OCT 25 WW PREFACE. i For the guidance and assistance of those who ma}^ desire to purchase from the state of California school lands suitable for cultivation in con- formity with the provisions of Chapter 395 of the Statutes of 1915, which is hereinafter printed, the following constitutional and statutory provisions, together with certain excerpts from the decisions of our Supreme Court construing the same, are inserted herein. Close adher- ence to the law as herein declared will greatly facilitate the accomplish- ment of the desired end. Applicants are, therefore, earnesly requested to study carefully these constitutional and statutory provisions in the light of the accompanying decisions and to follow the same closely in the preparations of their several applications. W. S. Kingsbury, Surveyor General. -25455 CONSTITUTIONAL PROVISIONS. Article XVII, Section 2. The holding of large tracts of land, uncul- tivated and unimproved, by individuals or corporations, is against the public interest, and should be discouraged by all means not inconsistent with the rights of private property. Article XVII, Section 3. Lands belonging to this state, which are suitable for cultivation, shall be granted only to actual settlers, and in quantities not exceeding three hundred and twenty acres to each settler, under such conditions as shall be prescribed by law. STATUTORY PROVISIONS. Section 3495 of the Political Code, provides, in part, as follows : " * * * ]s^Q application shall contain lands situated in more than one county. The Surveyor General and Kegister of the Land Office must make and enforce all necessary rules and regulations to prevent the sale of school lands suitable for cultivation to any person not an actual settler thereon ; provided, that any smallest legal subdivision of school lands shall be deemed suitable for cultivation if any part not less than one-half of its area will, without artificial irrigation, but with or without the clearing of timber or other growth therefrom, by the ordinary processes of tillage, produce ordinary agricultural crops in average quantity ; and provided, that any contest of the applicant's right to purchase, arising from the character of the land as cultivable or otherwise, may be referred to the Superior Court of the proper county, as in other cases, for determina- tion; and provided, further, that no contest of the applicant's right to purchase arising from adverse occupation, shall be maintained, except by a prior adverse occupant, who shall have filed an application to pur- chase the land under the provisions of this section, and no occupation of land by a person other than the applicant shall be an adverse occupa- tion within the meaning of this section, unless such occupation is by a person who is entitled to purchase the same under the provisions hereof, and who files his application therefor within the time prescribed by section 3497 of this code. If any portion of the land applied for is not open to entry, the Surveyor General shall file the application for such portion as may be open to entry, eliminating from the application such .land as may not be open to entry." Section 3497 of the Political Code — Occupants protected. "Every occupant of a sixteenth or thirty -sixth section is protected in his occu- pancy for three months after the township has been sectionized: and any person settling upon a sixteenth or thirty-sixth section after a town- ship has been sectionized has sixty days after such settlement in which to file the application required in the preceding section." DECISIONS CONSTRUING THE FOREGOING CONSTITU- TIONAL AND STATUTORY PROVISIONS. Under section 3, article 17, of the Constitution, and section 3495 of the Political Code, a claimant to purchase from the state of California a tract of its land which is suitable for cultivation, must be, at the time of filing his application, an actual settler thereon. An actual settler upon land belonging to the state is one who estab- lishes himself upon the land or fixes his residence upon it, to take posses- sion for his exclusive occupancy and use, with a view to acquire title to it by purchase from the state. For that purpose, an actual entry upon land belonging to the state, followed by making improvements upon it, or building a house thereon in which to reside, and occupation of the land while doing such acts, are evidence of such a settlement as gives to the occupant, if he possesses the qualifications prescribed by law, an inchoate right to purchase the land, and operates as notice to all the world of the right. Gavin vs. Mohr, 68 Cal. 506. The policy of the state is here declared (section 3, article 17, Constitu- tion) to be against selling any lands suitable for cultivation in tracts in extent exceeding 320 acres, or to others than actual settlers. And this policy is greatly emphasized by the preceding section, which plainly declares that the holding of large tracts, uncultivated, is against the public interests, and should be discouraged by all means consistent with private rights. In view of such declarations it must be manifest that it was intended that all lands within this state should, so far as govern- mental action could accomplish it without violating private rights, be held in small tracts, and constitute homes for its owners. No narrow construction of the only words in the section open to construction — "suitable for cultivation" — should limit this policy. The effort should be rather to extend than to restrict, for the policy is plainly that the section should include all as far as possible. The constitution classified all land as suitable or not suitable for cultivation. For the purposes of this section, neither the legislature nor the courts can classify them otherwise, and it must follow that whether a particular tract belongs to one class or the other must always be a question of fact. Fulton vs. Brannan, 88 Cal. 454. An applicant to purchase school lands from the state must be a citizen of the United States, or have declared his intention to become such ; and while the amendment of .1880 to section 3945 of the Political Code wa^ in force, he must have been an actual settler upon the land, whether it M'as suitable for cultivation or not, and must have so stated in his affidavit to purchase. If the qualifications of citizenship and actual settlement, or either of them, be wanting in fact, the application, and a certificate of purchase issued thereunder, are void and a mere possessor of the land can assail the certificate of purchase in an action of eject- ment on these grounds. Trimmer vs. Bode, 82 Cal. 647. 2 — 25455 4 SURVEYOR GENERAL. The provisions of the Constitution and of the Political Code requiring actual settlement upon lands belonging to the state which are fit for cultivation are imperative; and an applicant for such land must not only state the requisite facts as to such settlement in his affidavit, but the facts as stated must be true, or he can acquire no rights under his application. Davidson Exec, etc. vs. C. Fruit and Land Company, 78 Cal. 4. Under the provisions of the Constitution restricting grants of state lands to actual settlers, no grant can be earned by one not an actual resident on certain state lands which he seeks to purchase, but who manages the land in question by means of servants. Mosely vs. Torrcnce, 71 Cal. 318. An actual settler upon state lands, who is compelled to seek a tempo- rary residence elsewhere for the purpose of obtaining relief for a sick member of his family, does not thereby abandon his settlement. Greenwood vs. Decamp, 79 Cal. 1. The fact that an applicant who testified that he was living upon swamp land suitable for cultivation removed his family therefrom temporarily, because of the ill health of a member of the family, does not show nor tend to show that he was not an actual settler upon the land. Maddnix vs. Brown, 91 Cal. 523. The purchaser is required to be an actual settler. He must show something more than that he has eaten and slept on the place, besides having a cabin there, and that he has made some fanciful attempts at planting trees and cultivation. The section means real settlers on the land, and not occasional visitors. It does not contemplate casual acts, done, not in good faith to make a home, but simply to secure cheap land. Although if a home is actually established motives can not be further questioned. Belcher vs. Farren, 89 Cal. 73. The provisions of section 3 of article 17 of the Constitution that "lands suitable for cultivation shall be granted only to actual settlers" speaks with reference to the condition of the land at the time of the initiation of proceedings for purchase, without reference to its condition of unsuitableness for cultivation previous to said application, or the manner in which it became suitable therefor. Boggs vs. Ganeard, 148 Cal. 711. "We think the evidence sufficiently showed that the land was subject to settlement when the defendant entered upon it; that he entered to make a settlement thereon, and that, in the exercise of his right, he began making his improvements upon the land with a view to future occupancy and residence thereon. These acts, and the occupation of the land while engaged in performing them, gave the defendant the DECISIONS. status of an actual settler in the sense of the law which authorized him to purchase; and as he made and filed his application to purchase while engaged in the act of settlement, the law protected him for sixty days after settlement. Qavitt vs. Mohr, 68 Cal. 510, The phrase "lands belonging to this state suitable for cultivation" includes all lands ready for occupation, and which by ordinary farming processes are fit for agricultural purposes. The land in controversy is situated in Santa Cruz Mountains about six miles from the coast, and is difficult of access on account of the absence of roads. Its surface is rolling and uneven, but not steep, and its soil is of a rich nature. The greater portion of the surface is covered with brush and redwood timber, which would have to be removed before the land could be plowed. There are, however, spaces and openings aggregating less than one-half, ready for plowing. The land has a dis- tinct value for its timber, but would be more valuable for agricultural purposes after the timber was removed. Held, that the land was suit- able for cultivation within the meaning of the Constitution. Manley vs. Cunningham, 72 Cal. 236. The language of section 3495 of the Political Code, which describes what character the land shall possess in order to make it agricultural, should be taken in its broadest sense, and be held to include crops of fruit in the term "ordinary agricultural crops," especially in view of the circumstance that a very large portion of the husbandmen of the state are engaged in tilling portions of the soil in which are growing various descriptions of fruit — a fact well known to the people and their legislative representatives who enacted the law. It will not do to say that in California apples, prunes, and grapes are not ordinary agri- cultural crops. Beeves vs. Hyde, 77 Cal. 397. The fact that school land is in most places heavily covered with red- wood timber and brush ; that it would not when cleared, produce ordi- nary agricultural crops in average quantities ; and that it is more valuable for timber than for agriculture, does not render it unsuitable for cultivation within the meaning of section 3, article 17 of the Con- stitution. Jacobs vs. Walker, 90 Cal. 43. The fact that school land does not produce "ordinary agricultural crops in average quantities" does not render it unsuitable for cultiva- tion, within the meaning of section 3, article 17 of the Constitution. Albert vs. HoUer, 111 Cal. 398. The facts, we think, show, independently of the opinion, evidence complained of, that the land is suitable for cultivation. The land is level, free from serious obstruction to plowing, the soil a rich, sandy loam. It is near Lake Tulare, but has been dry for some years; and SURVEYOR GENERAL. there is evidence that the lake is steadily receding year by year. If in such a soil crops sometimes, or often, fail through drought, it can not be said, in this state, that the land is therefore unsuitable for cultivation. Belcher vs. Farren, 89 Cal. 77. In view of the provisions of the Constitution discouraging the holding of large tracts of uncultivated and unimproved land by individuals and corporations and that land "suitable for cultivation" can not be pur- chased by one not a settler thereon, school land, some portion of which in each legal subdivision is suitable for cultivation, can not be purchased by one not a settler thereon; and the words "suitable for cultivation" must be held to apply to all tracts of land on which there is arable or tillable land sufficient, with the use of other lands for pasture or other- wise to furnish a permanent home for the settler. Sanford vs. Maxwell, 3 Cal. App. 242. Held, that land absolutely unfit for cultivation unless by the boring of artesian wells water may in the future be developed in sufficient cpantities as to render it possible to artificially irrigate the same, is land not suitable for cultivation within the meaning of the constitu- tional provision. (Distinguishing Fulton vs. Brannan, 88 Cal. 454.) RoUnson vs. Eherhart, 148 Cal. 495. ^u^uii^jgiinB LAWS GOVERNING THE SALE OF SCHOOL LANDS IN THE STATE OF CALIFORNIA. CHAPTER 389. An act providing for the sale of certain state lands. [Approved May 19, 1915.] The people of the State of California do enact as follows: Section 1. The unsold portions of the sixteenth and thirty-sixth sections of school lands not included within the exterior boundaries of national reservations, the unsold portions of the five hundred thousand acres granted to the state for school purposes, and the unsold portions of the listed lands selected of the United States in lieu of the sixteenth and thirty-sixth sections and losses to the school grant, shall be sold at public auction by the surveyor general, under such rules and regula- tions as may be prescribed by him, to the highest bidder, who must be a citizen of the United States, the sale to be advertised in some news- paper in the county in which the land is situated, or if there is no news- paper published in the county, then in some newspaper of general circulation in the county, said newspaper to be designated by the state board of control; provided, Jiowever, that any such lands which in the judgment of the surveyor general contain growth valuable for forest- cover protection to water sheds, or are valuable for reservoir sites, shall be withheld from sale by the state ; the full purchase price of the land, or ten per cent thereof and interest to the first day of January following, at the rate of six per cent per annum on the unpaid balance of the purchase price, to be paid at the time of the acceptance of the bid ; the unpaid balance of the purchase price shall bear interest at the rate of six per cent per annum, payable in advance on the first day of each year, at which time the purchaser may pay as many one-tenths of the purchase price as he may desire ; provided, that the legislature may require the payment of the unpaid balance of the purchase price within five years after the passage of an act requiring such payment. All payments to be made to the county treasurer of the county in which the land is situated. Sec. 2. "When the full purchase price has been paid the purchaser shall be entitled to a patent for the land. Sec. 3. Those parts of all acts in conflict with this act are hereby repealed. SURVEYOR GENERAL. CHAPTER 395. An act providing for the sale of certain state lands suitable for cultivation. [Approved May 19, 1915.] The people of the State of California do enact as follows: Section 1. The unsold portions of the sixteenth and thirty-sixth sections of school lands not included within the exterior boundaries of national reservations, the unsold portions of the five hundred thousand acres granted to the state for school purposes, and the unsold portions of the listed lands selected of the United States in lieu of the sixteenth and thirty-sixth sections and losses to the school grant, which are suitable for cultivation shall be sold to actual settlers in quantities not exceeding three hundred and twent.y acres to any one person under the provisions of section three thousand four hundred ninety-five of the Political Code, at a price to be fixed by the state board of control and the state surveyor general, payment to be made as follows : The full purchase price of the land, or ten per cent thereof and interest to the first day of January following, at the rate of six per cent per annum on the unpaid balance of the purchase price ; the unpaid balance of the purchase price shall bear interest at the rate of six per cent per annum, payable in advance on the first day of each year, at which time the purchaser may pay as many one-tenths of the purchase price as he may desire ; provided, that the legislature may require the payment of the unpaid balance of the purchase price within five years after the passage of an act requiring such payment ; * * *. Section 3500 of the Political Code. — False statement. Timber lands to be sold for cash at full price. "Any false statement contained in the affidavit provided for in section 3495, defeats the right of the applicant to purchase the land, or to receive any evidence of title thereto, and, if wilfully false, subjects him also to punishment for perjury. Timber lands belonging to this state shall be sold for cash only, and the Sur- veyor General and Register of the State Land Office must make and enforce all necessary rules and regulations to prevent the sale of or issuance of any evidence of title to any timber lands of this state, except on payment, in cash, of the full price fixed therefor by law." RULES AND REGULATIONS. RULES, REGULATIONS AND INFORMATION CONCERNING THE SALE OF SCHOOL LANDS IN THE STATE OF CALI- FORNIA. 1. Should a citizen of the United States desire to purchase land unsuitable for cultivation pursuant to the provisions of Chapter 389, Statutes of California, 1915, page 605 (see preceding copy), he should so advise the Surveyor General at Sacramento, by letter, giving a description of the land. 2. When the Surveyor General is satisfied that the demand for land unsuitable for cultivation in any one county will warrant the expense of advertising and conducting a sale in that county ; the description of the land to be sold, the date and the place of sale in the county seat of the county in which the land is situated will be advertised in a newspaper published in the county, or if there is no newspaper published in the county, then in some newspaper of general circulation in the county, the newspaper to be designated by the State Board of Control. All persons, who have made their desire to purchase land unsuitable for cultivation known to the Surveyor General, will be notified by mail when the sale of the land desired is to be held. 3. School lands unsuitable for cultivation will be sold to the highest bidder in quarter quarter sections of 40 acres each, or if the sections are subdivided into lots containing a fraction more or less than 40 acres, the sale will be by lots, there being no limit as to the number of 40-acre tracts or lots that one person may buy. The Surveyor General reserves the right to reject any and all bids. At the time of bidding each bidder must present an afiidavit that he is a citizen of the United States, which affidavit must contain the post-office address of the affiant. Agents may bid for principals, upon submission of affidavit of citizenship of princi- pal and power of attorney to bid for principal. 4. At the time of the acceptance of the bid the purchaser must pay to the county treasurer of the county in which the land is situated the full purchase price of the land, or 10 per cent thereof with interest on the balance at the rate of 6 per cent per annum from the date of sale to the first of January following. The purchaser must also pay the county treasurer $3.00 for a certificate of purchase, which will be issued pursuant to the provisions of section 3514 of the Political Code, upon surrender to the Surveyor General of the receipt of the county treasurer, showing payment as herein provided. 5. Interest, on the balance of the purchase price of the land, at the rate of 6 per cent per annum, is due and payable in advance on the first day of each year after the date of the purchase, and if the interest is not paid on or before the first day of May following, the certificate of purchase becomes null and void and the land reverts to the state without suit (section 3513, Political Code) and it can not be redeemed. The purchaser may, on the first day of each year, pay as many one- tenths of the balance of the purchase price as he may desire, thereby reducing the interest. 6. Certificates of purchase and all rights acquired thereunder are subject to sale by deed or assignment, executed and acknowledged before 10 SURVEYOR GENERAL. anj'- officer authorized by law to take acknowledgments of conveyances of real property, or before the register, but 'patent for the land must issue in the name of the original purchaser upon payment of the full purchase price (section 3519, Political Code), reserving in the people the absolute right to fish thereupon. (Section 25, Article I, Constitu- tion of California.) 7. Lands suitable for cultivation must be sold to actual settlers, as provided by Chapter 395, Statutes of California, 1915, page 634 (see preceding copy), by mailing to the Surveyor General at Sacramento an application to be made in accordance with the provisions of sec- tion 3495 of the Political Code. Forms for application can be secured from the Surveyor General. The approval of the application will be governed by the provisions of section 3498 of the Political Code. 8. The character of the unsold school lands can only be satisfactorily determined by an examination thereof. The state of California does not issue maps or plats showing the location of the laud, but having their description, their approximate location can be determined by using in conjunction with the accompanying list, county maps which can be secured from most stationery stores at a cost of about 50 cents. The Surveyor General is the only agent of the state for the sale of its school lands and it is not necessary to pay any one for information relative thereto. The school lands were all surveyed by the United States Government and it may be that the corners are now obliterated, in which event it will be necessary, should one desire to have the corners located, to employ a surveyor for that purpose. INSTRUCTIONS TO PURCHASERS. 11 INSTRUCTIONS TO PURCHASERS. Forms of application to purchase, as actual settlers, lands suitable for cultivation under the provisioiis of Chapter 395 of the Statutes of 1915, may be obtained upon application to the Surveyor General. Such forms after having been properly executed by the applicant should be returned to the Surveyor General's office, Sacramento, Cal., accompanied by a $5.00 filing fee. If the land is any part of a sixteenth or thirty-sixth section a $20.00 deposit is required by law in addition to the filing fee and said $20.00 will be accepted by the County Treasurer as part pay- ment for the land. After an application has been on file in the Surveyor General's office ninety days, the applicant must furnish proof of actual settlement by his affidavit corroborated by tM^o disinterested persons. The approval of the application will be governed by the provisions of section 3498 of the Political Code. Any person desiring to acquire school lands suitable for cultivation must he a resident of this state of lawftil age and a citizen of the United States, or must have declared his intention to become a citizen, and he must be an actual settler upon the land when he makes his application to the Surveyor General to purchase such land. The determination of whether the land sought to be purchased is suit- able for cultivation lies with the Surveyor General and the State Board of Control, as does also the fixing of the price at which the land shall be sold, which is determined by examination and appraisement in each particular ease. Upon the authority of Manley vs. Cunningham, 72 Cal. 236, and other similar decisions, it has been determined for purposes of sale under Chapter 395 of the Statutes of 1915, that if 70 or 80 acres of a 320-acre tract are arable or tillable, thereby being sufficient, with the use of the other lands for pasture or otherwise, to furnish a permanent support to the settler, the provisions of this law will apply and the applicant would be allowed to complete his purchase. School lands not suitaMe for cultivation will be sold pursuant to the provisions of Chapter 389, Statutes of California, 1915, to the highest bidder at public auction. The Surveyor General has no information concerning the character of any of the vacant school lands. For information relative to Indian, homestead, desert and other gov- ernment lands, you are respectfully referred to the United States Land Office of the district wherein the lands are situated.
