X. Ifthe Governor, Lieutenant Governor by his Proclamation or Order in Council fhall direa any Alien
to depart the Province, within a limited time, any Juflice of the Peace may apprehend and commit to Gaol any
fuch Alien jefufing to pay due obedience to fuch Proclamation or Order refpeaively. there to remain until de-
livered by due courfe of Law, and in cafi?s where the Governor or Lieutenant Governor may apprehend that
immediate obedience will not be paid to fuch Proclamation or Order, he may give fuch Alien in charge to any
Peace Officer or other Perlon or Perfons to be conduaed out of the Province.

XL Any Alien difobeying fuch Proclamation or Order of the Governor or Lieutenant Goveinor, fhall upon
conviffion be adjudged to depart out of the Province, within a lime to be limited, and if found therein after
fuch tin- . fhall be iranfportea for life as therein after enaaed.

Xil. Any jufiice of tne Peace in any part of the Frovnce may fequifc any iT-uen arnvcu aaer tus urfl day

IV. Tout Etranger venant en cette Province par quelque communication ou navigation intcrieure,

IX. Les Officiers de la Douane, les Jugeset Greffiers dela Paix, recevant les declarations, fonttenusde
les tranlmettre (tenant une copie d'icelles) au Secretaire de la Province, fous peine de cinq Pounds pour chaque
negligence, applicables de meme maniere ,quc les penalites impolees par la deuxiime Seflion de TAde.

X. Si le Gouverneur ou Lieutenant Gouverneur, par fa Proclamation ou ordre en Confeil, ordonne ^
quelque Etranger de fortir de la Province, fous un terns limite, tout Juge de Paix, peut arreteret emprifonner
tel Etranger refufant d'obeir i cette Proclamation ou ordre refpeaivement, pour y refter jufqu a ce qu'il foie
juridiquement eldrgi, et dans les cas ou le Gouverneur ou le Lieutenant Gouverneur apprehendera que telle
Proclamation ou ordre ne foit pas immediatement obei, il peut donner tel Etranger en charge a un Officier
de Paix ou k une ou plufieurs auires perfonnes, pour etre conduit hors dela Province.

XL Tout Etranger defobeiffant a telle Proclamation ou ordre du Gouverneur ou Lieutenant Gouverneur
feracondamne d'apr^s conviaion a fortir de la Province fous un terns qui fera limite, et s'il eft trouvfe en

XV. The Juflices of the Courts of King's Bench or of Oyer and Terminer and Gaol Delivery, may bail Aliens.

XVI. Juflices of the Peace may bail Aliens, ifauthorifed fo to do, under Warrant from the Governor or
/l.ieutenant Governor.

. -XVII. His Maxell y, when the Governor orLieiuenant Governor fhall deem it neceffary, may fend out of the
Province, any Alien apprehended or committed to Gaol for any offence agaill the Aft or impriloned in execu-
tion of any fcntence pafled upon fuch Alien for any offence againll the Aft, or admitted to bail.
. XVIII. Any Perfon adjudged under the Aft to be tranfported, who fhall return or be found at large within
the Province after fcntence of tranfportation, fhall be guilty of Felony and fuffer death as a Felon without bene-
fit of Clergy. .

XIX. Perfons adjudged to be tranfported may be fent to fiich places as the Governor in Council fhall direft

XX. Aliens not fourteen years old excepted from the operation of the Aft.

XXI. Certificates fliall be given gratis, and frefh Certificates may be granted where the former ones are loft
or nfiiflaid.

XXII. In all Queflions refpefling offences againfl the Aft, the onus probandi fhall lie on the party accufed.

XXIII. Penalties may be levied by Warrant of Diflrefs, and for want of fufficient diflrefs, the party offendine
may be impriloned till latisfaftion be made — Parties aggrieved may appeal to the Quarter Seffions of the Diffrift

XXIV. Parlies appealing to give fix days previous notice — Juflices in SefFion may award cofts. If there be
not fix days between the judgment of the Juflices and the next Quarter SeflTions, the Appeal may be made to
the fecond Seffions.

XXV. Aftions brought againfl Perfons for any thing done in purfuance, or by colour of the Aft, are limited
to 3 months. Defendant may plead the general iflue and give tnc fpecial matterin evidence ; and'if judfimeiit
be fiiven for fuch defendant, or the Plaintiffs be nonfuit or difconiinue his Aftion, double cofts fhall be awarded

XXVII. Pariftiioners may be Witnefles, though part of the Penalty be given to the poor of the oarifli to

d'une fentenoe padee contre tel Etranger pour auelque delit contre l'A6le, ou adinis k caution.

XVIIL Quiconque ftra condamn^ k etre tranlporte, retournera ou lera trouve ac^ns quel que partie lie la
Province apres fentence de Tranfportation, fera coupable de E6lonie, et fubira la mort com me Felon, f&ns

XIX. Ceux qui feront condanin6s k etre tranfport6s, pourront Stre envoy6s dans tels endroits que le
Gouverneur en Confeil ordonnera.

XXVIU. Les fujets du Roi, de I'un ou I'autre fexe, de la defcription contenue dans Tarticle pr&cedent,
ariives en cette Province depuis la pallation de I'Afie, font tenus de declatter leur rang Sec. ainfi que
les raifons qui les ont engages d'aller et de rcfider en France, combien de Terns, oU ils ont refide^ quelle
profeflion ils exer9oient ; et aufli Icurs raifons pour venir en cette Province ; ious les peines et ptnalites de-
clarees contre les Etrangers qui negligent ou refufent d'obeir a I'Afte. .. ^ v

XXIX. Toutes amendes, confilcaiions, &c. impofecs par cet Afte, feront payees entre les mains du
Receveur General pour etre appliquees par Warrant du Gouverneur, eux objets mentionnes dans I'Aftc ;
pour en rendre compte a la Couronne, par la voie des Commillaires du Trelbr de Sa Majede.

XXX. Un precis des reglements contenus dans I'Afte concernant les gens qui ont rtfide ou acquis des
biens en France, mentionnes dans I'Atle, lera imprime en Anglois etcn Fran9ois, et affiche dans les endroits ou
les Etrangers ont coutume de pafier en entrant dans la Province ; et notihe par \t% Officiers dc la Douane
aux Patrons de Vaiffeaux et aux Ztrangers a bord (les matelots exceptes) maisia preuve de cette notification
