NEVADA STATE PRINTING OFFICE JOE FARNSWORTH, SUPERINTENDENT 1921 PRELIMINARY ORDER OF DETERMINATION OF CARSON RIVER STREAM-SYSTEM AND ITS TRIBUTARIES IN THE COUNTIES OF ORMSBY, DOUGLAS, AND LYON The State Engineer of the State of Nevada, having heretofore and under and pursuant to section 18 of chapter 140, Statutes of Nevada, 1913, and Acts amendatory and supplemental thereto, selected in order of its importance for irrigation the Carson River stream-system and its tributaries lying and flowing in the Counties of Ormsby, Douglas, and Lyon, in the State of Nevada, for the determination of the relative rights to the use of the water of said stream-system and the State Engineer having given and published the notices and filed and made the orders as required by the provisions of sections 18 to 27 of the said chapter 140, Statutes of Nevada, 1913, and Acts amendatory and supplemental thereto, and having made the investigations, prepared the maps, observations and other data, as required by said sections of said Act, and having received and there having been filed with said State Engineer the proofs and statements of claims to the use of water from said stream-system, and all said proofs and evidence taken or given before the State Engineer, or obtained by said State Engineer, having been duly considered, said State Engineer hereby makes this his Pre- liminary Order of Determination, establishing the several rights of claims to the waters of said stream-system and its tributaries. The State Engineer finds 1. The duty of water ; 2. Length of season or time of use ; 3. Point of diversion and measurement ; 4. Method of use ; 5. Priority of rights ; 6. Distribution ; and the tabulation showing in order from left to right the first date of beneficial use of water on each separate area ; the date when the construction of dams and ditches was initiated; the culture in acres of harvest crops, meadow pasture, willow and sage pasture, swamp or overflow land ; the loca- tion by legal subdivisions of each tract of land ; length of season ; and duty of water in cubic feet per second and in acre-feet of the various claimants and users of water on said Carson River stream-system and its tributaries to be as follows : 1. DUTY OF WATER The duty of water on the Carson River stream-system for all types of lands shall be 3.6 acre-feet per acre, extending over a season of 180 days, and the amount shall be measured in close proximity to the land to be irrigated. 2. LENGTH OF SEASON OE TIME OF USE The length of the irrigation season shall be 180 days and commence on or about April 1 of each year, the exact date being dependent upon the season and river run-off. 3. POINT OF DIVERSION AND MEASUREMENT All measurements of amounts diverted are to be made at the point where the main ditch enters or becomes adjacent to the land to be irrigated or as near thereto as practicable, the location if not selected by the State Engineer to be t> kAHPTON ACCESSION MUCROFT UBRAMY ^ approved by him. Each \\aler user shall install and maintain substantial head- irates and weirs in his ditch or ditches. Due allowance for losses in ditches will be made by the State Engineer in rase it becomes necessary to divert addi- tional water into said ditches. 4. METHOD OF USE The parties named in this order, or their successors, shall not he required to take or use the amount of water allotted to them in continuous flow, but may cumulate the same or any part thereof in rotation or in periodic turn with the approval of the water commissioner, subject to his control, and direction under such rules and regulations as are prescribed by the State Engineer and the statutes of the State of Nevada. 5. PRIORITY OF RIGHTS Vested Rights. The tabulated list attached hereto shows the relative priorities of the rights of all vested water users on the Carson River. Granted Rights. Priorities of permits to divert water from the Carson River and its tribu- taries in Ormsby, Douglas, and Lyon Counties shall be from the date of the receipt of the application in the office of the State Engineer. These granted rights shall always be subject to the existing vested rights on the stream-system, and shall be subject to regulation and control by the State Engineer and Water Commissioner in the same manner and to the same extent as the vested rights which have been adjudicated and decreed under the provisions of the water law. 6.
