OUR sovereign LORD having Considered the following Additional Articles of Regulation concerning the Session, Approves, and Ordains the same to be put to Execution, and to have the full Force, Strength, and Effect, comform to the late Act of Parliament made thereanent: And Ordains the same, together with this Approhation, both Superscribed by His Royal Hand, to be Recorded in the Books of Secret Council, and Session, and thereafter Published and Printed, that none pretend Ignorance. ADDITIONAL ARTICLES OF REGULATION CONCERNING THE SESSION. WILLIAM R. THE Commission Appointed by His Majesty for Regulating of Judicatories, comform to the Act of Parliament, in the first place for the further Explanation of the Twenty fourth Article of the saids Regulations, beating date the 29th. of April 1695, Anent the Signing of Abbreviats of Adjudication by the Pronouncers thereof, at the time of the Pronouncing the same; Considering that the saids Abbreviats must be Prepared and made Ready by the Clerks: They think fit, that for Preparing and Writing thereof, there be Allowed to the Clerk of the Process, fourteen Pence per Sheet, to be payed in by the Party Pursuer, to the Collector Appointed by the saids Articles, after the Manner, and for the Uses, as the other deuce mentioned in the saids Articles, are Ordered to be payed in. 2. That the Recorder, for Recording the saids Abbreviats, shall have, and may take forty Shillings Scots only, if the Abbreviats be Contained within two Sheets; and four Pounds Scots and no more, as was Appointed of before for Allowances, if it exceed two Sheets, how many Sheets soever it exceed the same. And that notwithstanding, by the foresaids Articles of Regulation already Published, forty Shillings Scots be only Allowed for Recording of Abbreviats, without Distinction. 3. That albeit formerly there was no Allowance in the Case of Adjudications, proceeding on Decreets cognitionis causa; And that the saids Abbreviats be Appointed in Place of former Allowances. Yet it is thought fit and Ordained, that hereafter, there be Abbreviats of all Decreets of Adjudication, as well of these proceeding on Decreets cognitionis causa, as of these come in Place of Apprysings, without Distinction; And that they be Recorded within sixty Days, and expede at the Rates, and with Certification comform to the Act of Parliament anent Allowances. 4. That for the greater Security and Satisfaction of the Parties Concerned, albeit Abbreviats fall to be Written a-part, and Subscribed before the Extracting of Decreets; Yet if any Party shall Desire the said Abbreviat to be Written upon the Back of his Decreet the same shall be done, if the Decreet shall be Extracted, and the same Desired within twice sixty Days after the Date of the Pronouncing thereof; And the same Lord Ordinary, who Signed the first Abbreviat, shall Sign the second endorsed, the Party Concerned paying always for the Writing thereof Fourteen Pence per Sheet, as for the first Abbreviat: Declaring, that this Article, being only provided for the greater Satisfaction of Parties, is left free to them to be Used, or not Used as they shall I think fit; And that a single Abbreviat be as sufficient as both. 5. That the Money formerly in use to be paid for the Depositions of Parties and Witnesses, and likewise for the Calling and Tabling of summons, and Calling of Acts, as also the Money appointed to be paid for Acts and Decreets not Extracted, by reason the Pleas are Transacted, comform to the Appointment of the Regulations 1672 be paid in to the Collector for the Clerks, and to their Stock, and that the same be attested by him, or otherwise, that the Clerk haver of the Process may stop the same, and detain the pieces produced in Process, until the said Attestation be shown. As also that all Instrument-Money for Instruments taken before the Lords, be put into the Stock, and given to the Collector for that effect. 6. That for the Under-Clerks, their attendance and pains in count and Reckonings, and Ranking of Creditors, as also in Commissions and Improbations where there is Production, and for their attendance upon Commissions, there shall be given to them as follows: In count and Reckonings by both Pursuer and Defender, such Allowance as the Lord Ordinar shall modify for every Meeting toties quoties, not exceeding a Rix Dollar from each Party; and in Competitions of Rights, and Rankings, a Dollar for every Interest, to be paid by the Producer; and in Reductions and Improbations wherein Productions shall be made a Rix Dollar by the Producer, for the hail Production, though at different times. And for attendance upon Commissions by either Party, as the Lords of the Commission shall modify; all which Sums are to be paid in to, and attested by the Collector. 7. That for preparing of concluded Causes to be reported and advised by the Lords, there be paid such allowance as the Lord Preparer of the Report shall modify, not exceeding two Dollarsâ–ª which is to be paid in to the Collector, and his Attestation upon the back of the Report, produced and shown before Advising; and if one of the Parties be absent, then he is not thereafter to be heard, either at Preparing or Advising, till he repay his half to the Party who made the advance. 8. That at the first enrolling of all Causes in the Inner-house, or Calling of Causes there by the Lords Warrant, there be a Dollar paid by the Pursuer, and as much by the Defender, in to the Collector, for the Clerks pains in Minuting the said Cause, during the dependence, whereof a Receipt is to be shown to the Keeper of the Rolls, before he be obliged to behoveful the same. 9. That for every Diligence granted by the Lords without an Act, there by paid in to the Collector a Dollar, to be marked on the Warrant, before Expeding thereof. 10. That for all negative Oaths allowed to be summery advised, the Party Ingiver shall give in a Dollar to the Collector, which is to be marked on the Process, and shown before the Oath be advised, Declaring, that where there is a Bill given in for advising of the said negative Oath, there shall be but a Dollar paid for both the Bill and advising of the Oath. And lastly, That Five Hundred marks shall be added to each of the Under-Clerks Yearly salaries, in regard of their great Pains and Attendance, which shall be subject to the same Defaulcation the Thousand Pound Scots formerly Modified was to have been.
