To the Constitutional Commission: Pursuant to the following resolution adopted by the Commission, December 5, 1872, to wit: Hesolved, That the Clerk send a circular to the mayors of each of the cities, to the clerks of the boards of supervisors in the several counties, to the supervisors of each town and the president of each village of the State, requesting a statement of the amount of the present indebtedness of their respective cities,'counties, towns and villages, the time when and the purpose for which the same was created, and ‘the time when payable, and, also, the amount of the present assessment roils of said cities, counties, towns and villages. Immediately after the adjournment, in December, the Clerk of this Commission prepared a circular, with blanks, on which to enter the data called for, and forwarded the same to the mayors of each city in the State, for the debts of the cities; to the clerks of the boards of supervisors, for the debts of the counties; to the supervisor of each town, for the indebtedness of the towns; and to the presidents of each incorporated village, for the debts of villages. A large majority of those to whom the circulars were addressed promptly responded, but, in some instances, two, and even three, duplicate circulars had to be forwarded before a response could be obtained. In ten towns the data desired had to be obtained from other than official sources. The Legislature of 1870 passed a law requiring the supervisors of each town to report at the annual meeting of the board of super- visors in each county the amount of indebtedness of each town, that the facts might form part of the records of those boards. It appears that this law is not complied with, except in a few counties. In a majority of the counties not a single supervisor has made the report required by that law, and, in others, only a portion of the super- visors have complied with it. With all the tardiness on the part of some of the supervisors to respond, it is believed that a correct statement has been obtained2 from official and unofficial sources of tlie entire municipal indebted ness of the State, except it may be of a few unimportant villages. The facts thus obtained have been arranged by the Clerk in tabu- lar form, by towns, cities and counties, and present important questions for the consideration of this Commission, and all those interested in the subject of debts and taxation. The facts and data presented show, in many instances, a great abuse in the exercise of the power of creating municipal indebtedness, and a recklessness in the creation of obligations for future generations to pay. The debt, in a large majority of the towns bonded, has been • created under either the general or special railroad bonding law. The general rule appears to be, to exchange the bonds issued by the towns for stock in the roads which it is proposed to aid. In a few instances, the town authorities have been able to sell the stock after the road has been completed for from 70 to 75 per cent of the value of the bonds, but these are exceptional instances. In a few cases, the roads thus aided by towns have been leased to other roads, on a guarantee of interest upon the outstanding 'obligations, but at a lower rate than the interest on the bonds of the town; but, neverthe- less, lightening the burdens of the towns. In nine-tenths of the towns, the property, real and personal, will be compelled to pay not only the interest but, also, the full amount of the bonds issued. Most of these obligations fall due between 1880 and 1900. The prevalent custom appears to have been to issue bonds for twenty or thirty years and those of each town all falling due on the same year. Some of the towns have been bonded in this manner for twenty, thirty, and even fifty per cent of their assessed valuation. Next in importance to the railroad bonding is that of bonding towns for boulevards, avenues and gravel drives. In some localities that has been carried to an extent far greater than bonding for rail- roads. This class of debts have been created under special laws of the Legislature, passed without the people knowing their full import. The Clerk has arranged the data in six different classes of tables. The first is a detailed statement of each of the sixty counties, in which will be found the name of the towns, cities and villages in each county, with the amount of indebtedness of each town, city and village, the date when contracted, the purposes for which it was contracted, the time payable, and the assessed valuations of the real and personal property of each town, village and city, with the total of the county. The footings of aggregate valuation of real and personal property in each county, contain the' aggregate valua-3 -tions of the towns and. cities. All property of villages is assessed by the towns in which they are situated, and is included in the assessed valuation returned for the towns. The villages, however, have a separate assessment roll for village purposes, but it covers the same property assessed by the town. The assessed valuation returned by the village authorities is not iqcluded in the aggregate for each county. It is given separate in tables, in order that the per- centage of debt to valuation may be deduced therefrom if desired. It will be noticed that the assessed valuation of personal property in some of the villages as returned, exceeds the entire valuation of the personal property of the whole town, including, in some cases, other villages and farm lands outside of villages, showing a different mode of assessments for village from that for town purposes. The second table is a recapitulation of the aggregates by counties. In this will be found the entire debts of the county, cities, towns and villages in each county, for each of the Specified purposes, together with the total debt and total valuation, and percentage of debt on assessed valuation of each county. By reference to this recapitulation the following result will be seen : There have been issued by towns, cities and villages of the State, in aid of railroads, and remaining unpaid, $26,946,662.09. For the purpose of erecting public buildings, such as court- houses, city and town halls, and school buildings, $10,416,864.84. Of the debt growing out of the recent civil war, there remains unpaid $26,934,696.19. Bonds issued for roads, boulevards, streets, avenues and bridges, amount to $36,658,144.59. For water-works and fire apparatus, $29,335,383.79. For parks, local improvements and other purposes, $84,052,655.08. Making the aggregate bonded indebtedness of counties, cities, towns and villages of the State, the enormous sum of $214,344,676.58. The entire valuation of real and .personal property of the State is $2,124,034,143.46; showing that, aside from the detyt of the State and United States, the local bonded indebtedness of the State is equal to ten and T^- per cent of the assessed valuation of the entire property. Ulster county is bonded for twenty-four and per cent; Che- nango, twenty and \ per cent, and Oswego sixteen per cent upon their assessed valuation. The entire local indebtedness outside of the city of New York is $95,483,946.72.4 The third table contains a recapitulation of the county bonded debt, or the bonds issued by county authorities and chargeable to the county at large. The counties not enumerated in this statement have no county bonded debt. It will be seen that thirty-nine coun- ties have a bonded debt, and twenty-one counties have none. The amount of bonds outstanding against those thirty-nine counties amounts to $46,685,264.40. This includes what is known as the county debt of New York. The assessed valuation of the counties thus bonded is in the aggregate, $1,931,645,392.46, making a per- centage of county debt upon the valuation of nearly 2f per cent. The counties outside of New York have a county debt of $15, 030,159.94. The fourth table is a recapitulation of the debts of cities. There are twenty-four cities in this State, the aggregate indebtedness of which amounts to $137,539,609.34, exclusive of the county debt of New York and a portion of the town debt of Yonkers, which are a debt upon those cities. The aggregate assessed valuation of the cities is $1,497,894,469.20, showing a percentage of 9 ^ per cent upon the valuation of all cities in the State. The city of Loekport has no bonded debt, but has a floating debt of $2,794.86. This is the only city without a bonded debt. The city of Poughkeepsie has the largest amount of bonds in pro- portion to its assessed valuation, the debt being 31 per cent of the valuations. Oswego comes next, being bonded to the extent of 21 per cent of its valuations, while Binghamton and Utica are each bonded to the extent of over 16 per cent. Brooklyn, 15f per cent, and the entire property of Kings county is bonded to the extent of 17-3^ per cent. New York, including the city and county debt, without deducting the $23,000,000 in sinking fund, is bonded lOf per cent. The fifth table exhibits a statement of the number of towns in each county bonded, and the number not bonded, with the aggre- gate indebtedness and valuations of the towns which are bonded. There are four hundred and sixteen towns in the State bonded, and five hundred and seventeen towns not bonded. The aggregate indebtedness of those towns amounts to $25,167,- 781.83. The assessed valuation of the towns bonded amounts to $328,292,233.16 equal to Tf per cent upon the entire assessed valu- ation of the town bonded. The last table is a recapitulation of villages bonded in alphabeticalorder. From this it will be seen that there are sixty-six villages which have a bonded debt, the aggregate of which is $2,204,700.09. There are one hundred and fifty-five villages which report no bonded debt, and, in almost every instance of this kind, the response is accompanied with a statement that their charter prohibits the issuing of bonds. Thirty-five villages have not responded. Four of those villages, which have failed to respond, are known to have a bonded debt, but the Clerk has been unable to ascertain the amount. The other villages which have not responded are believed to be free from debt. Six villages have contracted debts, the bonds for which have not yet been issued. By an examination of the detailed statements it will be seen that a large amount of the town bonds were issued in 1872, showing that the practice of town bonding is still in progress. In addition to the amount of municipal indebtedness as stated above, an additional amount of bonds have been authorized by municipalities to the amount of $2,165,000, all of which will unquestionably be issued within the next three or four months. In addition to that a num- ber of towns are now going through the preliminary process of bonding, with every indication that the municipal bonded debt, at the close of 1873, will reach fully the aggregate amount of $225,000,000. Your committee, in view of the above facts, believe that the time has arrived when it is absolutely necessary to impose some restraint upon the power of municipalities to incur debt, for if that process is continued in the future as it has in the past, as shown by the statistics herewith submitted, the result will be in the highest degree disastrous. Your eomlnittee present, in connection with this report, a section prohibiting cities, towns and villages hereafter incurring debts, including existing indebtedness, beyond ten per cent of their assessed valuations, which they recommend this Commission to adopt as part of the Constitution of the State.
