 J BY-LAW 
 
 To confer certain powers vested in. the Council^ upon 
 Counsellors^ when acting in their respective Town- 
 ships, in regard to Roads and Bridges. 
 
 Whereas by a certain Act of the Legislature of the Province of 
 Canada passed in the fourth and fifth year of the Reign of her present 
 Majesty Queen Victoria, entitled " An Act to provide for the better 
 internal Government of that part of this Province which formerly con- 
 stitutcd the Province of Upper Canada, by the establishment of local 
 or Municipal Authorities therein," it is among other things Enacted, 
 that all and every the Power and Authority which by any Act or 
 Acts in force within that part of this Province which formerly con- 
 stituted the Province of Upper Canada, are now vested in the Justices 
 of th-? Peace for the several Districts, with regard to Highways and 
 Bridges or work connecled therewith, shall, after the first day of 
 January one thousand eight hundred and forty-two, becom'i and be 
 vested in, and may be exei\aised by the District Council for such 
 Districts respectively, within the limits thereof, And Whereas it is 
 necessary for the due execution of the powers therein granted, and 
 for the better protection and management of the local interests of Her 
 Majesty's subjects, that the powers hitherto vested in and exercised 
 by the Justices of the Peace acting within any division of their District, 
 so far as the same has been vested in the District Council, shall 
 be exercised by the Counsellors within their several Townships 
 respectively, Be it therefore enacted by the Warden and Counsellors 
 of the Home District, That from and after the passing of this 
 By-Law, that all and every the power and authority which by any 
 Act or Acts in force within that part of the Province which formerly 
 constituted the Province of Upper Canada previous to the passing of 
 the before recited Act was vested in the Justices of the Peace acting 
 within any Division of the District, so far as the same has been con- 
 ferred upon the District Council, shall be exercised by the Counsellors

 A BY-LAW 
 
 To provide for the layin^r out, alteration, and keeping in 
 repair the Puhlic Highways in the Home District. 
 
 1. Be it enacted hj the Warden and Counsellors of the Home 
 Vislrict, That from and after tho passino- oftliis Act, every Surveyor 
 of Highways, who has boon or mnv hcivafter be appointed by the 
 Council, shall, before entering upon the di-^charge of the duties of his 
 office, make and subscribe tho fi)l!o>viiig declaration before the Clerk 
 of the Council, "I, A B, do «oleniiilv declare that I will to the best of 
 "^y^^!^!.?'^"'''^'t^i"''t partality, favour, four or afToction, dilirrently 
 and faithfully discharge tho duties of a Surveyor of Highways, Igree 
 ably to the provisiom of an Act passed in 'the fifth year of Her 
 Majesty s reign, entitled an Act to provide for the laying out, alteration 
 and keeping in repair of Public Highways in the Home District, and 
 With a view in all cases to the public sood." 
 
 2. Beit enacted by the authority aforesaid, That upon application- 
 jn writing being made to any such Surveyor by twelve or more Free- 
 holders of any Township or Townships, stating that any Public 
 Highway or Road in the neighborhood of such Freeholders, now in 
 use, IS inconvenient, and may be altered so as better to accommodate 
 Her Majesty s subjects and others travelling thereon, or that it is. 
 necessary to open a new Highway or Road, or that an old Road has 
 peconrie useless and is not required for the convenience of the public, 
 \i shall and may be lawful for such Surveyor, and he is hereby required

 to examiao the same, uad report thereon in writuig tu the Council at 
 its next ensuing Session, describing particularly the alteration intended 
 to be made, new Highway or Road to bo opened, or old Road to be 
 shut up, giving at the same time Public Notice thereof, by affixing or 
 causing to be aflixod, a copy of the said Report in three or more of the 
 most public places next adjacent to the place where the said alteration 
 is intended to be made, or new Highway or Road to be opened, at 
 least ten days previous to the next ensuing Sessioi. of the Council. 
 And it shall be the duly of such Surveyor, to attend the Council in 
 person with such Report, in order to give any explanation or evidence 
 that may be required. Provided always, that it sliall not be lawful 
 to lay out or alter any Public Highway, so as to lead tlie same through 
 any Orchard or Garden, or to remove any Building, without the con- 
 sent of the own '!• first hud and obtained, nor to shut up the allowance 
 for Road made in the original Survey of any Township, anything in 
 this Act contained to the contrary in any wise notwithstanding. 
 
 3. Beit enacted hy the authority aforesaid, Tliat whenever the 
 owner or owners of any Land required for a new Road shall object 
 to the same being taken for sucii purpose, or shall require compen- 
 sation for such Land sotalvcn, it shall bo Incumbent upon him or them 
 to give notice tlureof in writing to the Surveyor ot Highways, at least 
 five I. ays previous to the next ensuing Session of the Council, of his 
 or their intention to oppose such new road being established as a High- 
 way, or his or tiieir intention to apply for compensation, which notice 
 shall be delivered to the Clerk of the Council by such Surveyor, ap- 
 pended to his Report — and such owner or owners siiall attend in person 
 or by Agent, the next ensuing Session of the Council, to state his or 
 their reasons lor such opposition, or to establish his or their claim for 
 such compensation. 
 
 4. Be it enacted hy the authority aforesaid, That in all cases 
 when it shall ])o found necessary lo alter the direction of any such 
 Highway or Road already laid out, and ilic! Council shall by their 
 Act have establislied the new Road as a Public Highway, or directed 
 the closing of an old Road so that the Land ilirough wliich it formerly 
 passed shall become unnecessary for a Public Higiiway, that in such 
 case it shall be lawful for the Surveyor of Highways by wliom the new 
 Road was laid out, and he is hereby fully authorized and required to 
 sell such old Road by Public Auction, giving due notice of sucli sale, 
 and paying over to the Treasurer of the District the proceeds thereof, 
 and also to grant the same under his hand and seal, to any purchaser, 
 which sale and grant as aforesaid shall convey a legal title. Provided 
 always, that no compensation has ever been paid for such old Road, 
 in which case it shall revert to the then owner. Provided also, that 
 nothing in this Act shall extend or be construed to extend to author- 
 ising any Surveyor to sell and convey the Government appropriations 
 for Highways. Alsofurther provided, That in all cases in which 
 compensation had been previously received for the Land occupied by 
 such old Road, and the Public Sale of the said old Road takes place^ 
 a right of pre-emption shall at all times exist on the part of the owner 
 of the Lot through which such old Road passed, at the time of such 
 sale.

 By-Laws. 
 
 6. Be It enacted by the authority aforesaid, That in all oases 
 when any application sliall ho made to any Surveyor of Hiffhways 
 to have any mm Road laid out, or any Road already laid out altered, 
 and the same shall ho of a local nature, those making the application 
 shall he deemo.l hablo to pay the expenses of the Survey, together 
 with the oompnnsafion (leiorminod bv the Council, to the owner or 
 owners of the lurid through which the new road may pass ; and if it shall 
 appear to the Council, that the said alteration or new Road is of man- 
 ifest utility to th(! public at largo, then in that case the same shall be 
 paid from the public money of the District. Provided always never, 
 theless, That the owner or owners, agent or agents thereof shall make 
 application to be compensated for the Land taken within three months 
 
 from the date of the Report of such new Roatf or alteration of such 
 Road. 
 
 6. Be it enacted by the authority aforesaid, That such new Road 
 or alteration of Road, when established by Act of Council, shall be 
 made and kept in repair by statute labour,' or in such manner as other 
 public highways are made and repaired. Provided always, That in all 
 cases where compensation is demanded, no order shall issue directing 
 statute labour thereon, unless a discharge or acquittal for compensation 
 lor the Land taken for such purposes or a release for the same from 
 the owner or owners thereof, . r proof of a tender having been made of 
 the value thereof as determined by the Council, bo produced to the 
 satisfaction of the said Council.

 To establish and confirm four several Roads in the Town- 
 ships of Uxhridge and Rcach^ in the Home District. 
 
 Be it enacted by the Warden and Counsellors of the Home District^ 
 That the Road surveyed by John Farquharson, Esq., Road Surveyor, 
 from the centre of Lot No. 31, in the sixth conces-siou of Uxbridge, 
 through the centre of the seven Lots (north sixteen degrees west) to 
 the Township line of Scott ; also, the Road from Uxbritigo Mills, south 
 easterly from the south-west angle of Lot No. 30, through the seventh 
 concession and the Gore of Uxbridge ; then through tlio eighth and 
 and seventh concessions of Reach to the road allowance between 
 Lots Nos. 6 and 7, together with the Road through Lots No. G, in the 
 first, second, third and fourth concessions of Reach ; also, through 
 part of the seventh, eight, ninth and tenth concessions of the said 
 Township of Reach, reported to the Council, be, and the same is 
 hereby established and confirmed as important Roads and Highways 
 which will greatly tend to the public good.

 To authorise the Treasurer, during the recess, to advance 
 a sum not exceedhig Tv)enty-five Pounds, for the 
 repair of Bridges, <Sfc. 
 
 Be it enacted by the Warden Counsellors of the Home. District, 
 That it shall and may be lawful for the Treasurer of said District, 
 and he is hereby authorised duimg the Recess of the Council, on 
 application being made, signed by the Counsellor or Counsellors, as 
 the case may be, the Town Clerk and Twelve Freeholders of the 
 Township for which the application is made, to pay the Town Clerk 
 of said Township, out of the District Funds, a sum not exoe«?ding 
 Twenty.five pounds, to be by him expended under the direction of 
 the Counsellor or Counsellors, as the case may be, in r<3-building or 
 repairing such Bridge or Bridges w^hin the Township as may have 
 been destroyed or rendered impassable by, or dangerous to the tra- 
 veiling c> nunity, and it shall be the duty of the said Town Clerk

 to make returns to the Treasurer of the expenditure of the money 
 before the next regular session of the Council, and if in the opinion 
 of the Council, the expense of said repairs should be borne by the 
 District, or any part thereof, then the same shall be acknowledged in 
 the Treasurer's account, but should it be the opinion of the Council, 
 that the expense, or any part thereof, should be defrayed by the 
 Township or locality, then it shall bo the duty of the Council to 
 determine the extent of such locality, and impose a Tax on the same 
 to the amount of the money received, or any part thereof, which shall 
 be collected and paid over to the Treasurer by the Township Col- 
 lector

 To establish and co7ifirm a Public Road from Ste^man*s 
 Mills, in the Townsliip of Vaughan, to the allowance 
 for Road on Lot No. 23, betioeen the 6th and 1th 
 Concessions of the Township of York. 
 
 Be it enacted by the Warden and Counsellors of the Hone District, 
 That the Road surveyed and reported by Robt. Walsh, one of the 
 Road Surveyors, from Stegman's Mill in the Township of Vauwhan, 
 to where it intersects the allowance for Road on Lot number Twenty, 
 three, between the sixth and seventh Concession of the Township of 
 York, West of Yonge-st. be, and the same is hereby established and 
 confirmed as a public Road or Highway of importance to the public. 
 
 And he it further enacted by the authority aforesaid, That the Peti- 
 tioners for the opening of the said Road, shall pay to the said Surveyor 
 his expences for surveying the said Road.

 1. Be it enacted hy the Warden and Counsellors of the Home District , 
 That the eighth clause of a By-Law passed on the fourteenth day of 
 May, one thousand eight hundred and forty-two, entitled " A By-Law 
 to provide for the laying out, altering, and keeping in repair the 
 Public Highways in the Home District," be, and the same is hereby 
 repealed. 
 
 And be it further enacted hy the authority aforesaid, That every 
 Surveyor of Highways hereafter employed, shall be entitled to demand 
 and receive the sum of fifteen shillings for every day in which he shall 
 be necessarily employed in carrying into effect the provisions of the 
 above recited Act — an account of which such Surveyor shall present 
 to the Council, and to which he is hereby required to make and sub- 
 scribe the following declaration: — 
 
 I, (A. B.) do solemnly declare that I have been necessarily and 
 faithfully employed in examining, surveying, &c,, (as the case may 
 
 be) days, and tnat the above account is just and true. Which

 Provided always, That for all animals empounded not allowed by 
 the laws of the Township to run at larr^e, the Pound-keeper shall be 
 entitled to receive one fourth more than for other animals ; and for 
 advertising, selling, &c. any animal, the Pound-keeper shalli be enti- 
 tied to receive double the amount allowed him by this By-Law foF

 to the same penalties, and to be recovered in the same manner as those 
 imposed by the statute passed in the first year of the Reign of Queen

 Sand, Earth and other materials that may be found standing or lying 
 in or upon any Highways or Road Allowances within this District,

 That from and after the passing of this Act, it shall and may be law- 
 ful for the Counsellor or Counsellors in their respective Townships 
 (or Lnion of Townships, as the case may be,) to sell or dispose of any 
 Stone, Timber, Sand, Earth, or any other material that may be found 
 standing or lying in or upon any such Highways or Road Allowance 
 as aforesaid, or upon any such Highway as may hereafter be laid out, 
 Provided, That in the opinion of the Counsellor or Counsellors in or 
 for their respective Townships or Union of Townships, the same be 
 not required tor the use of Bridges and Public Highways in the locality

 where such materials may be found ; and also to rent or lease for 
 a term not exceeding one year, any such Road Allowance as may not 
 be required for the use of the Public HighMays, and thai theproceeds

 Clerk within the Township or union of Township where such proceeds 
 have been raised, and that the same shall be expended under the direc- 
 tion of the Counsellor or Counsellors on the improvement and construe 
 tion of Bridges and Highways within their Townships, or union of 
 Townships as the case may be, and the said Township Clerk shall in 
 each and every year make a return to the District Treasurer of the 
 Receipts and Expenditures of said proceeds of sales and rents, accom- 
 panied with the necessary vouchers.

 person or persons trespassing on any such Highway or Road Allow- 
 ance, shall be liable to the pains and penalties as by law provided,

 A BY-LAW 
 
 To authorise the Inhabitants of Newmarket to commute 
 
 their Statute Labour. 
 
 Whereas, the inhabitants of the village of Newmarket, in the 
 Township of Whitchurch, have, by their petition to the Council, re- 
 quested that the Statute Labour therein should be commuted, and paid 
 tor in money, and that such commutation money should be applied 
 to the purposes therein mentioned, 
 
 Be it enacted ly the District Council of the Home District, That 
 any person liable to perform Statute Labour according to law, residing 
 in the said village of Newmarket, is hereby authorised to compound or 
 commute for such duty, between th*? first day of April and the first 
 day of June, in each and every year, by paying to the Overseers of 
 Highways, lawfully nominated or appointed to serve for the said village 
 of Newmarket, the sum of two shillings and sixpence for each and 
 every day which he or she may be required by law to work ; and such 
 Overseers are hereby authorized to act as a Board of Commissioners, 
 and accept the said sum in lieu of such Statute Labour, and lay out 
 and expend the same upon the Roads and Bridges in the said village, 
 under and subject to the directions of the Counsellors of the said Town- 
 ship for the time being. 
 
 2nd. Provide' %lways : And he it further enacted, That it shall 
 be the duty of the Overseers appointed for the said village, or one of 
 them, to collect the commutation money aforesaid ; and in case any 
 person liable to perform Statute Labour as aforesaid, shall neglect or 
 refuse to pay the same within the time hereinbefore set forth, and after 
 he or she shall have been called upon by the said Overseers, or one

 of them, so to do, he or she shall forfeit and pay the sum of five shillings 
 for each day commuted he or she shall so neglect or refuse to pay 
 the said sum of two shillings and sixpence per day, to be recovered on 
 complaint of the said Overseers, or one of them, by warrant under the 
 hand and seal of a Justice of the Peace, by distress and sale of the 
 goods and chattels of the person so ofTending, rendering the overplus, 
 if any, to the party, after deducting the penalty and legal charges 
 attending such distress and sale ; and the imposing of any such fine or 
 penalty on any person shall not be constructed in any way to release 
 such person from paying the commuted labour as aforesaid, but he or 
 she shall be liable, and subject to pay the same at any time within 
 the current year, when called upon by the proper officer, as though 
 no such penalty had been imposed. 
 
 3rd. And he it further enacted hy the authority aforesaid, That if 
 the said Overseers, or either of them, shall neglect or refuse to collect 
 the said commutation money within the time hereinbefore specified, 
 and expend the same at such time and place as hereinbefore set forth, 
 and in a faithful and judicious manner, and under and subject to the 
 directions of the said Counsellors, he or she shall be subject to a line 
 of not less than five shillings, nor more than five pounds, with costs, to 
 be recovered on complaint of said Counsellors, or one of them, in like 
 manner that persons are by this Act who neglect or refuse to pay the 
 commutation money ; and the imposing of any such fine or penalty 
 shall in no wise release such Overseer or Overseers, from the per- 
 formance of the duties of him or them by this By-Law : Provided al- 
 ways, that the information and complaint for a breach of the fulfilment 
 of the duties aforesaid, must be made within five days after the time 
 limited by this Act for the performance of the said duties. 
 
 4th. And beitfurther enacted, That it shall be the duty of the said 
 Overseers, or either of ihem,to make a just and true return of the 
 receipts and expenditure of all monies collected under and by virtue 
 of this By-Law, to the Counsellors aforesaid, on or before the eighth 
 day of November, in each and every year, in order that the same may 
 be laid before the Council at its last quarterly meeting ; and in case 
 of default thereof, he or they shall forfeit and pay the sum of not 
 less than five shillings, nor more than five pounds, with costs, to be 
 recovered in manner hereinbefore set forth, within ten days after the 
 first day of December. 
 
 5th. And be it further enacted. That the bounds of the said village 
 of Newmai Let shall be considered or known as comprising the East 
 Halves of Lots Nos. 92, 93, 94, and 95, in the first Concession, and 
 the West Halves of Lots Nos. 32, 33, and 34, in the second Concession 
 of the said Township of Whitchurch.

 To Tax the Owners of Dogs. 
 
 Whereas, by an Act of the Parliament of this Province, entitled 
 " An Act to empower the District Councils of the Municipal Districts, 
 and Boards of Police of incorporated Towns in Upper Canada, to im- 
 pose a Tax on Dogs within their respective Districts and Towns," the 
 District Councils of the several Districts in Upper Canada are em- 
 powered to make By-Laws for imposing a Tax upon the owners of 
 Dogs, 
 
 1st. Be it therefore enacted by the District Council of the Home 
 District, and it is hereby enacted by the authority of the same, That the 
 owner of every Dog living within the boundaries of this District, save 
 and except such as are exempted by law from the same, and also save 
 and except every Householder who shall possess only one Dog, shall 
 pay to the Collector, when demanded, the sum of five shillings for 
 every such extra Dog ; the said Tax to be levied and collected in like 
 manner as all other Taxes are now by law levied and collected.

 2. And he it fur titer enacted by the authority aforesaid, Th&X the 
 Clerk of the Peace is hereby required to add an additional column to 
 the Assessment Roll for each Township, for the purpose of said Tax, 
 and it shall be the duty of the Assessor of each and every Township, 
 who shall hereafter be chosen or appointed, to specify in such column 
 the number of Dogs liable to be taxed as aforesaid, kept by each and 
 every inhabitant Householder in each Township or union of Town- 
 ships respectively ; and that the amount of said Tax, when collected, 
 shall be added to the amount realized on account of all other District 
 Rates, and paid over to the District Treasurer, for District purposes ; 
 and the Collector shall be entitled to retain to his own use, his per 
 centage on the aggregate amount thereof, with reference to the scale 
 laid down in By-Law No. 25. 
 
 3. And be itfurther enacted, That this By-Law shall not come 
 into force until the first day of January next, and that the same be 
 read by the Township Clerk of every Township, at the next Town- 
 ship meeting.

 sum of £80, granted to the said Townshipof Georgina by said By-Law, 
 on such Roads and Bridges in the Township, as they.or a majority 
 of the said Commissioners shall deem proper and expedient. 
 
 3. Andheit further enacted hy the authority aforesaid, That in 
 the event of vacancies occurring in the office of Road Commissioners, 
 appointed under and by virtue of said By-Law, by death, removal, or 
 from other cause, it shall and may be lawful for the Counsellor or 
 Counsellors of such Township where such vacancies may occur, 
 (after being notified by the Township Clerk, or by the parties declining 
 to act,) to appoint others or another in their stead ; and in the event 
 of the Commissioners appointed under said By-Law, not acting in the 
 discharge of their duties before the 15th day of June next, he or they 
 shall be considered as having declined to act, and the said Counsellors 
 are hereby authorized to appointed others in theiv place and stead.

 Whereas a Company has been formed in the City of Toronto, 
 for the purpose of building an Electro- Magnetic Telegraph through 
 the Home, Gore, and Niagara Districts, and have applied to the Dis- 
 trict Council of the Home District for authority to erect the necessary 
 posts and apparatus, and connect the same with wires along the high- 
 ways and roads of the Home District : And Whereas the said Home 
 District Council are desirous, as far as in them lies, to promote the 
 said undertaking, and for that purpose have consented to the erection 
 of the necessary posts, wires, and other apparatus, along the highways 
 and roads of the said Home District, as far forth as they legally can, 
 
 Be it therefore enacted hj the District Council of the Home District, 
 That the said Compai^y be allowed to erect at such places along the 
 highways and roads of the said Home District as may be found nec- 
 essary for the purpose of building an Electro-Magnetic Telegraph, all

 To. prescribe the mode of ascerlaini?is^ the wishes of the 
 Inhahitmits of any Toivnship, in regard to the erec- 
 tion of a Township Hall, the Site for the same, and 
 the place for holditig the Township Meeting. 
 
 VVHEfiEAs it is highly desirable that tiio wishes of a majorityof 
 the inhabitant freeholders and householders of any Township^ should 
 be consulted in reference to the selection of a suitable and conrenient 
 site, cither for the erection of a Township Hall, or for the purpose of 
 holding the Township Meetings, temporarily and for the time being, in 
 any Township wherein a Hall has not been legally or properly erected, 
 and also in reference to the expediency or necessity of erecting a Town- 
 ship Hall in such Township at any particular time. 
 
 And whereas h is expedient in order to prevent confusion and 
 dispute, and to enable the District Council to obtain correct information 
 m relation to these matters, that some uniform and legal mode should 
 be defined and prescribed for such purposes respectively, by which the 
 desire or wishes of the said mhabitants may be ascertained,

 Township ; the business of such Meeting to commence at ten o'clock

 legal voter, at any such meeting, to propose or nominate a Site for the 
 erection of a Township Hall, or place for holding the Township Meet-

 duly recorded in such order as tlie same may be proposed by the 
 Township Clerk, if present ; or if he be not present, then by such per-

 such record to be made in a poll book to be kept for that purpose, and 
 if more than one Site be so proposed or nominated, or any question 
 involving a difference of opinion in regard to the aforesaid objects, 
 and a poll be demanded by three or rnoro legal voters, it shall be the 
 duty of the Chairman, or of the presiding Officer at any such meeting, 
 to proceed by a regular and impartial poll to ascertain and determine 
 the desire and wishes of the majority of legal voters in respect to any 
 or to all the matters as aforesaid, by polling or recording all the legal 
 votes which may be tendered or offered, such polling not to extend 
 beyond the hour of Twelve o'clock at night of the same day, and the 
 Township Clerk, or in his absence the Clerk chosen as aforesaid, shall 
 act as poll Clerk, shall keep a true and correct record of the votes for 
 or against such propositions or nominations made as aforesaid ; and 
 the Township Clerk or Clerk appointed as aforesaid, shall as soon as 
 may be after such polling be ended, make a true and authentic certi- 
 fied copy, (verified upon oath before a Magistrate, if required by any 
 three legal voters,) and transmit the same to the Clerk of the District 
 Council, in order that the same may be laid before the said Council at 
 its next session. 
 
 3. And he it farther enacted, That no person shall be allowed to 
 vote at any such Meeting, unless he bo an inhabitant freeholder or 
 householder, residing in the Township, and of the full age of 21 years ; 
 and any person voting at any such Meeting, not being dnly qualified 
 as aforesaid, shall be, and he is hereby declared to be liable to che 
 same fines and penalties which shall or may be imposed, recovered, 
 and applied in the same way and manner, and by the same process as 
 is provided by the 4th section of an Act of the Legislature, entitled 
 " An Act to alter and amend sundry Acts regulating the appointment 
 and duties of Township Officers," passed on the 6th day of March, 
 1838, for fining or punishing persons not qualified, who may vote, or 
 olTer to vote, at regular Township Meetings.

 Six Shillings and Three Pence for each day he shall have sat in 
 Council during the present session, and the like sum of Six Shillings 
 and Three Pence for each day he shall sit in Council at each of the 
 next four half-yearly sittings of the Councilor at any extra sitting 
 wiJhin the period limited by law ; that is to say : during the years 
 1847 aud 1848, to be paid out of the General Funds or Revenues of

 Whereas it is provided by the 12th section of the District Muni- 
 cipal Council Amendment Act, passed on tiie 9th day of June, 1846, 
 that any District Council nnay by a By-Law to be made from time to 
 time in their behalf, alter the period or periods for holdin- the half 
 yearly meetings of such District Council, and whereas it is found 
 expedient for the public convenience to alter the periods of the Sittings 
 of the Home District Council, 
 
 Be it therefore enacted hy the District Council of the Home District^ 
 That from and after the passing of this By-Law, the half yearly meet- 
 ings of the said Home District Council shall commence and be holden 
 at the times following, that is to say : the First half-yearly Meeting-

 A BY-LAW 
 
 To authorise the inhabitants of the Village of Oshawa, to 
 commute for their Statute Labor. 
 
 1. Be it enacted by the District Council of the Honr, District, 
 and it is hereby enacted, That from and after the passing of this By 
 Law, it shall and may be lawful for all and every person (liable 
 by the laws of this Province to perform statute labour), residing 
 within the Road division or divisions in which the village of Oshawa 
 is, or shall be situated, and they are hereby authorised and required, 
 instead of performing statute labor in the usual manner, to commute 
 or compound for the same, by paying or causing to be paid in each 
 and every year during the continuance of this By-Law, to the Over- 
 seers of highways, who shall or may be duly appointed to serve for 
 said division or divisions, the sum of Two Shillings and Six Pence per 
 day, for each and every day such person shall or may be liable to 
 perform statute labor on or before the first day of May, in each and 
 
 every year. 
 
 2. And be it further enacted by the authority aforesaid, That 
 it shall be the duty of the Overseers for said division or divisions, for 
 the time being, within ten days thereafter, to notify each and every 
 such person in such division, who shall or may refuse or neglect to 
 pay to such Overseer, such commutation money as aforesaid, by 
 personal application, or by leaving a written notice at his or her 
 usual place of abode or business, to pay such commutation money 
 as aforesaid within three days after so delivering or leaving such 
 notice, and in default of such payment within the said time, such 
 Overseer shall have, possess, and may exercise the same power and 
 authority that are held, possessed and exercised by the Collector 
 of any Township for the collection of the ordinary assessments, 
 viz. : by distress and sale of the Goods and Chatties of such person 
 or persons, and who shall and may be entitled to the same fees for 
 the exercise of such power and the due performance of such duties 
 that Township Collectors are entitled to : Provided always, That in 
 any case where sufficient distress cannot be found to pay such com, 
 mutation money with the costs as aforesaid, it shall be the duty of such 
 Overseer to report all such defaulters to the Justices of the Peace in 
 the Township, in the usual way, and within the time prescribed by 
 law for Overseers to make their returns ; and such defaulter or de- 
 faulters shall and may be proceeded against and dealt with in every 
 respect by the said Justices, by fine or otherwise, as for neglecting or 
 refusing to perform their statute labour, had this By-Law not been 
 passed. 
 
 3. And he it further enacted by the authority aforesaid. That the 
 Overseers aforesaid shall faithfully lay out and expend all such 
 commutation money coming into their hands, and render their ac-

 the Assessors in each and every Township mentioned in said 
 Schedule for the present year, shall, and they are hereby required 
 to furnish to the District Clerk, within fourteen days after notice 
 shall be sent to them, a certified copy of the Assessment Roll of 
 their respective Townships, so far as rej^mrds the limits of the several 
 School Sections mentioned in said Scliedule, containing the names of 
 persons liable by law to bo assessed, together with the aggregate 
 amount of their rateable property for the present year, in such School 
 Section specified opposite to their names; upon delivery of which 
 said extract of Roll to the said District Clerk, the Ass ssor shall be 
 entitled to receive from the Treasurer the sum of Two Shillings 
 and Six Pence for every hundred names, and it shall be the duty of 
 the Clerk of the Peace, upon receipt of said extracts of Rolls, in a 
 separate column, to assess the Inhabitants residing in said School 
 Section, for the sums mentioned in said Schedule, equally upon the 
 aggregate amount of their rateable properties. 
 
 2. A7id he it further enacted hy the authority aforesaid, That the 
 Collectors for the present year of tlie Townshi}) named in said Sche- 
 dule, shall, and they are hereby authorised and required to collect in 
 the usual way from the said persons named in said Rolls, the several 
 and respective sums mentioned opposite to their names in said addi- 
 tional column, and shall as soon as collected pay the same over to the 
 Treasurer of the District, for which service they shall be entitled to 
 receive from the Treasurer at the rate of Five per cent, on the 
 amount collected and paid in addition to their other per centage. 
 
 3. Provided always, and he it further enacted, That where a 
 School Section has been altered since t!ic building of the School 
 House, for the payment of which llie sums advanced by the Trea- 
 surer were applied in the payment of the persons now living in the 
 original section, as far as it can be ascertained, shall be assessed and 
 shall be liable for the payment of the sums advanced for payment 
 of the School House then erected ; and if any difficulty shall arise in 
 ascertaining the boundaries of said original School District, or other 
 difficulty as to the i)arties who should be liable to pay the assess- 
 ment or rates for building the School Houses aforesaid, by reason 
 of such alteration of said School District, thf Counsellor or Counsel- 
 lors, as the case may be, for the Township, or Union of Townships, 
 are hereby authorised to exercise a discretionary power in th? matter, 
 and to decide as to the extent of the bounds of the original School 
 District to be taxed for the purpose aforesaid. 
 
 4. Andprovided always, and he it further enacted. That when any 
 person or persons who may be assessed for the payment of such 
 School House, shall have paid to the Collector or to any person 
 entitled to receive the same at the time, a sum at least equal to the

 Whereas doubts are entertauied as to the power intended to be 
 conferred by the Lerrislature, upon the Municipal Councils by the 
 10th clause^, 9th Victoria, chap. 20,— when the assessments therein 
 directed to be made shall exceed Two Pence in the Pound : And 
 whereas it is expedient to provide for the immediate erection of certain 
 School Houses, the expense of which shall be raised, levied and 
 collected, within their several School Sections respectively, so soon as 
 the said question shall be determined and set at rest, 
 
 Be it therefore enacted hi the District Council of the Home Bis- 
 tnct, That from and after the passing of this By-Law, it shall and 
 may be lawful for the Treasurer of the District, and he is hereby 
 required so soon as a School [louse shall be erected in any of the 
 following named School Sections, to pay to the Secretary-Treasurer 
 of the Trustees of such Sections, the sums placed opposite the same 
 respectively. Provided always, That a good and sufficient title to the 
 District Council, for the site on which the said School Flouses shall 
 be erected, shall first have been deposited with the Clerk of the Coun-

 Whereas it appears that a suitable building has been erected in 
 the Village of Streetsville, in the Township of Toronto, for a Town 
 Hall : And whereas it appears that the Inhabitants of said Township 
 are desirous that the said building should be confirmed and estab- 
 lished as the Township Hall for the use of the said Township, 
 
 Be it therefore enacted hy the District Council of tlie Home Dis- 
 trict, and it is hereby enacted hy the authority of the same ^ That the 
 building erected in the Village of Streetsville, in the said Township 
 of Toronto, and known as the Town Hall, shall from and afler the 
 passingofthis By-Law, be deemed, taken and considered as the Town 
 Hall of the Township of Toronto, and all Township Meetings autho-

 the centre thereof as a suitable site can be obtained,

 trict, That from and after the passing of tliis By-Law, tite site on 
 which a Township Hall for the Township of Markht^a,, ceafter to 
 be erected, shall, and may be on the rear end of t.chc i oi the fol-

 several Townships in the Home District, and they are hereby respec 
 tively authorised and required to do and perform in their several and 
 respective Townships, all and everv the duties required of thie Dis- 
 trict Council, under the 9th ol Victoria, chap.. 8, and that all and 
 every the powers and authority conferred by th« said statute on the 
 District Council shall be, and are hereby vested in. t>he saidi respec- 
 tive Counsellor or Counsellors for the respective TownsRips, fn refeir^ 
 ence to the opening and using any original Roatf AUowatice or 
 AUowances in their respective Townships. Provided ahmys, That

 sha be opened unless an Order, ordering the same to be opened,

 the allowance is situated : Provided always, That no such order shall 
 be made unless a nofico in writing, that an application for that pur- 
 pose will be made, shall have been given to the i)arfv in posseosion o^ 
 .such allowanco for Road, at least Eight Days previous to the Meet- 
 ing ot the District Council at which such application is intended to

 10, West Centre Road, Caledon, under certain con-

 1. Be it enacted hy the District Council of the Home District, 
 That the Road surveyed and laid out by John Embleton, Esquire, 
 one of the Road Suiveyors for the District, across or upon Lots Nos. 
 9 and 10, in thn nnii concession of the Township of Caledon, agreeable 
 to his Report l> -Avuvr date the tenth day of August, 1846, be, and the 
 same is hereby established and confirmed as a public Road or High- 
 way, one chain wide. 
 
 2. And he it further enacted, That the Petitioners for surveying 
 said Road, shall pay to the said Surveyor his legal charges for sur- 
 veying ihe same. 
 
 ^' Provided always, and be it further enacted,, That it shall not 
 be lawful to open or perform statute labour upon that part of said 
 Road, upon or crossing the said Lot No. 9, in said concession, until 
 the amount of damages jstained bv Archibald McArthur, (now the 
 owner of part of said Lot No. 9,) by reason of the said Road crossing 
 his land, have been paid or tendorod to him by some one or more of 
 Petitioners for the surveying and establishing said Road ; the amount

 Provided also, That in the event of either of the said partes neglecting 
 or refusing to name one Arbitrator as aforesaid, within ten days after 
 he shall have been duly notified of the appointment of one Arbitrator 
 by the other party, then and in that case, the two Counsellors for the 
 said Township for the time being, and the one Arbitrator who shall 
 have been appointed as aforesaid, shall determine the amount of dam- 
 ages as aforesaid to be paid or tendered to said Archibald McArthur.
