes or liquours of allomes shall at any time or times during the residue of the said term of 31. yeeres before, in, and by these presents, granted, or mentioned to be granted, be brought from any the parts beyond the seas, into the said realm of Scotland, or any the dominions or parts thereof,& shall there be uttered, sold, or spent, that then vpon such proof made of the importation, selling, uttering, or spending of any such foreign allomes within the said realm of Scotland; as by the Lord Treasurer of England, a●d chancellor of his majesties exchequer shall be allowed under their seals to be sufficient, they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, shall and may haue, keep, and retain in their own hands: And our said sovereign Lord the King, for him, his heires, and successors, doth will and command the Lord Treasurer of England, and chancellor of the exchequer for the time being from ●●●e to time to deduct and allow unto them the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, so much money out of the rents and sums of money by these presents reserved and paieable as aforesaid, as may countervail and recompense the losses and hindrances which they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, shall receive in respect that they or any of them shall and may sell and utter the less there. And that these presents shall be as well unto the said Lord Treasurer of England and chancellor of the exchequer for the time being: As also to the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, a sufficient warrant, exoneration, and discharge in that behalf. And furthermor●, our said sovereign Lord the Kings majesty, of his especial grace, certain knowledge, and mere motion, for him his heires and successors, doth promise and grant to and with the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, by these presents; That in case at an● time or times hereafter, during the residue of the said term of one and thirty yeeres, there shall happen any war, hostility, restraint, prohibition, or great and important impediments, of trade or intercourse of merchandise to rise, grow, or continue in foreign parts, or within his majesties said dominions, by reason whereof the trade and intercourse for the said Allomes so to be made within his majesties said Dominions shall be diminished, letted, or prohibited: That then in such case, from time to time, it shall and may be lawful to and for the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators and assigns, and every of them vpon notice of their, or any of their intention and determination in that behalf to be given to the Lord Treasurer of England for the time being under their, or any of their hands and seals in writing, to relinquish and forbear to make or work all or any Allomes, or the liquours thereof by force and virtue of these presents, to or for their own use, or to transport or carry by force or virtue of these presents, any Allomes, or the liquours thereof into any the parts beyond the seas, to or for their own use for the term of one or more whole year or yeeres, of the residue of the said term of one and thirty yeeres, before by these presents mentioned to be granted, the year or yeeres to begin from any feast of the nativity of Saint John Baptist, during the residue of the said term of one and thirty yeres before by these presents mentioned to be granted as to them or any of them from time to time s●all seem good. And that then the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, for and during such and so much of the residue of the said term of one and thirty yeeres, before by these presents, mentioned to be granted. As they the said William Turnor, Richard Bowdeler, and Thomas jones, and either of them, their, or either of their executors, administrators, or assigns, shall after such notice made, so relinquish and forbear the said making and working of Allomes, and the liquours thereof within the said realms of England and Ireland, or either of them, and the dominions thereof, to their own use, and shall also forbear the transportation of any allomes, or the liquours thereof out of the said realms of England and Ireland, and the dominions thereof, to or for their own use, stand and be acquitted and discharged by and against our said sovereign Lord the King, his heires and successors, of and from the payment of the said yearly rents or sums of money, by these presents, reserved or agreed to be paid for and during such whole year or yeeres as aforesaid, and no longer, as ●hey the said William Turnor, Richard Bowdeler, and Thomas jones, their excutors, administrators, and assigns, and every of them, from and after such notice given as aforesaid, shall relinquish and forbear to make any such Allomes or the liquours thereof to their own use, and to transport the same or any part thereof into any the parts beyond the seas, by virtue of these presents, to and for their own use; And yet nevertheless, his majesty is pleased and contented. And the said William Turnor, Richard Bowdeler, and Thomas jones, for them, and every of them, their, and c●erie of their executors, administrators, and assigns, do covenant and grant by these presents to and with our said sovereign Lord the King, his heires and successors, that they the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, and every of them, after such relinquishment and forbearing, and during the time of such hostility, prohibition, restraint, impeachment or stay as aforesaid, shall and will at the only cost and charges of our said sovereign Lord the King, his heires, and successors, well and truly make and work for the onely use and behoof of our said sovereign Lord the King, his heires and successors, within the said realms of England and Ireland, and the dominions thereof, such and so much quantity of good and merchantable Allomes, and the liquours thereof, as may and shall serve for the expenses and use of the said kingdoms of England and Ireland, and the dominions thereof. And also for transportation as in former yeeres ( communibus annis) shall haue been used,& the same to utter and sell for the use of his majesty, his heires, and successors, at and for such prices as by the privy counsel of his majesty, his heires and successors, shall in that behalf be from time to time directed, and shall also half yearly at all times during the continuance of such warres and hostility, prohibition or restraint of intercourse and trade, yield up to the Kings majesty, his heires, and successors, before the Barons of the court of exchequer, for the time being, vpon their corporal oaths, a just and true view of account, and a just& true account as well of all such benefit, profit, and commodity, as shall arise, grow, or come of or by reason of all or any Allomes or the liquours, thereof, so by them the said William Turnor, Richard Bowdeler, and Thomas jones, or any of them, their or any of their executors, administrators, deputies, factors, seruants, or assigns, to be made and wrought within the said realms of England and Ireland, or the dominions thereof, to be spent or used within the same. As also of all such Allomes, and liquours thereof, as shall from time to time during the time of such relinquishment be transported out of any the said realms of England and Ireland, or either of them, or any the dominions of the same, into any the parts beyond the seas, as also of all other profit and benefit whatsoever, that shall any way be made, and which should haue acrued ●o the said William Turnor, Richard Bowdeler,& Tho. jones, their executors, administrators, and assigns, if such relinquishment had not been, and the money thereupon arising coming or growing to be due over and above the sum or sums of money in and by the said recited Indenture quadrupartite before mentioned to be paid by our said sovereign Lord the King, his heires and successors, then being in their or any of their hands, or which they or any of them haue received, shall yield, satisfy and pay into the receipt of the said exchequer at the times and feasts in which the rents or sums of money before in and by these presents are mentioned and reserved to be paid as aforesaid, And that if the said William Turnor, Richard Bowdeler, and Thomas jones, or either of them, their, or either of their executors, administrators, or assigns, shall at any time after such relinquishment, or forbearing, as is aforesaid, under their or any of their hands& seals in writing, give notice unto the Lord Treasurer of England for the time being, that they, or any of them shall and will make& work allomes, and the liquours thereof for their own use according to the former grants, covenants, and articles before in these presents mentioned, and also transport the same without payment of any subsidies or custom, as by the said former grants and covenants before in these presents mentioned they may lawfully do; That then and from thenceforth it shall and may be lawful to and for the said William Turnor, Richard Bowdeler, and Th. jones, and either of them, their& either of their executors, administrators,& assigns to make& work Allomes to their own use and also to transport the same or any part therof without payment of any custom, subsedie or other duty, in as ample maner as by any former grants, covenants, promises or articles before in these presents mentioned, and according to the purport and true meaning of the same, they may and ought to do during the residue of the said term of one and thirty yeeres before by these presents mentioned, to be granted to the said William Turnor, Richard Bowdeler, and Thomas jones, under their reservations, couennants, grants, articles, and agreements, in these presents contained, so always as the said William Turnor, Richard Bowdeler, and Thomas jones, or either of them, their, or either of their executors, administrators, or assigns, shall after such notice as is above mentioned, account the beginning of their or any of their continuance of their or any of their making or working of the said Allomes or the liquours thereof, to their own use and transportation thereof, without payment of subsidies, custom, or other duties from some feast of the nativity of Saint John Baptist which then shall happen during the residue of the said term of one and thirty yeeres, before by these presents mentioned to be granted: And furthermore his majesties will and pleasure is, and his majesty of his more especial grace, certain knowledge, and mere motion, for him his heires, and successors, doth by these presents require, and charge and command as well the Lord chancellor, or the Lord Keeper of the great seal of his majesties realm of England for the time being; The chancellor or Keeper of the great Scale of his realm of Ireland for the time being, and also the chancellor of his duchy of Lancaster for the time being, and every of them, that they, and every of them do make, or cause to be made unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns, such, and so many several letters Patents, duplicates, constutes, and exemplifications, under the several great seals of his majesties said realms of England and Ireland, and either of them, and under the seal of his majesties said duchy or county Palatine of Lancaster, of and concerning all and singular the grants, articles, matters, gifts, authorities, liberties, and things in these presents contained to be had, taken, executed, and performed in his majesties said realms and dominions, and every of them, as they or any of them shal require. And that these presents or the enrolment therof shal be as well to his majesties said Chauncelors of his said realms of England and Ireland,& either of them, as to his said chancellor of his duchy of Lancaster, a sufficient warrant& discharge in that behalf, without any further or other warrant from his Highnesse, his heires or successors, to be in that behalf had and procured or obtained. And moreover our said sovereign Lord the King of his especial grace, certain knowledge, and mere motion, doth for his Highnesse, his heires& successors, grant unto the said William Turnor, Richard Bowdeler, and Thomas jones, their executors, administrators, and assigns: That these presents or the enrolment of the same, shall stand and be in all and every thing firm, strong, sufficient, and effectual in the Law, to and for all respects, purposes, constructions, and intents, for and against his majesty, his heires and successors, as well in all Courts as elsewhere within his Highnesse realms and Dominions, without any other confirmations, licenses, or tolerations, from his majesty, his heires, or successors, hereafter in any wise to be procured, had, or obtained. In witness whereof to the one part of these present Indentures remaining with the said William Turnor, Richard Bowdeler, and Thomas jones, our said sovereign Lord the King hath caused the great seal of England to be put. And to the other part thereof, remaining with our said sovereign Lord the King, the said William Turnor, Richard Bowdeler, and Thomas jones, haue put their seals.
