THE CASE OF Peter Fagan of Feltrim. RIchard Fagan( Brother to the said Peter, and under whom he claims) is proved by the Queen's Warrant for Reversal of his Out-lawry( grounded upon the Cases having been examined by Sir George Treby then Attorney General) to have quitted his Command of an Old Company, pursuant to their Majesties Declaration of the 22d. of February 1688, and to have retired to his Habitation, and to have lived Inoffensively( without re-taking any employment, either Civil or Military) till he was murdered Aug. 1690, by Rapparees in the English Quarters, for Owning Their Majesties. All these particulars are also farther proved by Affadavits Viva voice, lately taken before Judges and Masters of Chancery in London, which Affadavits, together with the above mentioned Warrant, are annexed to the Report made by the Trustees here. His being However contrary to Law, Justice and Reason outlawed after Death, is proved by the Certificate of the Proper Officer of Ireland( who is now in Town) and the same is acknowledged by the Trustees, and the Certificate annexed to their Report. And this Groundless and Illegal Out-lawry standing Unrevers'd, the said Peter Fagan can have no Relief, but by Humbly applying( as he now doth) to the Justice and Compassion of the honourable the House of Commons, for the Reversal thereof.
