I William Martyn of Netherex in ye County of Devon Esquire being of perfect memory but weake and sick in body do publish & declare this my last Will & Testament as hereafter followeth-Imprimis I give my soule into ye hand of Almighty God my most merciful father trusting through ye merits of Jesus Christ to obtaine eternal salvation and my body I give unto Christian buriall. Item I give unto Elizabeth Martyn my loving Wife all that part & parcells of ground which lately was expressed in a certain deed made in trust to my Brother Shilstone Calmady for her use as an addition to her joynture the whole being to ye value of fifty or neere three score pounds a yeare or thereabouts. Item I give her my Coach & two Geldings. Item I give her my sayd Barton house of Netherex with the gardens & orchards thereunto belonging to her own use till my Executor (who shall be last of all named) shall attain to ye years of one and twenty. Item I give unto her my farme at Heavitree as it is made away by writing formerly expressed during the term of her life. Item I give her the household goods which are now in ye sayd Barton house at Netherex to bee made use of at her pleasure till my sayd Executor shall attaine unto ye yeares of one & twenty. Item I give unto my daughter Elizabeth Martyn ye whole summe of nine hundred & fifty pounds & fifty pounds more which was given her as a legacy by my Lady Lawdy deceased which whole summe of one thousand pounds it is my will and pleasure yt my Executour hereafter mentioned should pay in unto her when she comes to bee of ye age of foure & twenty yeares. Item I give unto my daughter Honoure Martyn ye summe of eight hundred and fifty pounds and fifty pounds more which was given her as a Legacy by my Lady Lawdy deceased which whole summe of nine hundred pounds it is my will and pleasure yt my executour also hereafter mentioned shall pay unto her when shce also comes to bee foure and twenty years old. Item I give unto my daughter Gertrude Martyn ye summe of six hundred pounds to be payed unto her by mine Executor hereafter mentioned when she shall attaine to ye age of one & twenty. Item I give unto my daughter Susanna Martyn ye summe of five hundred pounds to be payed unto her by my Executor hereafter mentioned when she attains to the age of twenty and one and shall further leave her to be better provided for at ye good pleasure of her dear Aunt my sister Stennings. Item I give unto my sonne Willyam Martyn ye summe of two hundred pounds to be payed unto him by my Executour hereafter named when he comes to ye age of twenty and one. Item I give him for the term of his life the tenement & premises in which John Churchill & his Wife are possessed of during the terme of their lives. Item I give unto my sayd sonne for the terme of his life three pieces of ground in Thorverton which Robert Warring & his Wife are possessed of during their lives and it is my desire that hee should be trained up for the ministrey. Item I give unto my sonne John Martyn ye summe of two hundred pounds to be payd to him by my Executor hereafter named when he comes to ye age of twenty and one. Item I give him for the term of his life ye house in St Peter's Churchyard in Exon now in ye possession of Francis Cooke if hee shall survive Amose Short, Minister of Lyme & Grace or Mary Madge who have an Estate in ye same for their lives. I give him this house the rather because it is my desire yt he should bee a Merchant. Item I give him for ye terme of his life all that tenement in Vognacott which was lately in ye possession of John Penrose deceased but graunted by me to two of his sonnes each of them having two lives on halfe part of ye tenement. Item I give him for ye terme of his life those grounds (which are now or were late in ye possession of Elizabeth Curry) in Holesworthy & to bee held for her life & the life of John Moysey if my sonne shall survive them my pleasure is that hee should enjoy them during life. Item I give unto Mr Ford of Exon Minister as much black cloth as shall make him a suite & cloake to ye ground to bee sent him at the day of my funerall. Item I give unto my worthy friend and neighbour Mr Edward Parr of Rew as much blacke cloath as shall make a suite & cloake to ye ground to bee sent him against ye day of my funerall & it is my will if he please that hee should speak some words when I am layd into my grave. I give unto Thomas Coale my servant all mye wearing apparell linen & woolen unleste a new suit now come for mee to Exon which I desire may bee returned by my Wife unto Mr Doble of London. Item I give unto my servant Edward Gannutt blacke cloath for a suit & cloake. Item I give unto William Heckeman mine Apprentice ye summe of five pounds to be payd unto him by my Wife & my Brother Shelstone Calmady when he hath served out the terme of his apprenticeship & it is my desire yt he should stay wth his mistresse longer. Item I give unto my man John ye summe of twenty shillings. Item I give unto my Wife aforesayd & to my Brother Shelstone Calmady of Leawood all my outgoods & all my Corne in Barne in mow and in ground; to this intent that there being one hundred & fifty pounds owing by mee to Mr Isaac Manditt of Exon my very good friend & ye summe of One hundred pounds more owing by mee to one Robert Ridler may be payd to the persons aforesaid within one half year after my decease out of the aforesayd goods & my Will is that my sayd Wife & Brother Calmady doe with the overplus of ye sayd corne & goods (if any shall bee) pay my smaller debts where they shall be found honest & just. And I doe entrust my sayd Wife & my Brother Shelstone Calmady, if he please to receive all my rents profitts & dues • *"Immediately before whose death, as he lay sick on his bed at Netherex, one of the bells of that church began to toll of itself, and continued so to do, to the time of his death, about the space of a quarter of an hour. [ 9 ] & to emprove & sett out ye remaining part of ye said Barton of Netherex not formerly granted either from year to year or as they shall think fitt giving in an account of ye profits of ye land unto my Sonne Nicholas Martyn when he shall attaine to ye age of twenty & one. Item I give unto my sonne Nicholas Martyn my Signett of gold wch was given mee by my father & I doe give unto him all my lands & tenements rents & reversions in ye County of Devon (except before excepted) to him & his heires in fee for ever. Item I give unto sayed sonne Nicholas Martyn all my lands, houses, gardens & orchards within ye City & County of Exon & suburbs of ye same to him & his heires in fee for ever charging him yt what grants I have made for his profitt he never question in ye Court to make good. Lastly my Will is that ye said Nicholas Martyn shall be my whole & sole Executour. Unto all my friends adieu. And my further Will is yt in case either of my foure daughters should dye before they bee of age to receive their moneys she that dyes first her sayd portion formerly given shall bee payd at such day & time as is expressed unto my two youngest sonnes William & John by equal parts & portions. I give to my two nurses nurse Green & Nurse Cloister my house in St Mary Orchards in Exon where my Nurse How hath her life in two chambers. "I, Elizabeth Martyn of Kenton, widdow-unto my sonne Nicholas Martyn-unto his wife my chiney dishes in my closet-unto my daughter in law, the wife of William Martyn my sonne, my mother o' pearl dish-unto my sonne John Martyn's wife, my gold ringe with Fortescue and Calmady armes engraven on it-to my daughter Honor Martyn, twentye poundes. In the Name of God Amen. I John Martyn of the Parish of St. Paul Covent Garden within the Liberty of Westminster Esqr. being in perfect health of body and of good and perfect memory (praised be God) do make and ordain this my last Will and Testament in manner and form following that is to say First and principally I commend my Soul into the hands of God my Creator and Redeemer trusting and assuredly hoping through the merits and mediation of my blessed Lord and Saviour Jesus Christ to inherit eternal life my body I commit to the earth to be decently buried in Christian burial at the discretion of my Executrix herein after named in sure and perfect expectation of a joyful Resurrection at the last day and in respect of my worldly estate wherewith it hath pleased Almighty God to bless me I order and dispose of the same as followeth (vizt.) Whereas I did by some instrument in writing before my marriage with Philip' Martyn my now wife covenant and agree (amongst other things) that if she should survive me I would at the time of my decease give and leave unto her the said Philip my wife one full third part share and proporc'on (the whole being divided into three equal parts) of the clear estate which I should happen to dye possessed of or intituled unto in pursuance whereof and in full and absolute discharge of my said covenant and agreement and in full of her thirds and right of dower and all other claims which she the said Philip my wife may have or make in or to my said estate other than what is contained in this my last Will I do give and bequeath unto the said Philip my wife All that my capital stock in the Bank of England amounting to the full sum of two thousand pounds stock which I now esteem to be worth upwards of two thousand seven hundred and fifty pounds Item I give and bequeath unto my said wife All that messuage or tenement wherein I now dwell situate in King Street in the Parish of Saint Paul Covent Garden aforesaid with the backbuildings garden and appurtenances thereunto belonging and all my estate right interest and term in and to the same under and subject to the rents and covenants I am obliged to for or in respect thereof Item I give and bequeath unto my said wife all and singular my plate jewells household goods utensils and implements of household in and about the same premises Item I give and bequeath unto my said wife my two Orders issuing out of His Majesty's Exchequer on survivorship for the respective lives of John Martyn and Thomas Martyn And whereas by the last Will and Testament of my late son Charles Martin deceased I stand charged with the sum of one thousand pounds to be paid by me to his Widow in twelve months after his decease my Will and mind is if the said one thousand pounds shall be behind and unpaid at the time of my death that my Executrix shall and may discharge the same out of the South Sea Bonds which I shall leave for that purpose And I likewise desire my Executrix to pay Mr. William Swanton his Bill of Costs which shall appear to be due when taxed deducting the fifty pounds I have already paid him as in part thereof Item I desire my Executrix to pay unto Mrs. Susan Stole her Annuity of fourteen pounds a year for her natural life by half yearly payments Item I give and bequeath unto Charles Martin Esqr. all that my sixty two shares in Merchant's Water Works if not otherwise disposed of by me in my life time he performing every- thing that I am obliged to for or in respect of the said shares Item I give and bequeath unto my said nephew Charles Martin and his heirs for ever All that messuage or tenement situate in Woodbury in Com. Devon with all appurtenances thereunto belonging commonly called or known by the name of Rotterdam he indemnifying my Executrix from a covenant I entered into to Mary Trapnell Widow when she renewed the Lease and put lives in the same Item I give and bequeath unto my said wife all my South Sea Stock South Sea Annuities and South Sea Bonds In trust that she my said wife her executors and administrators shall pay or cause to be paid unto my said nephew Charles Martin for and during the terme of his natural life the yearly sum or Annuity of fifty pounds by four even and quarterly payments the first quarter to commence immediately from and after the time of my decease and upon this further trust that my said wife shall pay or cause to be paid unto my niece Tripe of the town of Chedley and her children the sum of two hundred pounds equally to be divided between them to my niece South- cott of Dowlish in Com. Devon one hundred pounds to my niece Hilson wife of Mathew Hilson of Honiton in Com. Devon one hundred pounds to the youngest daughter of my nephew John Martyn (who is known by my Executrix) one hundred pounds to my niece Young one hundred pounds to my nephew Thomas Martin two hundred pounds and to his daughter one hundred pounds to Mrs. Catherine Cooper Junr. and her sister Mrs. Philip Cooper one hundred pounds each to my niece Mrs. Elizabeth Langton one hundred pounds to my nephew William Martin Esqr. son of Brother William Martin fifty pounds to Mrs. Susan Stole now living with me fifty pounds to my brother Charles Hooper and to Mrs. Barbarah Baker ten pounds each to the Charity School belonging to the Parish of St. Paul Covent Garden aforesaid ten pounds and to my three [ 11 ] servants that now live with me the sum of five pounds each provided they are living with me at the time of my decease and to my great nephew William Clifford Martyn the sum of one thousand pounds all which legacies before mentioned my will is shall be paid within six months after my Executrix shall have made a final end and received the money due to me arising out of the third part of the Mannor of Muchelney in Com. Somerset pursuant to a contract made by my son Charles Martyn dec'ed with Mr. Richard Woodford And whereas my said son by his said last Will did devise unto me and my heirs All his interest right and title of in and to one third part of the undivided Mannor of Muchelney aforesaid I do hereby appoint and ordain and my will and mind is that all and every sum or sums of money arising therefrom or any ways to be raised by sale thereof or otherwise shall be applied towards the satisfying and discharging the following demand if any such shall hereafter lawfully appear vizt.
