ASSEMBLIES DU CONSEIL C^N^RAL.

The Annual General Meeting of the
General Council of the Corporation shall
be hold on such day, and at such hour,
within the thirty days prescribed by Sec-
tion 14, Cap. 27, 44 and 45 Vic, as shall
be fixed by the Secretary-Treasurer who,
before appointing said day, shall consult
the members of said Council in relation
thereto.

Besides the special meetings provided
for by the said Section 14, extraordinary
meetings of the General Council of this
Corporation may be held on the requisi-
tion of three members of said Council, at
such time and place as they may appoint,
after having given fifteen days notice
thereof in writing to the Secretary-
Treasurer, whoso duty it shall be imme-
diately to communicate the said notice to
the other members of the General Council.

L'Assemblee Gonorale Annuelle du Con-
sell General de la Corporation aura lieu
dans les trente jours prescrits par la Sec-
tion 14, chap. 27, 44 ot 45 Vict., a tel jour
et a telle heure qui seront determines par
le Secretaii-e-Tresorier qui, avant de fixer
lejour, devra consulter k cet etfet les
membres du dit Conseil.

II.

A pr.rt des assemblees speciales pour-
vues T)ai' la dite Section 14, des assemblees
extraordinaires du Conseil General de
cette Corporation pourront avoir lieu sur
la requisition de trois membres du dit
Conseil, h tel jour et en tel lieu qu'ils de-
termineront, en donnant quinze jours
d'avis de telle assemblee par ecrit au Se-
cretaire-Tresoriei', dont le devoir sera de
communiquer immediatement le dit avis
aux autres membres du Conseil General.

sion of Advocate, Solicitor, Barrister,
Proctor, Attorney and Counsel -at-Law ;
and members are hereby forbidden to
hold any office of profit or emolument, or
employment whatever outside of the said
)irofession of Law, (except those men-
tioned in Article IX of the.-e By-Lawt ),
or voluntarily to perform or assist in the
performance of any act, service or duty
appertaining to any office hereby for-
bidiien, or .any act usually- performed by
any such office holder or public func-
tionary ; and any member contravening
this article shall be deemed and held to
have committed a breach of the discii)line
of this Corporation, and shall be liable to
punishment as provided in Section 25 of

Whereas every mombor of tho Bar

of governing his lifo and conduct in
accordance with tho principles of honor,
justice and morality, it is horohy declared
that each of tho following acts, when com-
mitted by a mombor of the Bar, is dero-
gatory to tho honor and dignity of the
legal ])rofoH8ion, to wit :

l'>. Jtnproperly revealing any secret of
tho profession, "or any communication
imparted in confidence by a client ;

•J". Communicating to tho newspai)ors
or for publication any imperfect or false
report of proceedings boforj tho courts,
or any ro[iort, with intent to injure or
(iogrado a confrere.

yii. Praciising any deceit or surprise
noon a confrere with a view to gain in a
ponding cause an advantage which there
is good reason for believing could not bo
gained without such improper practice ;

40. Abandoning a client on tho day or

VIL

The oxercino, for Lho purpose of profit
or gain, of any profession other than that
©fan Advocate, Solicitor, Barrister, Proc-
tor, Attorney, or Counsol-at-law, and tho
exercise of any trade or other industry are
hereby declared to be incompatible with
tho dignity and honor of tho legal profes-
sion : and any member of tho Bar of this
Province who shall exercise any such
other profession for profit or gain, or any
trade or other industry, either directly or
indirectly, either alone or in partnership
with others, or in the name of another,
shall be liable to punishment as set forth
in the said section 25, cap, 27, 44 and 45
Vic, the whole subject, nevertheless, to
tho provisions of Article X of these By-
Laws.

The holding of any ofFice as a means of
obtaining a livelihood, or for purposes of
profit, gain or emolument, — other than
those specially excepted in the next fol-
lowing article— is hereby declared to bo
incompatiblo with tho dignity and honor

VII.

merce, ndgoco ou autre Industrie, sont
par lo present declares otre incompatiblos
avec la dignite et I'honnour do la profes-
sion legale : et tout membre du Barreau
de cetto Province qui exercera toute telle
autre profession pour profit ou gain, ou
aucan commerce, negoco ou autre indus-
trie, soit directement ou indirectomont,
foit soul ou en societe avec d'autros, ou
sous lo nom d'un autre, sera passible do
punition tol que montionne dans la dito
section 25, chap. 27, 44 et 45 Vict., lo
tout, neanmoins, sujet aux dispositions de

VIII.

IX.

Notwithstanding tho provisions of tho
four preceding articles, any member of
tho legal profession shall bo permitted to
hold any oftico in tho Privy Council of
the Dominion of Canada, or tho Execu-
tive of any one of tho Provinces, or tho
office of Professor of Law, the office of
Registrar of tho Vice-Admiralty Court,
uny offlco, such as a Commissioner, created
for i> special temporary purpose by tho
Privy Council of Canada, the Executive
Council of any of the Provinces, any Le-
gislature, any Municipal Council, or any
corporate body, or any office in any scien-
tific or literary socioty, or the office of
President or Director in any corporate
body : and any member of tho Bar is
hereby permitted to act as an arbitrator.

In all cases, the Council of any Section
before whom a complaint against a mem-
ber is tried, as well as tho (roneral Coun-
cil sitting in Appeal from tho decision of
a Council of a Section, shall always have
the right to oxorciso its own discretion
as to tho gravity of the act under the
particular circumstances proven, and to
decide, if thoy shall see lit, that the cir-
cumstances proven have or have not been
derogatory to the honor and dignity of
tho profession, or such as rendered the
act excusable.

Dans tous les cas, le Conseil de toutes

XI.

Any member of tho Bar who considers
himself injured, or that his honor be co"a
promised by an act of authority, shall
nave the right to bring a complaint before
the Council of his Section, and submit to
them the examination of his conduct and
acts, and obtain their decision upon the
same.

XII.

On the trial of any complaint against
a member cf the Bar, the party accused
shall have the right to offer his own tes-
timony, if he shall deem necessary.

XI.

Tout membre du Barreau qui se croit

XYI.

The Secretary of the Section shall
transmit to the Secretary -Treasurer of
the General Council, within three days
after he shf.ll have received notice of the
deposit required by Section 78, of Cap.
27, the record of the cause in which the
said judgment has been rendered, inclu-
ding all the proceedings and the evidence
adduced on both sides respecting the ac-
cusation, and all the papers produced
either in support of the accusation, or for
the defence.

XVTT.

The complainant, the accused, and the
Council of the Section which rendered
the judgment appealed from (the latter if
it think proper), shall prepare a wi-iten
statement (or factum) of the case, ten
coi'ies of which each of them whall trans-
mi't to the Secretary-Treasurer eight days
at least before the hearing.

XVIII.

The Secretary-Treasurer shall keep a
Special Eegistcr in which shall be regis-
tered all appeals, and all proceedings on
them in the order of thair date, and each
appeal shall be proceeded with in its turn
according to its place on the roll.

XIX.

The Council of the Section which ren-
dered the judgment appealed from ehall
be represented by the Syndic, if it thinks
fit to prosecute the said appeal, and to be
heard before the General Council.

XX.

The Appellant as well as the Eespon-
dent may be heard cither in person or by
attorney.

Thp Secretaries of the Counci's of Sec-
tions shall be bound, whenever required
so to do by the Secretary-Treasurer, to
transmit to the General Council accjirect
roll of the members of their respective
Sections, which roll shall contain the
name, christian name, residence and date
of commission, of all the members of
the said respective Sections, indicating
whether such members are practising, or
whether they have notified the Section
that they have temporarily ceased to
practice, or whether they have been sus
pended, and for what cause.

XXIII.

The Secretaries of the Councils of Sec-
tions are bound to notify the Secretary-
Treasurer forthwith of the death of any
member of the Section, of all notifications
received from members temporarily cea-
sing to practice, or declaring that they
resume practice, and also of suspensions,
either temporary or permanent, and to
specify whether such suspension has been
pronounced by law, or by sentence of the
Council of the Section.

XXV.

The Secretary-Treasurer shall bo enti-
tled to ten cents per hundred words for
all writings in all proceedings in appeal, or
any copy of proceedings forming part of
the Registers of the General Council, and
twenty cents for each certificate required
for such copy or writing, and twenty
cents for each communication of pro-
ceedings in appeal.

XXVI.

The Secretary of the Council of a Sec-
tion shtll be entitled to the following
fees, to wit : the same fees as are allowed
to Clerks of the Circuit Court in actions
between $60 and $100.

regular account of all monies received
or disbursed by him ; and no money above
the sum of $50, at each time, shall be dis-

Batonnier of the .Section to which the
Secretary- Treasurer belongs.

XXVIII.

Every year, at the time of the General
Meeting of the General Council, and
whenever he shall be required so to do,
the Secretary-Treasurer shall report to
the General Council and to all the Sec-
tions, the receipts and expenses of the
Council.

a copy of all correspondence of the (rene-

pose, and shall carefully preserve all
correspondence addressed to the said

2°. The duties of these Assistant Exami-
ners shall be to prepare the examination
papers for admission to study, and lo for-
ward them to the Secretary of the General
Council, at least two weeks before the
date of the examination, in order that
thoy may be printed in such manner best
to preserve the same secret; to examine
the answers, and to prepare and submit
to the Board of Examiners, as soon as
such e:,:aminaiion is concluded, a schedule
shewing the name of each candidate with
the number of marks obtained by him in
each subject — such schedule, together
■v^ith the auswers of each candidate, to
be subject to amendment at the hands of
the Board.

30. That it be competent for the Board
of Examiners to submit oral questions to
the candidates for admission to study, and
upon the result of the answers to the oral
questions, and upon the schedule of marks
prepared by said Assistant- Examiners, the
Board of Examiners make their report to
the (ieneral Council, recommending the
granting or refusal ' f the certiticatos, as
they may deem proper.

7°. The papers for admission to practice
shall bo prepared by the Board of Exa-
miners, and forwarded to the Secretary
of the General Council, to be printed, at
least two weeks before the examination.

8". At least four weeks before the exa-
mination, the Ganeral Secretary shall
notify the Examiners in each Section of
the subjects in which they are required to
prepare questions.

9o. About three days before the exa-
mination, the General Secretary shall
transmit the printed questions to the
Batonnier of the Section where the exa-
mination is to take place.

lOo. For the written examination for
admission to study, the subjects shall be
latin, mathematics, geography, ancient
and modern history, philosophy and such
other subjects as the Examiners shall
deem necessary, appertaining to a liberal
and classical education.

11°- The examination in mathematics
shall be limited to arithmetic, algebra to
end of quadratic equation, Euclid, books
I, II and III.

12o. The Assistant Examiners shall be
paid their actual travelling expenses, and
the sum of $50 each, for their services in
connection with each half yearly exa
mination.
