BY THE KING: A DECLARATION. JAMES R. WHEREAS We have issued Our Proclamation of 21th day of January last past, for the encouragement of Tillage and Husbandry, wherein among other things conducing thereunto, We have declared that We would give directions unto Our Commissioners of Our Revenue to set all such Lands as are now in Our disposal, to such as will bid fairest for the promoting of Tillage, and increase of Corn and Hay; And whereas we are informed that several abuses have been committed in disposing of, embezzling, and concealing the Stocks, and other Goods and Chattels forfeited to us in the several parts of this Kingdom by Absentees and Attainted persons, and by detaining and concealing several Horses pretended to be seized upon for the use of our Troops. We have therefore thought fit hereby to publish and declare, that our Will and Pleasure is, that three of our said Commissioners of our Revenue, shall forthwith go into the several Counties of Wexford, Kilkenny, Tipperary, Waterford, County of the City of Waterford, County of Cork, and County of the City of Cork, County of Lymerick, and County of the City of Lymerick, Counties of Kerry and clear, Kings-County, County of galway, and County of the Town of galway, Counties of Mayo, Sligo, Roscommon, Longford, and Leitrim; in all which Counties they are to make diligent Enquiry after such Lands and Tenements as are forfeited to, or vested in us by the Absence or Attainder of any person or persons whatsoever, and to set the same during Our Will and Pleasure, and no longer, wherein they are to give the pference to such Reprizable persons as have lost their late Estates by the late Statute of Repeal, and to set them no more than Lands of equal value with what they are to be Reprized for, wherein they are to tie them to such Covenants for Hay and Oats, and for sowing of Hemp and Flax as the case will require, and to reserve upon them but a fourth part of the full improved Rents above Subsidies and Taxes: And where our said Commissioners shall find that any people have entred upon any such forfeited Lands without just Title, they are to dispossess them, and set the same to our use. And our further Will and Pleasure is, that the said Commissioners shall in the said several Counties make diligent Enquiry after all Goods forfeited to us as aforesaid, and after all Horses seized upon pretence of our Service, and not actually delivered in for the use of our Troops, wherein if any person whatsoever will discover any such forfeited Goods not already discovered, or any Go●●s that have been seized, and afterwards stolen or embezzled, or where any such Goods have been bought in trust for the persons concerned in such seizures, or sold by them to any their Friends at apparent under valves, or where they exchanged the Stocks or Goods seized for other cattle of a worse sort, for the benefit of themselves or their Friends and where they find any Horses Seized, and not brought to Our Service, or discover any Debts, not already Discovered, and not remaining on Record in all such and the like Cases, the said Comm●●●ioners are to give a Fourth part of the Party discovering, which they are to Pay him in money, or allow it him in specie at his Election( except where Serviceable Horses are Discovered in which Case they are to pay him the Fourth part in value) and where any Information is Given in this behalf against any Officers of Our Army. Our Will and Pleasure is that the said Commissioners do Summon them to appear before them, in order to proceed against them as against others, But in Case such Officers do not appear, then the said Commissioners are to proceed and Return the Records of their proceedings into Our Court of Exchequer to the intent that Process may Issue thereupon in due time against the Body, Goods, and Lands of such Officers; And Our further Will and Pleasure is that the other Three of Our said Commissioners of Our Revenue shall forthwith proceed in setting of Forfeited Lands, and inquiring after Forfeited Goods, and after Horses Seized to Our use, and not brought into Our Troops as aforesaid, according to the methods and rules aforesaid In all other parts of this Our Kingdom, wherein the Forfeited Lands of all the said last mentioned parts of Our said Kingdom, are to be set in Our City of Dublin according to the aforementioned methods; And Our further Will and Pleasure is that Our said Commissioners shall diligently inquire after the Estates of the Earls of Thomond and Kildare and likewise of Minors and of such Absentees as have not Forfeited their Estates by attainder or otherwise and bring the Agents or Receivers who intermeddle therewith, to an account, and likewise to settle the said Estates in such manner as that the Issues and Profits thereof may be answered to us during such absence wherein as we do not intend to withdraw Our Former Grace and Favour from any of the said persons, so we Conceive it is for their advantage, as well as for the Common good at this time, that we should cause Care to be taken of their said Estates, and the Profits thereof, to be employed for the public Defence: And Our further will and pleasure is that the said Commissioners shall give public Notice of the times of their sitting, and that all Sheriffs and other Officers shall be Aiding and Assisting to them in the Execution of these Our Commands.
